Councilman Cook-stated that he felt the draft Minutes of November 26 as changed in accordance with the request of the City Attorney to indicate that the Mayor was authorized to write a letter to the Santa Ana Heights Water Company and the shareholders, expressing the policies of the City, were not correct; that the Minutes were correct as original ly written indicating that the Mayor was authorized to write a letter to the Company. Mayor 'Hart requested that the record show that the Mayor was criticized by Councilmen Cook and Elder for having a letter multilithed for distribu- tion to the shareholders of the Santa Ana Heights Water Company. The reading of the Minutes of the Regular Meeting of November'25, 1963, and the Adjourned Regular Meeting of November 26, 1963, was waived; the Minutes of November 25, 1963, were approved as written and the Minutes of November '26, 1963, were approved as changed and orderer filed. A letter was presented from Edgar F. Hirth, Chairman, Parks, Beaches and Recreation Commission, regarding application to the State Historical Society to establish an historical marker at the Newport Pier commemorating the McFadden landing. The matter was referred to. the Motion x staff and to the Chairman of the Parks, Beaches and All Ayes Recreation Commission with instructions to proceed with,the proper procedure to make the request of the State regarding this memorial marker. 3.. A letter was presented from Edgar'F. Hirth, Chairman, Parks, Beaches and Recreation Commission, recommen ding a change in City procedure to require adjacent prop erty owners to remove.trees at their expense rather tha the removal by the City when removal is.requested by the property owners and is for their benefit; retaining the requirement of City. approval. Back Bay- Drive: A memorandum dated December 5, 1963, was presented from the City.Manager and Public Works 'Director re- garding the realignment of the northerly portion of Back Bay Drive. A letter from the Parks, Beaches and Recreation Com- mission relative.to'Back Bay Drive, was presented. Councilman Lorenz made a motion to adopt a Resolution Motion x authorizing the execution of a contract between the City and Eastbluff- Newport, Inc., Jamboree Land Co., and The Irvine Company, contemplating the improvement of the area shown in. blue and the abandonment of the area shown in red (Map M- 5018 -L). A discussion was had. J. H. Caldwell, Carl Staugaard, and George Friedl spoke from the audience opposing any agreement to aban don any portion of Back Bay Drive at this time. Council man Lorenz withdrew his motion to adopt the Resolution and made a motion that the matter be brought up at the Motion x Adjourned meeting on December 10. Traffic channelization on Pacific Coast Highway,through Corona del Mar: A memorandum dated December b, 1963 was presented from the City Manager and Public Works Director rega ing channelization on Pacific Coast Highway through Corona del Mar. A petition was presented containing twenty -one signature from business men in the 3800 and 3900 blocks of East Coast Highway, in Corona del Mar requesting adjustment of marking between Poppy and Seaward- Evening Canyon Road, and modification of the concrete island .at Hazel Avenue. A letter was presented addressed to Councilman Cook from Kenneth Jillson, Agency Supervisor, Pacific Mu Life. Insurance Company, 2700 East Coast Highway, Corona -del Mar,. regarding markings at Fernleaf and Coast Highway. Motion All Ayes A revision to the report was suggested by the Public. Works Director by adding a,study of the 3900 East Coast Highway block double double line and by amending.Point 3,to ex- plore with the.State,the possibility of providing an open- ing in the median opposite the southerly leg of Hazel Drive; and by deleting'Point 4; - The recommendation of the City Manager and Public Works Director were approved and they were instructed to forward recom- mendations to the State and pursue with all diligence the implementation by the State. 6. A memorandum dated December 6 was presented from the City. Manager and Public Works Director reporting on City- wide.drainage problems resulting,from the recent heavy rainstorms. The Clerk stated that a letter had been received from Attorney Robert R. Hurwitz, written for his clients, Mr. and Mrs. Carl Wester, 528 Seaward Road; Mrs. Shirley .,Anne Hughes, 524 Seaward Road; and Mr, and Mrs. Richard Taylor, 522 Seaward Road; regarding damage caused by the recent rains and alleged to be the City's responsibility, because of drainage problems. A memorandum dated December 3 from the City Manage regarding Population Estimate by State Department of Finance, was presented, recommending that.the City Manager be authorized to request the State Department of Finance.to make population estimates for the City as soon as possible. Wright, Jr., for background music on.the business blocks of Marine Avenue from .10:00 A.M. to 9:00 P.M. December 10 to December 24, 1963, regular music and Christmas carols; also request ing.use of a public address system for live entertainment at .the annual. Christmas party for the children at the corner of Park and Marine on or about December 23 fro 7:00 to 9:00 P.M. Said request was approved. Motion All Ayes RECESS for five minutes was declared by Mayor Hart. The Council reconvened with all members present except Councilman Cook who joined the meeting within a matter of seconds. A discussion was had re- garding protection.to the City that the mutually owned lot in the planned residential development would be main- tained to the satisfaction of the'City, George Holstein, Raymond Watson and William Mason spoke ;from the audience. The Tentative Map for Tract No. 5435 was approved subject to the recommendations of the Planning Commission and.the Public Works Department,with the additional recommendations :that the agreement with the developer, subject to the maintenance of the public areas, b e", a c.c e p table to the City, Attorney; that the subdivisior include or abut on the existing Back Bay, Drive; that. the additional widths for Back Bay Drive. to bring it to a sixty, foot street be dedicated; and that a contractual agreement be drawn up with the City assuring the im- provement of the portion of Back Bay.
