HomeMy WebLinkAboutItem 1 - Channel Road Propsed Dock ConfigurationABSTRACT: The applicant at 2222 Channel Road proposes installation of dock system outside of the setbacks as defined by the Newport Beach Municipal Code. RECOMMENDATION: 1. The Harbor Commission approves the proposal to install the dock system outside of the 5 foot setbacks; or 2. The Harbor Commission denies the proposal to install the dock system outside of the 5 foot setbacks. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: The applicant proposes to install a new dock system at 2222 Channel Road (Attachment A). In June 2012 Harbor Resources issued an Approval in Concept for installation of a new 8.5x20ft pier, 4x25ft gangway, 12x20 float and one 16 inch and two 12 inch piles. The California Coastal Commission issued a conditional Coastal Development Permit (CDP) in November 2012. The CDP recommended approval of the application with a Special Condition for final revised plans to avoid eelgrass impacts by modifications to the width or length of the dock float and removal of the proposed 10' x 10'8" pier platform. In response to the CDP Special Condition to avoid impacts to eelgrass beds the latest revision proposes installation of the dock system along the prolongation of property lines on either side (Attachment B). Newport Beach Municipal Code 17.35.020(6)(1) states all piers and slips for residential properties shall be stet back a minimum of five (5) feet from the prolongation of the property line. Setbacks are established to keep area between and to allow ingress and egress. The applicant has been in contact with the neighboring property owner, 2226 Channel Road, and has received support for the relocation along the shared property line. Should Harbor Commission approve this configuration the applicant will submit the revision to the Coastal Commission. ENVIRONMENTAL REVIEW: Staff recommends the Harbor Commission find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the Harbor Commission considers the item).
