Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Antony Brine, City Traffic Engineer, tbrine@newportbeachca.gov PHONE: 949-644-3329 TITLE: Ordinance No. 2020-25: Designating Portions of 61St and Lancaster Streets in Newport Shores as One -Way Streets ABSTRACT: At the October 13, 2020 City Council meeting, the City Council introduced Ordinance No. 2020-25, An Ordinance of the City Council of the City of Newport Beach, California, Amending Section 12.52.060 of the Newport Beach Municipal Code to Designate Portions of Streets as One -Way Traffic Only and passed to second reading on October 27, 2020. The Ordinance adds three (3) street segments in the Newport Shores community to Municipal Code Section 12.52.060. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Conduct second reading and adopt Ordinance No. 2020-25, An Ordinance of the City Council of the Newport Beach, California, Amending Section 12.52.060 of the Newport Beach Municipal Code to Designate Portions of Streets as One -Way Traffic Only. FUNDING REQUIREMENTS: There is no fiscal impact related to the Adoption of Ordinance No. 2020-25. DISCUSSION: At the October 13, 2020 City Council meeting, the City Council introduced Ordinance No. 2020-25, and passed to a second reading on October 27, 2020. Ordinance No, 2020-25 amends Section 12.52.060 of the Newport Beach Municipal Code by adding the following streets in Newport Shores as one-way streets - 3 -1 Ordinance No. 2020-25: Designating Portions of 61 st and Lancaster Streets in Newport Shores as One -Way Streets October 27, 2020 Page 2 Sixty-first Street from West Coast Highway to Newport Shores Drive. Northeast bound traffic only. Sixty-first Street from Coast Boulevard to Lancaster Street. Northeast bound traffic only. Lancaster Street from Sixty-first Street to Sixty-second Street. Northwest bound traffic only. Staff requests City Council conduct a second reading and adopt Ordinance No. 2020-25. ENVIRONMENTAL REVIEW Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENT: Attachment A —Ordinance No. 2020-25 3-2 ATTACHMENT A ORDINANCE NO. 2020-25 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, AMENDING SECTION 12.52.060 OF THE NEWPORT BEACH MUNICIPAL CODE TO DESIGNATE PORTIONS OF STREETS AS ONE-WAY TRAFFIC ONLY WHEREAS, Newport Beach Municipal Code Section 12.52.010 establishes that an ordinance or resolution may designate any one-way street or alley, and that the City Traffic Engineer shall place and maintain signs giving notice thereof; and WHEREAS, the Newport Shores Community Association has noted concerns with traffic on 61St Street and requested that 61St Street between West Coast Highway and Newport Shores Drive be designated as One -Way, as referenced on Exhibit A, attached hereto and incorporated herein. NOW THEREFORE, the City Council of the City of Newport Beach ordains as follows: Section 1: Section 12.52.060 of the Newport Beach Municipal Code is amended and replaced in its entirety with the following: 12.52.060 Newport Beach. The following streets and alleys shall be one-way streets and alleys in the direction indicated: South side of Balboa Boulevard between McFadden Place and Alvarado Street. East bound traffic only. North side of Balboa Boulevard between Alvarado Street and McFadden Place. West bound traffic only. The portion of McFadden Place westerly of the McFadden Parking Lot between Balboa Boulevard and Ocean Front. South bound traffic only. Ocean Front between McFadden Place and 24th Street. West bound traffic only. Twenty-first Place between McFadden Place and Ocean Front. Grant Street from Coast Highway to Canal Street northeasterly. 3-5 Ordinance No. 2020-25 Page 4 of 5 Section 2: The recitals provided in this ordinance are true and correct and are incorporated into the substantive portion of this ordinance. Section 3: If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 4: The City Council finds the introduction and adoption of this ordinance is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 5: Except as expressly modified in this ordinance, all other sections, Subsections, terms, clauses and phrases set forth in the Newport Beach Municipal Code shall remain unchanged and shall be in full force and effect. Section 6: The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the ordinance, or a summary thereof, to be published pursuant to City Charter Section 414. This ordinance shall be effective thirty (30) calendar days after its adoption.
