Ohl, Deputy City Attorney, ext. 3131, dohl @city.newport - beach.ca.us SUBJECT: Modification of Newport Beach Municipal Code Section 14.24.020 Dwelling Unit and Business Structure Sewer Connection ISSUE: Should the municipal code be amended to include provisions to require the installation of sewer lateral clean -outs and replacement of existing sewer lateral piping when one or more specified criteria are met? RECOMMENDATION: Introduce Ordinance No. 2005 - and pass to second reading. DISCUSSION: Staff is routinely called with complaints of sewer back ups and clogged lines. In most instances it is reported that the City's main line has caused the problem. The City cleans and maintains the portion of the sewer lateral from the private property boundary to the main sewer line in the street. Due to routine maintenance of City lines, the sewer main is seldom, if ever, the cause of back ups. This is confirmed by inspecting the main line. It is usually necessary to enter the sewer lateral line to locate the blockage. The preferred point of entry is a clean -out located at the property line. Otherwise residents expect staff to enter their property and find the blockage, which in most instances is on the private property side of the property line. In response to this situation, the Utilities Department, in conjunction with the Building Department has, since 1988, (See Attachment A, the most recent memo) required the installation of sewer lateral clean -outs at the property line and the replacement of Modification to Newport Beach Municipal Code Section 14.24.020 November 22, 2005 Page 2 existing sewer lateral piping to bring both to current standards when substantial construction work is done on the property. (See Attachment B) These requirements are triggered when one or more of six criteria exist. There are two major benefits with these requirements. First, if there is a stoppage in the line past the property line on the City maintained portion, the clean -out protects the property owner and the City by allowing the back up to escape outside, as opposed to inside, the residence. This significantly reduces property damage. Secondly, the clean out allows staff to save time and money by entering the City maintained portion of the lateral and determining if the blockage is the City's responsibility to correct, or if it is on the private property side of the line. Staff recommends that the criteria be specifically incorporated into the Municipal Code to clarify the requirements. Environmental Review: DNA This is not a project under CEQA. This memorandum is to inform you about the City's requirements for installation of sewer lateral dean outs and replacement of existing sewer lateral piping. These requirements apply to all projects involving demolition, construction, re-construction and or substantial remodeling of habitable structure or dwelling unit, house, duplex, condominium or apartment. All sewer laterals shall be inspected by the Utilities Department either at the time of demolition, (cut & cap of the sewer lateral) or before final approval of the Building Permit or granting occupancy. A clean-out shall be installed at the property line in the exact mariner shown in the Standard DrawiAgs for Public Works Construction, latest edition, Drawing STD - 406 -L. The clean-out shall be placed immediately adjacent to (on the public side of) the property-line or public utility easement boundary. The sewer lateral shall be replaced and brought up to current City standards and a dean out shall be installed wherever the following criteria apply: 1. If an area greater than 50% of the existing building area is added. 2. If the area of structural interior remodeling exceeds 50% of the existing building area. 3. If any alterations to the building sewer are done. 4. If additional plumbing fixtures require a change in the size of a building sewer line. 5. Wherever 6 or more fixture units are added to an existing undersized plumbing system, 6. Whenever it is found that the building sewer is installed in an illegal or unsanitary manner- 11 the existing property is served by a sewer lateral that is substandard; a new lateral shall be installed at the expense of the developer. In such case, the sewer lateral shall be replaced from the sewer main to the adjacent property line, where a clean-out shall be installed in the manner .described above. An example of a substandard sewer lateral would include one constructed with any of the following materials: cast iron; steel; ABS plastic; PVC with glue - joints; glazed-clay with concrete joints; concrete pipe; or any other pipe material other than Wedge -LokTm clay pipe in good condition; vitrified clay pipe (VCP) with caulder couplings or SDR -35 PVC with gasketed- joints. ABS plastic and other pipe with glue- joints are unacceptable. Building Department Utilities Superintendent, Field Operations Chief Building Inspector ORDINANCE NO. 2005- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING SECTION 14.24.020, OF TITLE 14 OF THE NEWPORT BEACH MUNICIPAL CODE, PERTAINING TO WATER AND SEWERS The City Council of the City of Newport Beach does hereby ordain that certain Newport Beach Municipal Code section is amended to read, in full, as follows: SECTION 1: Section 14.24.020 of Title 14 is amended to read as follows: 14.24.020 Dwelling Unit and Business Structure Sewer Connection Required. Every dwelling unit or business structure in the City shall be connected with the public sewer in the manner, at the place, under the supervision of and to the satisfaction of the Utilities MaaaWgirector, if the dwelling unit or business structure is within two hundred (200) feet of the public sewer. Each unit shall be individually connected to the City sewer system unless otherwise approved by the Utilities MaaaWQirector. All sewer laterals shall be inspected by the Utilities Department either at the time of demolition or before final approval of the building permit or granting of occupancy for all projects involving demolition, business structure. Each sewer lateral connection shall be replaced and /or constructed in accordance with the City's standards for such construction seaaestieas —and shall have a clean -out assembly installed at the property line whenever one (1) or more of the following apply:- A. If an area greater than fifty percent (50 %) of the existing building area is added; B. If the area of structural interior remodeling exceeds fifty percent (50 %) of the existing building area; C. If any alterations to the building sewer are done; D. If additional plumbing fixtures require a change in the size of a building sewer 1i E. Wherever six (6) or more fixture units (per the Uniform Plumbing Code [UPCI) are added to an existing plumbing system; or 1 F. Whenever it is found that the building sewer was /is installed in an illegal or unsanitary manner. SECTION 2: If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. SECTION 3: The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the official newspaper of the City, and it shall be effective thirty (30) days after its adoption.
