Modjeski introduced an ordinance entitled: AN ORDINANCE REGULATING TRAFFIC UPON THE PUBLIC STREETS AND REPEALING ALL ORDINANCES INCONSISTENT HEREWITH. The ordinance was read, considered, designated Ordinance No. 345 and upon motion duly carried was passed to the second reading and yeses_= to the City Attorney. On motion of Councilman Wilkinson seconded by Councilman Young and carried, the demands which were in proper shape and approved by the Finance Committee, were allowed and warrants to be drawn for same. On motion of Councilman Wilkinson seconded by Councilman William- son and carried, the demand of L. T. Terry of $132.00 for serving summons in the tideland suits, was allowed and transfer to be made from the unappropriated current expense fund to account No. 332 Misc. to cover the same. On motion of Councilman Wilkinson seconded by Councilman Williamson and carried, the Mayor and City Clerk were authorized to execute the two leases for pipe line crossings with the Southern Pacific Co. and the Pacific Electric Ry. Co. Councilman Wilkinson brought up the matter of our drayage license and just what constituted drayage, which was discussed and on motion of Councilman Young seconded by Councilman Williamson and carried, the matter was referred to the City Attorney to report on at the next meeting. L. W. Briggs asked if an agreement could not-be effected whereby Tract 802 known as Beek's Island, could not attach to the Balboa Island sewer at a certain price for each connection providing the septic tank would take care of it. City Engineer Kressly stated the septic tank would have ample capacity and on motion of Councilman Wilkinson seconded by Councilman Modjeski and carried, the agreement asked for was allowed and the City Attorney instructed to draw up the same. This being the time set for opening bids for the lease on the 93 acres of water- bearing land, the Council in open session publicly opened, examined and declared all sealed bids received, which bid was as follows: a Jacob Sauder, on 3 year lesb- - - - - - - - - - - - $1,050.00 ' The bid was thoroughly discussed and on motion of Councilman Williamson seconded by Councilman Modjeski and carried, the bid was accepted, the City At to draw up a new contract and the Mayor and City Clerk were authorized to execute the same upon payment of the back year's rental and one year's rent in advance on the new contract, or a total of $700.00. There being no further business on motion of CounoilmanYoung seconded by Councilman Modjeski andcarried, the meeting adjourned to 7:30 o'clock P. M. on Tuesday, April 10, 1928. ' City Hall, Newport Beach, April 10, 1928 The City Council of the City of Newport Beach met in regular adjourned session at 7:30 o'clock P. M. on above date. The meeting was called to order by Mayor Conrad Richter. The roll was called showing all members present except Councilman Modjeski. The minutes of the previous meeting were read and approved. 14 ;' This being the first regular meeting of the City Council of the City of Newport Beach after filing with the Clerk of said City of the returns of the election heretofore called and helig on the 4th day of April, 1925, and said city council opened and proceeded to canvass said returns, and upon the canvass thereof found and ordered the foll- owing report to be made and entered upon its minutes of said meeting: 1. The election was he14 as provided by law for the purpose of determing whether or not certain new and inhabited territory conti- guous to the City of Newport Beach, and which territory at the time of filing of the petition for its annexation formed no part of any incor- porated city or town, should be annexed to the City of Newport Beach. ' The said new territory is known as, designated and referred to as "Boulevard Addition to Newport Heights Area." 2. The whole number of votes cast thereon in.the territory proposed to be annexed was 45 votes. 3. The number of votes cast-therein in favor of annexation was 15 votes. 4. The number of votes cast therein against annexation was-27 votes. It appearing from the canvass of said returns of the election that a majority of all the votes cast in such outside territory onthe question of annexation was against the annexation, thereupon Council- man Harry H. Williamson introduced a Resolution declaring the result of the special election. The resolution was read,-considered, designa- ted RESOLUTION NO. 457 and upon call of the roll passed by the following vote: AYES, Councilmen Wilkinson, Young, Williamson and Richter. NOES, Councilman None. ABSENT, Councilman F. B. Modjeski. On motion of Councilman Williamson seconded by Councilman Young and carried, the request of W. H. Norwood for permission to construct a pier in front of Lot 6, Block 3, Section 1, Balboa Island was referred to the City Engineer to report on in the customary two weeks. The matter of providing some dairy and commercial fertilizer for the lawn planted on Corona Del kar asked for by Mr. Ellis, was , considered, and on motion of Councilman Williamson seconded by Council- man Young and carried, $150.OJ was allowed out of.the maintenance fund for fertilizer. The resolution from the Friday Afternoon Club objecting to the destruction of trees along Newport Boulevard was discussed, and on motion of Councilman Williamson seconded by Councilman Young and carried, the resolution was endorsed by the City Council and the Mayor and City Clerk authorized to sign the same. ORDINANCE NO. 343, entitled: AN ORDINANCE OF THE CITY OF NEWPORT BEACH PROHIBITING THE CARRYING OF CONCEALED WEAPONS OR THE DISCHARGE OF FIRE ARMS WITHIN THE CITY OF NEWPORT BEACH, AND PROVIDING A PENALTY FOR VIOLATION THEREOF, came up for final passage, was read, considered and upon call of the roll passed bythe following vote: AYES, Councilmen Wilkinson, Young, Williamson, Richter, NOES, Councilmen None, ABSENT, Councilmen F. B. Modjeski. ORDINANCE N0. 341, entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING VACANT FOR PUBLIC STREET PURPOSES A CERTAIN ALLEY IN BLOCK 435 AND BLOCK G OF TRACT N0. 323, Corona DEL MAR WITHIN SAID CITY, ' came up for final passage the Ordinance was read, considered, and upon call of the roll passed by the following vote: AYES, Councilmen Wilkinson, Young, Williamson, Richter. NOES, Councilmen None. ABSENT, Councilmen F. B. Modjeski. The request of J. E. Souder to have his lease on the 93 acres of water - bearing land, transferred to Clyde A. Plavan was considered, and.on motion of Councilman Williamson seconded by Councilman Young and carried, the request was granted and the Transfer to be made. Mr. J. Frank Burke of the Santa Ana Register stated he had arranged to have the late baseball edition of the Santa Ana Register, delivered by airplane and desired to drop them at some location in the City. The matter was discussed and on motion of Councilman 15 Wilkinson seconded by Councilman Young and carried, the matter was referred to the Police Committee and Chief of Police to consult with the City Attorney as to the responsibility of the City in case of accidents, and they were given power to act in the matter. There being no further business on motion of Councilman Williamson seconded by Councilman Wilkinson and carried, the meeting adjourned to 7 :3J o'clock P. M. of Friday, April 13, 1928, and Mayor Richter was to invite the three newly elected members of the Council to sit in at the Council for instructions on unfinished matters of the City. Approved April 13, 1925 City Clerk Mayor, City of Newport Beach City Hall, Newport Beach, April 13, 1925 The City Council of the City of Newport Beach met in regular adjourned session at 7:30 o'clock P.M. on above date. The meeting was called to order by Mayor Richter. The roll was called showing all members present except Councilman Modjeski. The minutes of the previous meeting were read and approved. The communications were read and acted upon as follows: The communication from the Pacific Highway Association asking that an appropriation of $500.00 be budgeted this year as the City's quota of the Assn. advertising for the coming year, was considered, and on motion of Councilman Wilkinson seconded by Councilman Williamson and carried, the communication was filed and the Clerk instructed to later call the attention of the Council to the wisdom of appropriating the $500.00 for this purpose. On motion of Councilman Wilkinson seconded by Councilman Young and carried, the communication fromthe Universal Traffic Control Co. in regard to traffic signals was filed. The communication from the Fire Chief of Coronado, calling atten- tion to the Convention of Southern California Fire Chiefs in May, and the communication from the League of California Municipalities in regard to a conference of city officials April 25th2 were considered, and on motion of Councilman Wilkinson seconded by Councilman Young and carried, the communications were to be acknowledged and filed, and the Clerk instructed to call the Council's attention to them before the dates arrive. On motion of Councilman Wilkinson seconded by Councilman Young and carried, the application of John Peterson for license to sell waffles, potato chips, soft drinks, etc. on Lot 12, Block 10, Balboa Tract, was allowed. On motion of Councilman Young seconded by Councilman Wilkinson and carried, the application of Mrs. Sutherland for a license to conduct the business of Palmistry reading on yearly basis, was allowed providing she pays the daily license fee provided for in the ordinance. ' On motion of Councilman Young seconded by Councilman Williamson and carried, the request of F. P. McConnelly for transfer of his business license No. 492 to J. K. Bruner was allowed. On motion of Councilman Young seconded by Councilman Williamson and carried, the re quest of Harry Welch for lease of 150 feet of frontage on the County Channel was referred to the Planning Commission for consi- deration and recommendation.at the earliest possible moment. The communication from Paul E. Kressly resigning as City Engineer and asking that his contract with the City be rescinded, was considered, and on motion of Councilman Wilkinson seconded by Councilman Young and carried', the resignation was accepted as of date April 16, 1929, and the conditions of the communication be complied with, and all plans, etc. already made for any work started to be turned over to his successor and all work in connection with the jobs be paid for on a per diem rate.
