HomeMy WebLinkAbout21 - Balboa Island Art Walk Banner - EPN2005-0117CITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 21 April 12, 2005 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Public Works Department Gilbert Wong, Associate Engineer 949 - 644 -3334 gwong @city. newport-beach.ca. us SUBJECT: APPROVAL OF A BANNER FOR THE ANNUAL BALBOA ISLAND ART WALK — ENCROACHMENT PERMIT N2005 -0117 RECOMMENDATION: Approve the request for the installation of a banner with sponsor's names for the 11' Annual Balboa Island Art Walk. No 2. Approve the request but require there to be no sponsorship names or logos on the banner. DISCUSSION: Debra Huse, the organizer representing the Annual Balboa Island Art Walk has requested that an 8 -feet long by 2.5 -feet high banner be installed from April 25, 2005 to May 9, 2005 in the landscaped median on East Coast Highway just west of the intersection of Marguerite Avenue (see Exhibits "A" & "B "). The 11`h Annual Balboa Island Art Walk will be held on May 7, 2005, along the Balboa Island South Bay Front Boardwalk from Emerald Avenue to Grand Canal and at the Fun Zone on the Peninsula (see Exhibit "C "). The event will have live entertainment and will exhibit various art work from local artists. The event will not only attract local residents, but also art enthusiasts and tourists. The organizer of the event estimates approximately 4,000 people will attend the one day event. In addition, a special event permit is being processed via the Recreation and Senior Services Department. The organizer's preference is to have the banner designed to include the names of the commercial sponsors of the event (Mary Hardesty Realty, Fletcher Jones Motorcars, and Daily Pilot) on the bottom of the banner as shown on Exhibit "D "- Option 1. But if City Council approval necessitates omitting the names of the commercial sponsors from the banner, the organizer will comply and will not have any commercial sponsor names on the banner as shown on Exhibit "E "- Option 2. The event is not co- sponsored by the City of Newport Beach, but it is free to the public. Council Policy L -16 prohibits the use SUBJECT: Approval Of A Banner For The Annual Balboa Island Art Walk — Encroachment Permit N2005 -0117 April 12, 2005 Page 2 of a commercial sponsor's name on the banner and it specifies that banners can be authorized for events that are free to the public. In the past, similar banner requests (i.e. Corona Del Mar 5K Run and The Annual Newport Beach Film Festival) were permitted at the same locations using the City's existing 2 -inch diameter PVC sleeves (see Exhibit "B "), but they were all co- sponsored by the City with no commercial advertisements on the banner, and there have been no reported public complaints or problems. Should the City Council elect to approve the installation of the private banner with or without commercial sponsors listed on the banner in the landscape median on East Coast Highway, staff recommends the following conditions of approval: 1. The organizer shall provide a minimum of two weeks notice with the General Services Department to coordinate the banner's installation and removal. 2. The organizer must provide on -going maintenance of the banner. 3. The organizer must sign a "Hold Harmless Statement" requiring maintenance of the banners and indemnification and hold harmless for any liability associated with the banners. 4. Issuance of an Encroachment Permit by the Public Works Department (Encroachment Permit No N2005- 0117). 5. The banners shall conform to City Council Policy L -16 with the exception of the commercial advertisement (if approved) and co- sponsor by the City. 6. Banners shall comply with the Encroachment Permit conditions. Environmental Review: Staff determined that the project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 of the Guidelines. This exemption covers the minor alteration of existing public facilities with negligible or no expansion of the facilities in areas that are not environmentally sensitive. Funding Availability: No City funds will be required. The applicant will pay all costs associated with the installation and removal of the banners.
