A motion was made by Commissioner Ross to adopt the minutes of the December 18, 1979 meeting. Motion carried. The Agenda was adopted as presented,.' II. RECOMMENDATIONS FOR ACTION: #5 Director Ron Whitley provided background information on the Smallwood Encroachment Request. This is an attempt to rectify the situation by requesting through proper pro- cedures the work that has been and is being done there. Chairperson Winburn reviewed the 1971 background informa- tion concerning this matter and the Public Works Depart- ment provided a chronological up -date on what has happened in summary of the situation.. The City's policy in regard to encroachment was reviewed. It was noted that operational policies and procedures have been to allow land -strip and certain improvements to the private properties if the adjacent owner will maintain the land -strip and, improvements. This beautifies an'area-and' maintains it where the city may not be able to do so. The City remains strict in the policy that encroachment does 'not obstruct a view for any adjacent or across - the - street neighbors. Mr. Whitley pointed out that the Smallwood strip improve- ments have done the following: 1) Created a situation where people are forced to use the proper access to Little Corona Beach rather than the - previously allowable descent down the cliffs. 2) The improvement to the property is attractive; the City couldn''t afford to maintain or install in this manner. Dr. Ken Smallwood presented pictures to the Commission of the improvements made to this area since 1971. • Commissioner Ross inquired whether or-not Dr. Smallwood would be interested in buying the improved property if it were legally available to him and he inferred he would be. Mr. Whitley will pursue whether or not this is feasible. INDEX Smallwood Encroachment Request COMMISSIONERS • MOTION: Ayes: No: Absent • • CITY OF NEWPORT BEACH PARKS, BEACHES 8 RECREATION COMMISSION REGULAR MEETING HELD TUESDAY, 1/8/80 CITY COUNCIL CHAMBERS 7:30 P.M. Commissioner Ammerman registered his concern that the 12" brick wall had been installed on private property and there may be some long -term easement evolve in the future. Commissioner Ross also indicated her concern that a prece- dent might be set if this encroachment were allowed. Chairperson Winburn stated she felt this area was an attractive nuisance before the improvement since it was an: area where people were able to slide down a 40" em- bankment to the beach below. The 12" brick wall now deters this hazardous descent and lessens the injury risk to the public. It was moved-by Commissioner Green that the Commission approve the Smallwood variance request-and-recommend to the City Council that they approve this variance. Motion carried. III. ITEMS FOR DISCUSSION: #7: This matter'will be placed on the Agenda for the next' Commission meeting in February in order that all reports will be in from the Police, Marine, and Traffic Engineer- ing Departments. The American Legion has informed us that there is no launching ramp at their facility; they have a marina and dry storage area which is used by-the public and there is a waiting list at this time. Mr. Don Donaldson appeared before the Commission on behalf of the American Legion and informed them that the launching ramp was taken out about 15 years ago. The Legion has 51 spaces rented to anyone on a first come -first serve basis. The hoist they have is limited to 1,500 pounds. Mr. Don- aldson reviewed the history of the development of the park and barbeque area at this site and stated the American Le- gion is willing to cooperate -wi.th the City in any way pos- sible; he indicated they would have to do away with sever- al slips to put in a new-launching hoist. It would also be necessary to add personnel if such a plan were implemented. Item #6: Recreation Superintendent presented thoughts on, "What is This Thing We Call Recreation ?" Her thoughts, in summary: Recreation should be geared to the individual; anything that makes him or her feel, good about themselves. The goal should be to provide for leisure needs for all ages. The emphasis and philosophy in our community seems to be, "Does it make money ?" If it does, we go ahead. Does this really meet the needs? Ms. White indicated that the Parks, Beaches and Recreation Commission could be a good help in establishing political aid to the Recreation Department in helping to promote a better rounded program. She requested a meeting with the -sub- committee in the near future who will come back to the Commission at a later date with recommendations. The possibility of a Needs Assessment survey was considered and it was determined that to be done with accurate results it-would be necessary to have this done by an outside pro- fessional 'agency which is almost monetarily prohibitive. Anbther'suggestions was that we ask the local newspapers to print a questionnaire. Item #8: Recently there has been an expressed interest in, renewing the badminton program with the Recreation Department.' Mr. Whitley informed the Commission, that there are not enough - facilities available for those few persons who are interested in badminton. When we did have the program, it was not self- supporting and few people participated IV. COMMITTEE REPORTS Item #9: The budget is now in the process of being prepared and before it is submitted to the Finance Department, a meeting of the budget committee will be held to point out areas in need of support. COMMISSION,LIAISON Item #16: A copy of a letter from Cindy Houston, Chairperson of the Litter Control 'Committee was reviewed. It will be for- warded to City Council, and will request ways and means of enforcing the litter control laws. . The Commission was requested'to support the efforts of the theatrical group. VI. INFORMATIONAL REPORTS: Item #19: The December, 1979 Progress Report was present to the Commission, together with the Fall 1979 Program Analysis. Chairperson Winburn requested that in future reporting, a comparison be given of the previous year'-s statistics. It was noted'by Commissioner Cole that tennis is dropping down as a sport•which•appears to be a national trend. Item #20: • Commissioner Cole complimented the Parks Division on the excellent job the department is doing. The Tree Committee will meet with Jack Brooks in the near future concerning the pine trees that need to be removed. Item #21: The Commission reviewed a,draft of the Oasis Senior Center Operation and Relationships. A few years ago t e same VP of document was formu ated which never received ap- proval by the Commission or City Council. This is an effort to formalize a policy in regard to what the rela- tionship should be between- the Friends of Oasis and the Recreation Department. The Commission approved the above mentioned draft which will be forward to City Council for their meeting of January 28, 1980. Council Action: Approval by Council authorization was given by the City Manager to hire a consultant architect for the Balboa Island Park - Development. Mr. Whitley has met with this commi.tt(e on the Balboa Park 4 or 5 times and they are confident they can build a two -story building with the funds allotted. The $138,000 will provide a community building and develop a park site. INDEX VII. SPECIAL, URGENT OR LAST - MINUTE ITEMS: Art Show Commissioner Cole discussed the matter of the Art Show to be held in May. 'He requested that there be a sec- tion established for the art work of the handicapped population. He suggested inviting works from Fairview Hospital patients and other handicapped facilities in this area. Chairperson V nburn remarked upon the success of the retirement party held for Helen Orr, Secretary -on January 4th. ADJOURNMENT: The meeting was adjourned at 9:30 p.m. Respectfully submitted, MAGGIE BALDWIN, Secretary • • -5- • 0 0 0 DATE: January 30, 1980 TO: PARKS, BEACHES AND RECREATION COMMISSION FROM: Parks, Beaches and Recreation Director SUBJECT: SMALL BOAT LAUNCHING The Small Boat Launching Committee chaired by Commissioner Gary Lovell, after significant investigation and study presented a committee report (attached) to the Parks, Beaches and Recreation Commission at their meeting of November 6, 1979. 1 ' This report resulted in an action of the Commission to recommend to the City Council that the public swimming beach at 18th and Bay be altered to provide a small boat launching area. This recommendation would provide•a smaller pro- tected swimming area and utilize the 18th street area for boat access. Prior to sending this recommendation to the City Council, anticipating that the Council would desire comments from City staff on possible affects, this Depart- ment solicited reactions from the Police Department, the Traffic Engineer and the Marine Department. Reports regarding the recommendation are attached to this communication from two departments. And, Mr. Dave Harshbarger, Di.rector of the Marine Department,'will be in attendance at our meeting of February 5, 1980, to provide input and answer any questions you might have. Additionally, the Commission asked that the chairperson communicate with the Newport Harbor American Legion Post No. 291 and the Balboa Peninsula Point Asso- ciation regarding the expanded public use of city property leased to these groups. They have responded, by letter, to the report as outlined by the com- mittee. Their letters are also attached to this communication. And, it is anti- cipated that both groups will be represented at our meeting. Finally, if changes are to be implemented for additional hand launching of boats, it is necessary to finalize recommendations for Council consideration soon. (213) 936 -2288 November 6, 1979 MEMO R A N D U M TO: P B E R COMMISSION FROM: SMALL BOAT LAUNCHING SUBCOMMITTEE P . *X- gip/ RE: COMMITTEE REPORT - After several meetings and substantial individualized investigation, the Small Boat Launching Subcommittee has defined its goals and has narrowed down its selection of sites. Initial definitions adopted to guide the committee are as follows: . 1. Small Boat -- a non - motorized boat up to 201 in length and weighing less than 500 pounds. 2. Launching costs -- anywhere from "free" up to a $50 annual charge. c 3. Launching facilities -- a. Concrete or metal trailer ramp leading into bay b. Mechanical or hydraulic lift mechanism into bay. c. Hand 'launching areas (i:e., stree,t ends, etc.) The committee originally selected some 10 potential launching sites, and a committee member was assigned to investigate each such site based upon the following outline: 1. Location 2. Type of launching facility currently available or recommended 3. Parking availability 4. Cost. -- either present or recommended 5• Restroom availability 6. Other facilities in vicinity (i.e., groceries, fuel, bait 6 tackle, maintenance and repairs, etc.) • 7. Ownership of site (including any lease arrangements) 8. Other restrictions (i.e., boat size limit, membership requirements, etc.) 9. Recommendation After weighing the recommendations of reporting committee members, some of the sites were deleted as either being impractical or already being utilized to their maximum potential use. Other sites were "deferred" from consideration of immediate usage due to legal, construction or other problems. BACK BAY LAUNCH AREAS Defer Good launching facilities for non- sailing vessels; but new bridge clearance only 21' Recommendations for potential additional sites will be gratefully received • by the Subcommittee. Respectfully submitted, SMALL LAUNC I NG BCO TTEE Enclosures By RY LOVELI 10/25/79 • Site 1_: 1. Location: n 0 SMALL BOAT LAUNCHING "N" Street and Bay (between "M" and Granada). Location has approxi- mately 225' of open beach, of which some 120' is public, including a public pier in the middle. The 105' private strip includes an open beach at the eastern end, a concrete launching ramp, and a rectangular mooring float ad- joining the public pier. The entire private portion is fenced and posted, with a combination lock securing gates to the launching ramp. 2. Type of Facility: 'There is a fully improved concrete launching ramp, approximately 12' wide, for use by boats up to 16' in length (according to sign), and enclosed by fence and locked gate. 3. Parking Availability: Street only; approximately one mile to Main Street parking lot in Balboa. 4. Cost: As noted below, it is recommended that both a "summer" and "all year" fee be assessed to those non - members wishing to use this facility, to help defray its earlier development costs and present upkeep. 5. Restroom Availability:. One mile to Balboa Pier or fun zone facilities. 6. Other Facilities: A1'1 shopping facilities available at Main - Street, Balboa, one mile distant. 7. Ownership of Site: City of Newport Beach, owner and lessor -- Balboa Peninsula Point Association, lessee. Year to year lease -- renewable on August 8th each year. Lease covers 11,790 sq.ft., including 118.97' of water frontage and 83.67 of street frontage. Rental: Lessee to erect and maintain improvements $0. Improvements revert to City on termination of lease. Insurance: lessee must provide $5,000,000 liability insurance. 8. Other Restrictions: a. Current rules allow boats only up to 16' in length.at $20 /yr.mininur charge. b. Membership in BPPA currently required, at $10 /year dues. c. Bylaws of BPPA currently apply to location. 9. Recommendation: It is recommended that City Council authorize a committee to negotiate with BPPA for both "summer" and "annual' permits for non - residents to utilize this launching site, with.the fee for each of these permits calculated to compensate BPPA for improvements, maintenance, and insurance costs. Location: City /County /State owned property underneath Arches Bridge, near south- east corner of Coast Highway and Newport Boulevard; only present access is via bicycle path or through Jolly Roger driveway and parking lot. 2. Type of Launching Facility Recommended: Either hydraulic lift mechanism or concrete ramp. 3. Parking Availability: Jolly Roger parking lot may be available during winter months, but during summer is overtaxed by Jolly Roger, adjoining office building, and yacht brokerage. Closest year -round parking would be beneath Hoag Hospital, at northwest corner of Coast Highway and Newport Boulevard. Foot access to site is possible. Another possibility would be City Hall'weekend parking (for a fee). 4. Cost: , Cost of constructing a launching ramp is estimated at $25,000; cost of hydraulic lift mechanism approximately $10,000. Either facility would require an individual in attendance and liability coverage. 5. Restroom Availability: City Hall is• available during weekday business hours; otherwise West Newport Park facilities approximately half mile distant. 6. Other Facilities: All shopping facilities are available in Lido Village Mall. 7. Ownership of Site: Original ownership in State, through tidelands trust; trusteeship assigned to City and thereafter leased to Orange County from 4/1/58 through 6/30/2008 (50 -year lease). Parking lot area is Teased by City /County to (name unknown) Jolly Roger corporation,for the same 50 -year period. 8. Other Restrictions: None. 9. Recommendation: This site does not appear feasible for immediate usage. However, it is recommended that City Council direct the subcommittee to contact the lessee of the parking lot to ascertain the possiblity of usage for ingress and egress for boats and trailers. It is further recommended that,more precise cost figures be obtained for either type of launching facility -- i.e., ramp or hydraulic lift. The opening consists of a 6 foot paved rain ^:Y!ich ends in the Marin$ Park Beach and allows small boat 0%,., erS access to the Bay. This is done by trailering the boat onto the ramp and then to hand carry or slide the boat across the beach to the water's edge; thib distance averages about 70 feet, depending upon the tide. PARKING Metered parking is available orlon- Bay Al;enue directl;,: in froYit of the beach, in lots adjacent to 19th Street and Balboa Boulevard, and along Balboa Boulevard. Other nearby parking is readily available along side streets and at the Newport Prier parking areas, No parking specifically for boat trailers, this being double length spaces, is provided. Trailers must be parked •,.ithin available rnarlced parking spaces. RESTROOM AVAILABILITY AND OTHLR'FACILITIES IN VICINITY Public restrooms are located on the Marine Park Beach at 19th Street and Bay Avenue. Grocery stores and restaurant facilities are also within close walking distance. RAJ 0 I?I:STI?IC'i'10igS REGARDIiIG USE Or SITE Restrictions which currently affect small boat launching at the 18th Street area are: 1) Trailers are prohibited on the beach. 2) Cars and trWheel'drive vehicles are prohibited on the beach. The restriction trhich prevents use of 18th Street for small boat launching is that it has been designated as a protected swimming area. In July 1979, the beach was closed for the summer months'until Sept- ember 15 to small boat launching. The Marine Department exercised it's option to close the beach to boat launching citing concern for potential city liability problems in the event of an accident. As a protected wwimming area, the increasing heavy use of 18th Street for small boat launching had caused safety hazards, according to the Marine Department officials, with boats passing through protected swimming areas. As the situation exists, the 18th Street launching area will again be closed during the summer months when more`people,ake using the area for recreation. This will virtually exclude small boat owners from using the Newport Beach Harbor and ocean areas during the summer months. 0 Rk1COMMENDATIONS The 18th Street launching area is the most widely used launching area by trailerable sail boat owners and their families because it allows for access to the ocean, contains necessary restroom and other facilities and ample parking ((depending on-the time of day and season . It also consists of a relatively large beach that can accomodate families, and friends for picnics, swimming and ether recreational beach activities while bo,;)ting. The boats using 18th Street are small and can usually only accomodate 2 -4 people at a time,and the beach area provides an ideal "home base' for families. A relatively simple solution which would provide for the safe use of the 18th Street area and Marine Park Beach by both small boat owners and swimmers would be to merely change the boundaries of the swimming area to provide a safe launching and boat use area. (See attached illustration.) As shown by the illustration, by eliminating the portion of the swimming area to the east of the launching area -the problem of boats passing through the protected swimming area is also eliminated. This would still provide more than ample area for swimmers and at the same time accomodate the legitimate need of the small boat owners to launch in the Newport Beach area. The need is especially crucial for the launching of small trailerable sail boats such as catamarans. The 18th Street launching area is currently one of the only areas in Newport Beach that also allows access to the ocean. Other areas, such as the Back Bay, r:hich is excellent for motorized boats, for instance, are blocked by bridges that will not accomodate the sail and mast heights of these trailerable bail.boats. 7 A cloariy visible sign could be posted to inform users Of the 18th Street launching area of regulations and restrictions and reduce or eliminate abuses of the boat launching privileges. The 18th Street launching area could easily be self - policed, provided its users :sere made aware of any re ulations and restrictions. The fact that regulations are not currently posted, i.e. no boating through swimming area, no driving on beach, etc. is to a great part responsible for the events which led, to the elimination of launching this past summer. The creation of a trailer parking area on the beach or near the launching area would provide an excellent service for small boat owners using the area and help to reduce parking congestion in the vicinity. A paved ramp on the beach allowing for trailers to be ,.,,,heeled down to the water's edge would also simplify small boat launching by eliminating the need to carry or slide the boat across the beach. The launch area is sheltered from the wind= sailboats are blocked from the harbor by the bridge,; and-the backbay area is not really•good for sailboats due to the depth of the shores, and the narrowness of the bay. DeAnza Marina - corner of Bayside and Pacific Coast Highway Sam Nigral, mgr., lessee of Irvine Company, property owners. Boat Launchin,* facility - paved ramp, fee of $4.50 per boat. Parking was for 120 units, now is 0•due to bridge construction. No gas available, food concession taken out due to Midge construction. Up untill a couple of months ago, this was probably one of the best small boat launching (not sail, however) areas in Xewport. However, the facility has been effectively put out of business because of 'the bridge construction. The lessee says that no one can tell him if there will be anything left after the new bridge has been built. The bridge is to be approxximately three ti.m, one. The area where the current bridge hits side of the bay is to be for future parking. bridge is constructed with cement bulkheads, will be removed to install a cement ramp. Reuben E. Director FROM: I Chief of Police SUBJECT: SMALL BOAT LAUNCHING AT 18th STREET AND BAY This is in response to your memo requesting comments on the proposal to expand small boat launching at 18th Street and the bay. While this is one of the few small beaches with a lifeguard on duty and available for family use, our primary concern with this proposal is the parking situation. In our view, there is insufficient parking space available for this area to be used for boat launching. There are no double length parking spaces available, which forces the • boat owner to detach his trailer and park it in a metered space or park it unlawfully in a red zone. Many boat owners remove their trailer license plates when unloading, the boat which creates problems in enforcing parking regulations. Because we cannot issue a citation to a vehicle without evidence of registration, we must store the vehicle or .ignore the violation. Most boat owners know this. A further problem is that many boat owners chain their trailers to their vehicles or a parking meter. As our parking control officers are not equipped with bolt cutters, this practice compounds the enforcement problem. There is no set -up or get -ready area for the boaters, which results in tow vehicles and trailers being parked in red zones and sometimes in the roadway, while the owner prepares the boat for launching. This creates serious driving hazards for other motorists in an area with heavy pedestrian traffic, including many children. It is our experience that this area cannot be, "easily self - policed," as proposed by Mr. Johnson. The boaters have not demonstrated a willingness to do this in the past. Some of the proposals violate Section 17.16.020 of the Newport Beach Municipal Code. That section specifically prohitits the use of trailers for boat launching at this site. This section also provides that, "only hand - carried vessels," may be launched. To term some of the catamarans, that require five or six people to unload them from a trailer • and drag them across the beach, as "hand - launched," may be stretching is Ronald A. I cannot think of a location that is ideal for small boat launching, but 15th Street and Bay Avenue is a better choi,ce in our view. That area provides as much or more parking. The beach is small and seldom used by bathers, which minimizes the pedestrian - vehicle conflict. The roadway is wide, which provides for greater vehicular safety and visability. Charles R. What you propose is termination of the lease agreement between the B.P.P.A, and the City of Newport Beach for the bayfront property easterly of "N" Street. This property has been leased by the B.P.P.A, for thirty years. The B.P,P.A. is of the opinion that for numerous reasons the property is • uniquely unsuited for "public" use. The following items cover all aspects of the proposed "public" uses HISTORYs - The original lease with the B.P.P,A, was signed on November 28, 1949 for twenty years and extended on a ",yearly basis, indefinitely" on August 8, 1969. - The B.P,P.A. represents approximately 850 residences on the Peninsula Point from Main Street in Balboa and extending easterly to the Jetty. - About half of the residents are currently members of the B,P.P.A. with fifty ramp users. - The B.P.P.A. has invested about $300000, (replacement cost) in capital improvements to the property. - The B.P.P.A, has been a good tenant with no liability to the City and superb facility maintenance. 17 Winburn - F.B. & R. Page 2 PROBLEMS WITH PUBLIC USE: - Security. Unauthorized use of the ramp has been a major problem. It is secured by a combination lock. The combination is changed annually, or oftener as required, as the combination tends to become common knowledge. To prevent unauthorized use for some years, the B.P.P.A. has employed an attendant to check and verify members' use of the ramp. This has been very successful. Obviously, "public" use would require a full time, year -round atten- dant to control use of the ramp. Boat & Trailer Storage. The storage area can accommodate 4 to 5 boat trailers, obviously inadequate for "public" use but quite adequate for B.P.P.A. use. Street parking of trailers is prohibited with complete cooperation of B.P.P.A. members. Overnight storage is strictly prohibited and violator's boats are routinely impounded by the Harbor Department. - Parking. While your "plan does not, seek to address the always difficult summer parking problem." it will surely make the parking situation untenable. In particular, "Public" ramp use will undoubtedly cause severe parking problems year round in the immediate residential area. • REQUIRED CAPITAL IMPROVEMENTS FOR "PUBLIC" USE: - The winch will have to be replaced at an estimated cost of $5,000. The current winch is rated for "light" duty at 2,000 lb. maximum weight of trailer and boat. - The dock is due for complete replacement due to excessive annual maintenance at an estimated cost of $5,000. - The two inboard pilings have reached the end of their use- ful life (8 years) and will require replacement very soon at an estimated cost of $4,000,, - For "public" use the ramp requires complete replacement at an estimated cost of $10,000. - The ramp electrical system requires an upgrade for "public" use at an estimated cost of $2,000. - The beach bulkhead is hazardous for "public" use and there- fore, requires complete replacement for an estimated cost of $300,000. - Total capital improvements to make the facility suitable is for "public" use are estimated to be $326,000. 1� Winburn - P.B. & R. • OPERATING EXPENSES: - To maintain adequate security (7 days per week.) attendant is of $20,000, per year. Page 3 for "public" use, a full -time required at an estimated cost - Maintenance of the facility, including winch repair, cable replacement, dock repair, painting, and general maintenance will cost an estimated $5,000. It is all done free by the B.P.P.A. members now. - Since the swimming area will be "public ", an additional life- guard will be required at an estimated cost of $6,000. per year. - Management of the facility, including members' records, per- sonnel administration, maintenance requirements, etc., will cost for "public" use an estimated $6,000. per year. This function currently is done at no expense by the B.P.P.A. Ramp Chairman. - Total estimated annual o erating expenses for "public" use of the "N" Street Beach /Ramp Facility are $37,000. We can appreciate your attempt to locate and develop additional • boating facilities for the residents of Newport Beach. However, we feel that with further study, it will become very apparent that this location in a residential area is totally unsuited for "public" use. It is already fully utilized to its capacity by members of the B.P.P.A. The volunteers at the Center carried on their duties, however, and service was not disrupted. Barbara came back to work January 21 and Judy returned January 30. The Friends of Oasis have applied for two federal grants through the County of Orange. One is a transportation grant and the second is for rennovation. SPECIAL CLASSES, The winter session began January 7; simultaneously, the rain began to fall, causing cancellation of outdoor classes such as tennis, golf, and sailing. Weather permitting, make -up lessons will be scheduled. Even though winter is traditionally a slow time, special activity registration for 1980 thusfar shows an increase over last winter. Tennis revenues are approxi- mately the same. The first "Sing -A -Long was held January 13 and drew almost sixty people. YOUTH AND ADULT SPORTS Adult softball is attempting to complete the season; however, the weather is not cooperating. Adult basketball should finish by early February at latest. Youth basketball games began January 12. Several divisions had to be cancelled due to lack of participation. The Cross - Country Meet held January 5 at Eastbluff Park was quite successful. Forty children registered for the event. All who ran January 5 advanced to the Orange County meet; of these, nine youngsters were eligible to participate in the SCMAF meet in San Diego.
