Newport Beach, December 12, 1939• The City Council of the City of Newport Beach .met in adjourned regular session in the City,Council Chambers at the City Hall, in the, City of Newport Beach at 7:30 o'clock P. M. on above date with Mayor Williamson presiding. The roll was called, the following Councilmen answering present: Gordon, Roll call Claire, Whitson, Brown, Williamson. Absent: Councilmen None. REPORTS OF SPECIAL COMMITTEES None. Resolutions No. 1685 to 1692 inc., were presented, being resolutions Res. 1689 to accepting quitclaim deeds to the City of Newport Beach on the following described 1692 inc. • property: Gordon and carried, that the Mayor appoint a Committee to investigate and report on the matter. Whereupon Mayor Williamson appointed Councilman Brown -and City Res. 1685 John B. Pyle Lot 24, Tract 682 accepting quitclaim ' Res. 1686 Fredric Charles Huber Lot 13, Tract 682 deeds ' Res. 1687 Lucy Chapman Page Lot 77, Tract 682 SPECIAL BOND ELECTION HELD DECEMBER 5th, 1939• Res. 1688 J. A. Cubley and No. 488, duly called and provided for the holding of a special election to be held in said City on December 5th, 1939, for the purpose of submitting to the Maude L. Lawrence Lot 10, Block 332, Corona del Mar hereinafter stated; and Res. 1689 Milton V. Newcomer Lot 64, Tract 682 Res. 1690 C. Alberta Hanna Lot 6, Tract 682 SE 30' of Lot 4, Blk 0, Tract 323• Res. 1691 George W. Archer Lot 9 and the Sally 10' of Lot 11, i- Block 235, Corona del Mar. � Re.s. 1692 William H. Ruth Lot 17, Block 334, Corona del Mar Whereupon it was moved by Councilman Claire that the Quitclaim Deeds be accepted, the motion was duly seconded by Councilman Gordon and the Resolutions adopted by the following vote, to -wit: . AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. COMMUNICATIONS A communication from the National Youth Administration was read and after some discussion, it was moved by Councilman Claire, seconded by Councilman Gordon and carried, that the Mayor appoint a Committee to investigate and report on the matter. Whereupon Mayor Williamson appointed Councilman Brown -and City Engineer Patterson as a Committee to look into the subject. 1 The letter of appreciation from C. L. Appling, Scout Executive, in . connection with the Sea Scout Rendezvous was read, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, same was ordered filed. UNFINISHED BUSINESS CANVASS OF VOTES. ' Resolution No. 1693. A RESOLUTION OF THE CITY OF NEWPORT BEACH, CALIFORNIA, STATING THE RESULT OF THE CANVASS OF THE ELECTION RETURNS OF THE SPECIAL BOND ELECTION HELD DECEMBER 5th, 1939• • WHEREAS, the City Council of the City of Newport Beach, by Ordinance No. 488, duly called and provided for the holding of a special election to be held in said City on December 5th, 1939, for the purpose of submitting to the qualified voters of said city the proposition set forth in said ordinance and hereinafter stated; and Natl.Youth Adm. Sea Scouts thanks Res. 1693 canvass of votes of Dec. 5th Special Bond Election. r276 WHEREAS, notice of said election was duly given in time, form and manner as provided by. law, and said election was on said. date held at the precincts designated in said ordinance and said election was duly and regularly held and conducted and the votes thereof canvassed and the returns thereof made • at the time and in the manner and form provided by law; and WHEREAS, on Monday, the 11th day of December., 1939, the first Monday after said election, at the hour of 7 :30 o'clock P.M., said City Council of the City of Newport Beach duly assembled in meeting at the usual place of meeting of said Council in the City Hall of said City for the purpose of canvassing the returns of,said election; and WHEREAS, the returns of said election, other than the absentee voter ballots, have been duly and regularly canvassed as required by law; and WHEREAS, the City Council of the City of Newport Beach, after the canvassing of said election, other than the absentee voter ballots, did adjourn from day to day in order that said absentee voter ballots might be counted when received by the Clerk of said City; and WHEREAS, on this, the seventh day after said election, all absentee voter ballots have not been returned to the Clerk of said city, nor have the same been received by the Clerk of said City of Newport Beach. NOW, THEREFORE, BE IT RESOLVED by the City.Council of the City-of Newport Beach, that a.special election for the purpose of submitting to the qualified voters of said city the proposition hereinafter set forth was duly called and ordered to beheld on December 5th, 1939, by said Ordinance No. 468, and that notice of said election was duly given in time, form and manner as provided by law, and that said election was on December 5th, 1939, duly and regularly held and conducted and all votes cast thereat canvassed and the returns thereof made at the time and in the form and manner regdred by law. BE IT FURTHER RESOLVED that the proposition set forth in said • Ordinance No. 468 and voted upon at said election was as follows: PROPOSITION N0. 1 Shall the City of Newport Beach incur a bonded indebtedness in the principal sum of $130,000.00 for the acquisition and construction of .a municipal improve- ' ment, to -wit: The acquisition, con- struction and reconstruction of two public piers, including the reconstruction and extension of the existing piers, into the waters of the Pacific Ocean, including buildings and structures necessary or convenient for said project? BE it further resolved that the votes of more than two - thirds of all the voters voting on s &id Proposition No. i were cast in favor of the adoption thereof and said Proposition No. 1 is hereby declared to be carried and the City Council of said City of Newport Beach is authorized to issue bonds therefor as provided by law: ADOPTED, SIGNED AND APPROVED this 12th day of December, 1939• Harry H. NEW BUSINESS and read in full City Attorney Thompson presentedAan ordinance for first reading, being AN ORDINANCE OF THE CITY OF NEWPORT BEACH, CALIFORNIA, PROVIDING FOR THE ISSUANCE OF BONDS OF SAID CITY IN THE AMOUNT OF $130,00 TH0.00 for THE ACQUISITION AND CON- STRUCTION OF MUNICIPAL IMPROVEMENTS, AND FOR E REDEMPTION OF SAID BONDS. On motion of Councilman Claire, ..seconded by Councilman Gordon the ordinance was passed to the second reading by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. 2'77 First read- ing of Ord. for issuing pier bonds. On motion of Councilman Claire, seconded by Councilman Gordon and carried, Advertising the City Clerk was instructed and directed to advertise for the sale of bonds in for sale of connection with the pier projects, said advertisement to be published in the Newport- pier bonds. Balboa News -Times for two issues of said paper December 14th and December 21st, copy of the advertisement to be sent to the First National Bank of Santa Ana.
