Modjeska and carried, the demands which were in proper form and approved by the Finance Committee, were alloyed and warrants to be drawn for same. On motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, a recess was taken for the Committee of the Whale to meet. After the recess Mayor Richter again called the meeting to order. Councilman L. S. Wilkinson introduced a Resolution entitled: A RESOLUTION FOR LEASE OF TIDELANDS AND OTHER REAL• PROPERTY ADJACENT THERETO OF THE CITY OF NEWPORT BEACH. The Resolution was read, considered, designated RESOLUTION NO. 441, and upon call of the roll passed by the following vote, to -wit: AYES, Councilmen L. S. Wilkinson, F. B. Modjeska, Fred W.Young, H. H. Williamson and Mayor Conrad Richter. NOES, Councilmen None. ABSENT, Councilmen None. The matter of a deed to the public library property which is paid for but no deed secured as yet, was considered and on motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson and carried, the details of the transaction were to be given to the City Attorney to arrange for the deed. Councilman L. S. Wilkinson, who is a member of the Library Board, asked for an appropriation for the purpose of enlarging the library building and on his motion seconded by Councilman F. B. Modjeska and carried, $1,500.00 was set aside out of the library fund for an addition to the present library building. Norman Robotham asked for an appropriation of $5 00.00 to be used by the Pacific Highway Association for putting Newport Beach on the road maps which they are getting out. The matter was considered and on motion of Councilman F. B. Modjeska seconded by Councilman Fred W. Young and oarried, $500.00 was allowed out of the advertising fund for this purpose, same to be paid about January 1, 1928. ' There being no further business on motion of Councilman F. B. Modjeska seconded by Councilman Fred W: Young and carried, the meeting adjourned to 7:30 o'clock P. M. on Monday, Nove er 1, 1927- Approved November 21, 1927- City Clerks City Hall, Newport Beach, Nov. 21, 1927. 'The City Council of the City of Newport Beach met in regular adjourned session at 7:30 o'clock P. M: on above date. The meeting was called to order by Mayor Conrad Richter. The roll was called showing the. full Council present. The minutes of the previous meeting were read and approved as read. Councilman H. H. Williamson stated that the Fire Committee would report favorably on allowing the Fire Department to purchase the boots, pants and helmets asked for, and also to allow them an extra fireman as relief man, and on his motion seconded by'Councilman Fred W. Young and carried, the expense of supplies and the additional fireman as relief man were authorized. On motion of Councilman L. S. Wilkinson seconded by Councilman F. B. Modjeska and carried, the communication from the Planning - Commission recommending the employment of Gordon Whitnall to do the preparatory work and draft a zoning ordinance for the City at an approximate cost of $2,400.007•was referred to the Committee of the Whole for consideration. The City Attorney was granted additional time until next meeting to prepare the fishing boat license ordinance. 477 City Engineer Kressly presented a map showing the location of the bridge and fill to be made for the Parkinson Syndicate, and requested permission to make application to the Government Engineer to grant permission to the Syndicate to construct same at the location designated. The matter was considered and on motion of Councilman F. B. Modjeska seconded by Councilman H. H. Williamson and carried, the City Engineer was instructed to draw up an application to the Government Engineer and present to the Council at the next meeting for consideration with the City Attorney. City Engineer Kressly reported that he made a survey of the S. F. Catey pier and that it extended 12 feet too far out in the bay, ' and on motion of Councilman H. H. Williamson seconded by Councilman F. B. Modjeska and carried, the Clerk was instructed to notify Mr. Catey that he would have to remove the outer 12 feet of the pier and move the float back 10 feet. On motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson and carried, the request of the Fire Chief for transfer of funds which was reported on by the Building Inspector, was referred to the Fire Committee and City Auditor for report at the next meeting. The communications were read and acted upon as follows: On motion of Councilman.Fred W. Young seconded by Councilman F. B. Modjeska and carried, the request of J. P. Hormen for permission to construct a pier in front of Lot g, Block 223, Section A, Newport Beach, was referred to the City Engineer for a recommendation and to lay over for the customary two weeks. On motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson and carried, the report of Water Superintendent Cundiff in regard to purchase of water supply from the C. E. Race interests, was referred to the Committee of the Wh @le for consideration, The communication from the Orange County Title Co. stating they held a deed to some ocean frontage in front of Block 22 Balboa East Side Addition which the City intended to purchase from Mrs. Edna R. Storey was considered, and on motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson,cthe_.deed . wts to be checked up and if found correct,, the Clerk was instructed to issue a warrant ' for the $1600.00 puroUase price and forward it to the Orange County Title Co. from the unappropriated fund for this purpose by the following vote: AYES, Councilmen L. S. Wilkinson, F. B. Modjeska, Fred W.Young, H. H. Williamson and Mayor Conrad Richter. NOES, Councilmen None. ABSENT, Councilmen None. On motion of Councilman F. B. Modjeska seconded by Councilman H. H. Williamson and carried, the communication from Hugh Miller, Manager of the Armistice Day Committee, thanking the Council for their co- operation on Armistice Day was filed. On motion of Councilman Fred W. Young seconded by Councilman F. B. Modjeska and carried, the communication from the Pacific Highuay Association thanking the Council for the appropriation made for advertising Newport Beach on the road maps, was filed. On motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson and carried, the communication from Hrs. B. H. Cass in regard to cleaning the sand off the boardwalk in West Newport, was referred to the Street Superintendent with instructions to report back. On motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson and carried, the transfers as suggested by City Auditor Briggs of.$lp300.00 from the unappropriated library fund and $200.00 from the general fund for the enlargement of the library building, was authorized. On motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, the request of the National Orange Show of San Bernardino for permission to string banners across the street in the City, was allowed and the Clerk to notify them to that eff.ect.. On motion of Councilman H. H. Williamson seconded by Councilman L. S. Wilkinson and carried, the communication of the Women's Civic League notifying the Council that Mrs. Ray G. Burlingame had been appointed the League's representative at the Council meetings, was to be acknowledged and filed. M: w / F The petition of Chas. H. Way and others heretofore filed in the office of the City Clerk for the creation of a municipal improve- ment district in the City of Newport Beach, was taken up for final action. Witnesses were sworn and testified and from affidavits on file it appears and the City Council finds: let. The petition•is-in writing and is signed by 58 persons each of whom is a qualified elector of the City of Newport Beach and resides within the proposed municipal improvement district, and they collectively constitute more than 10 % of the qualified electors residing therein. 2d. The.signatures to the petition are the genuine signatures of the qualified electors signing the petition, and the same were signed on the date therein shown, and the signers reside at the place designated. 3d. The petition contains an accurate description of the exterior boundaries.of.the proposed district and the same is a part of and within the boundaries of the City of Newport Beach. 4th. The petition sets forth a general description of the public improvement to be acquired and constructed and is such as the City of Newport Beach is authorized by law to acquire and construct. 5th. The said improvements to be acquired and constructed are necessary and the district described in the petition is benefitted by the said improvements. Councilman L. S. Wilkinson thereupon introduced an Ordinance of Intention as follows: An Otdinanoe of the City of Newport Beach by the City Council as the legislative body thereof, declaring its intention to call an election within a proposed municipal improvement district in said City, as described in a petition filed for that purpose, or as said district may -be hereafter modified, for the purpose of submitting to the qualified electors of said district, the proposition of authorizing the issuance and sale of bonds of such district in the manner and for the purposes set forth in this ordinance of intention; accurately describing the exterior boundaries of the proposed municipal improvement district, setting forth a general description of the public improvements proposed to be acquired and constructed therein, the estimated cost of the proposed public improvements and of the incidental expenses in connection therewith, fixing a date, hour and place for the hearing of protests, and the-date on which the election will be called and held in said district, referring to a map showing the exterior boundaries of said district with relation to the territory immediately contiguous thereto, and a general description of the proposed public improve - went on file in the office of the Clerk of the City of Newport Beach, which map shall govern for all details as to the extent of said district. The Ordinance was read, considered, designated Ordinance No. 327 and passed to the second reading. The two communications from the Women's Civic League concerning the leasing of some tidelands on the north side of the north bap, and asking that the rental for same be used for the improvement of the park site, met with a lengthy -discussion and Mayor Richter referred to a number of erroneous articles appearing in the papers, and in - his foreeful way gave the true facts in the-matter. He also referred to the matter of the public park and quoted the records of the City from the purchase of the site to the present time. The improvement of the park not being included in the budget he did not see where we could get the money for that purpose at the present time. A resolution adopting plans and specifications and a notice Inviting sealed proposals for the improvement of the park site were presented and considered, and on motion of Councilman Y. B. Modjeska seconded by Councilman L. S. Wilkinson and carried, they were referred to the Committee of the Whole for consideration. UNFINISHED BUSINESS. J. A. Beek reported his new appointments on the Citizens Harbor Development Committee, and the Committee stands as follows: J. A. Beek, Chairman, J. P. Greeley, Ernest Grill, Jr., Dr. Conrad Richter, Frank Smith, Lew H. Wallace, James A. Me Nally, Goo. E. Vibert, W. L. Jordan, Harry Welch, H. L. Sherman, Ben Cope, Dr. Hermann Hilmer, Elmer Cubbon and S. H. Lucas. 479 This being the time set for hearing protests against the issuance of bonds upon the security of unpaid assessments for work done by the Griffith Company under Resolution of Intention No. 396 passed and adopted by the Board of Trustees on November 1, 1926, and no protests having been filed and no one present desiring to be heard in the matter of said assessments, thereupon Councilman H. H. Williamson presented a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH RELATING TO THE'ISSUAMCE OF IMPROVEMENT BONDS PURSUANT TO RESOLUTION OF INTENTION N0. 396, DETERMINING ' THE AMOUNT OF THE UNPAID ASSESSMENTS, PRESCRIBING THE DENOMINATIONS OF SUCH BONDS-AND PROVIDING FOR THEIR ISSUANCE. The Resolution was read, considered, designated RESOLUTION NO. 442 and upon call of the roll passed by the following vote: AYES, Councilmen L. S. Wilkinson, F.B. Modjeska, Fred W.Young, H. H. Williamson,and Mayor Conrad Richter. NOES, Councilmen None. ABSENT, Councilmen.None. NEW BUSINESS. A d— eea —from the East Newport Town Co. for property between Bay Island and-the mainland was reported on favorably by the City Attorney, and on motion-of Councilman F. B. Modjeska seconded by Council- man L. S. Wilkinson and upon:.eail of the roll duly carried, it was resolved by the City Council of the City of Newport Beach that the annexed grant and the real property therein described, be and is accepted by the City of Newport Beach the grantee therein, and that a certified copy of this resolution be recorded with said deed. City Attorney West presented the leases with Dr. Arthur A. Noyes for a strip along his property on which to put up a retaining wall, and on motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and-carried, the Mayor and City Clerk were authorized to execute the lease for a period of ten years. City Engineer Kreesly stated that in the numerous tideland ' suits which had been filed it would be necessary to do.considerable checking up of maps, and thought the Council should make some provision for it. On motion of Councilman H. H. Williamson seconded by Councilman L. S. Wilkinson and carried, the City Engineer was authorized to look after the Citys interests in rechecking the maps. On motion of Councilman L..S..Wilkinson seconded by Councilman H. H. Williamson and carried, demands No. 1341 and 1342, having.been signed and approved by the Finance Committee, were allowed and warrants to be drawn for same. There being no further business on motion of Councilman F. B. Modjeeka seconded by Councilman Fred W. Young and carried, the meeting adjourned to 7:30 o'clock P.
