SUBJECT: PURCHASE OF THE STATE'S TITLE TO TAX DEEDED PROPERTY

1. Purchase State's tax deeded property located at the north-
westerly corner of Walnut Street and Newport Shores Drive.
2. Aut.horize the Mayor and the City Clerk to execute
the Agreement.
DISCUSSION:
The Orange County Tax Collector's office has informed the City of
their intention to sell a parcel of the State's tax deeded property,.allowing
the City the first option to purchase the parcel. The parcel to be sold is
AP 045-064-17, purchase price $110. The location of the parcel i:s shown on the
attached Exhibit "A". The parcel would be used for street right-of-way pur-
poses. Funding will be from non -departmental Acct. No. 02-144.0-009, Land
Acquisition.
The terms of agreement for purchase include the following: That for
two years following the date of purchase, the City will not offer said property
for sale; that within two years from date of purchase the City will devote said
property to the public purpose for which it was acquired; that in the event the
City fails to devote said property to the stated public purpose within two
years, or the City attenpts to sell the property for any reason, the terms of
the Agreement and the deed will automatically revert the property from the
ownership of the City to the ownership of the party who was assessed with the
property prior to the County Tax Collecto.r's Power to Sell status.

We are enclosing the form of Agreement recommended by the
State. Controller's office on which we have entered the
pertinent information as to description, purchase price, etc.,
of property which: the City plans to purchase.
Please be on notice that the terms of agreement for purchase include
the following: That within 2 years from the date of purchase the
City will devote said property to the public purpose for which they
acquired it (Sec. 3807.5 R & T); that in the event the City fails
to devote said property to the stated public purpose within 2
years, or the City attempts to sell the property for any reason,
the terms of the agreement and the deed will automatically revert
the property from the ownership of the City to the ownership of the
party who was assessed with.the property prior to the County Tax
Collector's Power to Sell status.
Please return five executed copies of the Agreement, together
with five certified copies of a. Resolution offering to purchase,
as provided by Division 1, part 6, Chapter 8, Article 2 of the
Revenue and Taxation Code.

COUNCIL MEETING OF JULY 22, 1985
The meeting was called to order at 7:30 p.m. in the City Council
Chambers of City Hall with all Council Members present.

Notion was made by Council Meer Pl�mmr to approve the foregoing
recommendation as presented.
The motion was voted on and unanirrously carried. -

THIS IMENTURE, made the 3rd day of December , 1985,
between ROBF.RT L. CInM, Tax Collector of the County of orange,
State of California (hereinafter, "TAX COLLECTOR"), and the City
of Newport Beach (hereinafter, "CITY"),
will lesseth;
THAT WHEREAS, the legally levied taxes on the real property
hereinafter described were a lien on said property for Fiscal Year
1977-78 , and were not paid, and said taxes were duly declared
to be in default, and said real property was subject to a power of
sale pursuant to Section 3691 for nonpayment of taxes which were
legally levied and were a lien on said property; and
WHEREAS, in conformity with the provisions of Division I, Part
6, Chapter 8, Article 2 of the Revenue and Taxation Code of the State
of California, an agreement for the sale of said real property has
been entered into between the governing body of CITY, and the Board
of Supervisors of the County of orange, State of California, pursuant
to which TAX COLLEMR has been authorized to grant to CITY, for value
duly received, the real property described below;
NOW, THEREFORE, in consideration of thepremises and in accordance
with the law in such case made and provided, TAX COLLECTbR does hereby
grant, convey and deed to CITY, for the sum of one Hundred Ten Dollars, that
certain real property referred to herein, and situated in the County of
Orange, State of California, more particularly described as follows,
to wit:
Located within the City of Newport Beach
That portion of Lot 2 in Block 5 of Tract No. 772 as per map
recorded in Book 23 Pages 5 and 6 of Miscellaneous Maps, re-
cords of orange County, described as follows: Beginning at the
Southeasterly corner of said lot; thence North 550 39' 25" west
along the Southwesterly line of said lot, a distance of 6 feet
to the beginning of a tangent curve concave Northwesterly hav-
ing a radius of 6 feet; thence Southeasterly and Easterly along
said curve through an angle of 890 58' 38" a distance of 9.42
feet to a line tangent, said line tangent being the Southeasterly
line of said lot; thence South 341 21' 57" west along said South-
easterly line a distance of 6 feet to the point of beginning.
EXCEPT the subsurface lying below the depth of 500 feet vertically.
Sale by Agreement #1308
This conveyance is made and accepted upon the following express
conditions:
1. That within. two (2) years from Deeanber 3rd

public street and highway
purposes, or else the CITY shall execute a recision of this Deed,
and the real property described above shall again be subject to a
power of sale by TAX COLLECTOR for delinquent taxes pursuant to -.
Section 3691 of the California Revenue and Taxation Code. \

2. That CITY shall not sell, nor offer to sell, said property
at any time during the two-year period described in Section 1 above.
3. That in the event CITY fails to devote said property to
public street and highway
purposes within the two-year period described in.Section.l..above, or
CITY desires to divest itself of said property within the two-year
period, CITY will execute a deed reconveying the aforesaid property,
and all right, title and interest thereto, to TAX COLLECTOR, to be
held as tax -defaulted property subject to a power of sale for delin-
quent taxes pursuant to Section 3691 of the California Revenue and
Taxation Code..
PROVIDED FURnffR, that a breach of any of the foregoing condi-
tions shall cause said property to revert to the status of tax -
defaulted property subject to a power of sale by the TAX COLLECTOR
and said TAX COLLECTOR, or his duly authorized agent, shall have
a right to re-entry on, and repossession of, said property.
IN wiTNESS WHEREOF, said TAX COLLECTOR has hereunto set his
hand as of the day and year first above written.
