M. Place of Meeting: Council Chambers Roll Call: The reading of the Minutes of the Regular Meeting of Octo- ber 28, 1963 was waived; the Minutes were approved as written and ordered filed. SPECIAL ITEMS: 1. Mayor Hart introduced Jeffrey. Wilcox,. an eleven year old student at Mariners Elementary School, who had sub - - mitted a letter suggesting that the City of Newport Beach have an.official flag and transmitting .a drawing -of the proposed flag. Jeffrey Wilcox displayed the flag which had been made in accordance with his drawing .and ex- plained the significance of the colors. Mayor Hart high - ly, commended Jeffrey Wilcox for his interest. The adoption of the flag as the official flag .of the City of Newport Beach was taken under consideration. 2. Mayor Hart'stated that the Santa Ana Heights Water Com pany had acted upon the offer of the City. of Newport Beach-to purchase its assets for $350,000, and Vice Mayor Hans Lorenz stated that the%Cornpany•had_Sapprov- ed thengurdHasecwithrafewznin6r ; changek 4in the Tropose contract. A discussion was had. Resolution No. 5884, authorizing the execution of a.con- tract with the Santa. Ana Heights Water Company, was adopted. A letter was presented from Attorney William W. Berry hill opposing, the adoption of subject Ordinance. Mrs. Frances Byers spoke from the audience and read further comments in. opposition from Attorney Berryhill.which were submitted for the record. A discussion was had. No one else desired to speak from the audience. The hearing was closed. On motion to disapprove, Ordinance ,No. 1061 failed adoption. The City. Attorney was instructed to look into the zoning ordinances so that minor infractions which are mentions in Section 9105.8 of the Newport Beach Municipal Code and'in the proposed Ordinance No. 1061, would be made conforming; and it was .directed that a report be made at the next Council meeting. 2. Mayor Hart opened the public hearing regarding the appeal of Warren E. Schwab from the decision of the Planning Commission denying Application for Use Permi No. 993 for permission to make alterations and an addi- tion.to an existing two units which are non - conforming .because of a garage which is 15'3" x 20'2"; Lot 24, Block 4, Section. 1, Balboa Island; Zone R -2; 204 Garnet Avenue. The findings of the Planning, Commission and a letter from the applicant dated October 25, 1963, were presented. Warren,E. Schwab spoke from the audience requesting the granting of subject Use Permit. J. W. Drawdy, Planning Director, spoke from the audience. The hearing was closed. A motion was made that the findings of the Planning Commission be overruled, and Use Permit No. 993 be granted with the following conditions attached: That the northernmost wall of the proposed new bedroom. be 16'11" and connect with the garage, thereby placing and making the toilet and shower a portion of the front hous< Said motion failed adoption. The findings of the Planning Commission were sustained and Use Permit No. 993 was denied. 3. Mayor 'Hart opened the public hearing regarding the pro - posed rezoning of a portion of Lot 2 and rezoning, "Lots 3, 4 and 5, Block G, Tract 323, Corona del Mar, from a C -1 to a C -O -Z District; located at 29,31 East Coast Highway; Planning Commission Amendment No. 173. Said motion failed adoption. The proposed rezoning was referred back to the Planning Commission with the request that the Commission rede- fine its guide lines and the basis for its recommendation, in,view of the fact that the recommendation apparently applied not only, to subject block. in Corona .del Mar, but to many, others in Corona del Mar;, and -it was, requested that the *Planning Commission elucidate as to what is not spot zoning as stated in its first paragraph of Findings, they saytlii'"s'is "'; not spot zoning ;" the Council would like to know how small the property,has to get before it is spot zoning,, what is the criteria that we use to distin- guish spot zoning from any other, and furthermore the :Council would like•to know what the Planning Commissio: recommendations might be on a short range reconsiders tion of zoning changes along the entire Corona del Mar strip; the Council recognizes that certainly,this area, if any, represents a good area to be rezoned C -O-Z, but where does it stop. CONTINUED BUSINESS: 1. The request of Jay,Hulbert for a curb cut permit,, to serve the lot at the southwest corner of Balboa Boulvard and Coronado'Street,,was tabled. Z. The City "Manager recommended that the requested re- port from him regarding "Lots, B and C, of Tract No. 33! located at the entrance to Cameo Shores, be taken off calendar since nothing could be accomplished until The Irvine Company submitted a proposal. The recommew tions of the City Manager were approved. 3. A report dated November 8, 1963 from the City Managez h regarding the request of Carl McCullah to lease the e building at the end of the Newport Pier, was presented. The City Manager read his report wherein he recommen ded that the sun room, be retained for its present use anc that no additional sales facilities be authorized on the Newport Pier. The City Manager's recommendations were approved and it was directed that he advise the ap- plicant that the property will not be leased. 4. A requested report from the City Manager regarding e drainage at Little Corona Beach was diaried for Novem- ber 25. CURRENT BUSINESS: 1. The recommendations from the Planning, Commission re garding Tentative Map for Tract No. 5394, , the David Young condominium building located at Coast Highway and Riverside Drive,. were presented. The Tentative Map for Tract No. 5394 was approved subject to the con• ditions recommended by the'Planning.Commission and the Public Works Department; specific approval.was given to Sheet 1 and Sheet 2 of the Tentative Map, and it was directed that it be noted that Sheet 3 showing. the division of air space has not.been.reviewed or approved by, the Council.
