Commission was called to order at 7:00 P.M. iItem 42 - Roll Call Roll Call Roll call was taken. Commissioners Compton, Demmer, Grant, Herberts, Konwiser and Vandervort were present. Commissioner Taft arrived at 7:15 P.M. Item 03 - Approval of Minutes - Meeting of Approval of February 5, 1991 Minutes Commissioner Demmer corrected two mis -typed words, namely, "replaced" in paragraph 5 on page 2 and "has" in paragraph 5 on page 3. Commissioner Compton moved the minutes be adopted as corrected. Unanimous. Item 44 - Adoption of Agenda i Adoption of Agenda The agenda was adopted as presented with the addition of Chess Table at the Wedge to be addressed under Item #9; Arbor Day to be addressed under. Item #7; and Philosophical Approach to the Minutes to be addressed under Special, Urgent or Last Minute Items. II. INFORMATIONAL AND COMMITTEE REPORTS Item 45 - Park and Street Tree Division Park and Commissioner Compton thanked staff for installing Street Tree Division the 3 lights in Ensign View Park. Item 46 - Recreation Division Recreation Division Chair Grant requested a copy of the scheduling at the Marian Bergeson Aquatic Center. In response to a y p question b Commissioner] i Compton, Nancy Beard advised that the current I I recession has not affected the Recreation Division programs. Item 47 - Tree Committee Tree Committee Commissioner Herberts reported the committee did not meet. She thanked the Tree Division for I planting 33 trees last month. Commissioner i I Herberts questioned the status of the Eucalyptus on Commodore which were removed and Director I Whitley advised they will be replaced. i Commissioner Herberts reported the Tree Committee had recommended the Westcliff area receive priority for replanting during the rainy season. i Commissioner Compton inquired if many trees werel. lost during the last storm and Director Whitley' advised that there were and he will submit a report on this subject. Commissioner Herberts reported Arbor Day will be celebrated on April 26. Nancy Beard further explained the ceremony will take place at Andersen School which is located next to a park. Commissioner Herberts urged the Commission to attend this ceremony. Item #8 - Recreation Program Committee Recreation Program { i No report from Commissioner Compton. Committee Item #9 - Parks and Open Space Committee Parks and 1 Open Space Commissioner Herberts requested a similar chess Committee table be retained at West Jetty View Park. He pointed out that they I do not get much use at more active parks and if one is installed at West Jetty View Park, it would be put on a concrete pad for maintenance purposes. Chair Grant suggested staff continue to try to contact the artist and also pursue commercial tables to be installed at passive parks. Commissioner Vandervort thanked the Commission for their intense research done on the Circulation Improvement and Open Space Agreement which has been transmitted to the City Council. Commissioner Vandervort questioned Commissioner Demmer on her report which she had just distributed to the Commission. Commissioner Demmer stated she wanted Council to know the reasons for her negative vote on the Agreement' and why she is endorsing Bay View Landing as ani active lighted park. ! Director Whitley pointed out that the only way a minority report can accompany the Commission's report is by a successful vote by the Commission.; f Since this is not the case, Commissioner Demmer' j can transmit the letter by herself to the City, + Council. I I Commissioner Vandervort questioned if a follow up report should be written in order that the I Commission's decision is not undermined. Shed I further noted that Bay View Landing is not an, appropriate site for lighted fields since the seaj Island community would be extremely impacted and' the homeowners were never informed that an active', lighted park might be installed. In addition j there is a definite preference and need for a park /field at the Castaways site. Chair Grant advised that Commissioner Demmer has! ! the right to send her letter to Council and! •i Commissioner Vandervort also has the right to I ' I l further clarify and define the Commission's decisions. i Commissioner Herberts agreed with Commissioner! f i CITY OF NEWPORT BEACH arks, Beaches & Recre -ation Commission Page 4 "City Council Chambers 7 p.m. INDEX Vandervort that the Commission's report to Council does not include all the reasons for their decision. Director Whitley explained that supplemental reports cannot be official reports and that the report is on Council's consent calendar to be referred to the Circulation and Open Space Committee. Further input will be solicited when public hearing occurs. Commissioner Compton felt the Commission gave Council what they asked for and they approved what is in the General Plan. He reported he will also send a letter to the City Council stating that, although he was absent from the February 26 meeting, he was involved in the process. • Item #10 — Beach Committee Beach Committee Commissioner Taft reported the metal poles to be installed between 40th -44th Streets have still' not arrived. Commissioner Compton explained the delay is due to 3 changes on the specs and he expects them to be installed next month. Item 411 — Oasis Liaison Oasis Liaison Commissioner Demmer reported the computers were installed at Oasis. She also reported she met with the Chair of the Garden Committee who told her that staff did an outstanding job in replacing the garden plots and that the seniors are very happy. She invited the Commissioners to attend the garden dedication on June 23 which will include a band and festivities. Commissioner Demmer also reported 2500 seniors have renewed their membership and 1000 potential j members will be contacted. •S In response to a question by Chair Grant, Director Whitley advised it was the Commission's decision to not plant trees between the parking lot and Marguerite for safety reasons. III. PUBLIC COMMENTS IV. ACTION ITEMS Item 013 - Tree. Removal Request Appeal - 1027 Mariners Drive Item #13 was addressed following Item #9. Chair Grant opened the meeting to public hearing and Mrs. Elizabeth Tomlinson, 1027 Mariners Drive, addressed the Commission. Mrs. Tomlinson requested the 2 Eucalyptus Citriodoras be removed and replaced by the type across the street and in her front yard to give more continuity. She also felt the trees are too large and not aesthetic and environmentally correct for the area. There being no further public testimony, Chair Grant closed the meeting to public hearing. Commissioner Konwiser stated he felt the trees are nice specimens but are overburdened. Since he didn't see any uniform trees on the street, he would suggest replacement with one or 2 lower trees. Commissioner Herberts felt the trees are gorgeous and she supports the Tree Committee and Tree Maintenance Supervisor's decision to retain them. She added that sky scape is important and there are other Citriodoras in the area and she saw no damage caused by the trees. Commissioner Demmer pointed out that there are many requests to remove diseased trees and it would not be prudent to remove a healthy tree because most of the growth is at the top. Commissioner Compton favored replacing the 2 trees since he felt they do not add anything to the immediate neighborhood. Motion passes. Nays x Chair Grant advised Mrs. Tomlinson of her right to appeal the Commission's decision to the City Council. V. DISCUSSION ITEMS Item #14 - Status of Capital Projects Status of Capital Chair Grant questioned the new � play equipment Projects which has deteriorated. Director Whitley explained these were in West Newport Park and Nancy Beard has written several letters to the vendor, result of which they will meet next week to try to resolve the matter. • Commissioner Taft inquired about permanent benches at Little Corona. Director Whitley explained the temporary benches will be replaced with permanent ones when the contractor receives them from the supplier. Commissioner Compton questioned the status of Newport Shores Park and Director Whitley explained the plans were corrected and returned to the architect. Commissioner Compton also voiced his concern about plant and tree removal and Director Whitley advised there are no tree removals or scrubbing of plants in the plans. Chair Grant recommended Commissioner Compton review the plans before they go out to bid. Item #15 - Progress Report - Facility Inspections Progress Director Whitley stated this is the first time a Report— Facility complete progress report has been provided in Inspections response to the Commission's Inspection Reports. Commissioner Konwiser recommended the graffiti be • immediately removed at 38th Street Park. Commissioner Demmer referred to the wire fence on the bluff at Galaxy View Park and asked if it could be removed. Director Whitley will pursue. CITY OF NEWPORT BEACH • arks, Beaches & Recreation Commission Page 7 City Council Chambers 7 p.m. INDEX F Chair Grant questioned the status of the sign for the Marian Bergeson Aquatic Center and Nancy Beard advised it will be installed by General Services. Chair Grant requested this be a priority item. Chair Grant inquired about the sea wall at Lido Park and Director Whitley advised the Marine Department and General Services Department have been notified. Chair Grant requested the side slope at Begonia Park be renovated as soon as possible. VI. SPECIAL. URGENT OR LAST MINUTE ITEMS Chair Grant announced he has been invited by Newport National Little League to a ceremony honoring Bill Singer. He asked for the Commission's approval to allow him to present a letter or proclamation on behalf of the Commission. The Commission concurred and it was decided Chair Grant and Director Whitley will pursue. Chair Grant recommended that Goals and Objectives be placed on the Commission's April agenda as a discussion item. Commissioner Vandervort brought up for discussion the procedure of clarifying and correcting preliminary minutes. i VII. ADJOURNMENT There being no further business, the Parks, Beaches and Recreation Commission adjourned at 8:20 P.M. Dottie Flohr, Secretary PARK AND TREE DIVISION Item No. 5 MARCH, 1991 PROGRESS REPORT • Our park crews performed the following tasks in addition to normal maintenance during the month of March. Southeast Corner of Pacific Coast Highway and Dover Drive Installed plant material. Project completed and approved by the California Department of Transportation. "L" Street Park Installed a new drinking fountain. Buffalo Hills Park Started the removal of the old sand play area south of Port Nelson. We removed all of the wood (vertical telephone poles were throughout the area and the rail- road tie retaining wall)_ and removed what concrete we could. The rest is being bid for removal by contract. Newport'Boulevard Arterials Planted more 1 gallon material as needed. Corona del Mar Fire Station Started redoing the front lawn area. Six inches of soil with old soil removed • and replaced with amended top soil. 50' of railroad tie installed along the north side to keep cars off the new turf. Parkway dug out in preparation for concrete. Water Conservation Program - Update Data information supplied by a Utilities consumption comparison report for the same month and previous year have shown the following water useage reduction. The following areas represent, parks•, landscape traffic medians., and landscape, areas around city facilities. Planted 29 trees. Removed 5 trees. Root pruned 71 trees. Completed 34 work requests. Areas being trimmed this month: Poppy, Corona del Mar, Fashion Island, cut 200 palm fronds for Palm Sunday. The Arbor Day celebration is set for April 26 at Andersen School. We will be planting a tree at Buffalo Hills Park. The Youth Track and Field Meet will take place this Friday, April 5, at 5:00 P.M., Davidson Field. Once again the meet is sponsored by the Newport- Balboa Rotary Club. The UCI Sigma Alpha Epsilon Fraternity will also be assisting. We expect 120 to 150 participants to compete. Adult Sports 70 basketball teams took to the courts to begin the spring season on April 1. The winter softball season is pretty much all wet! So far we have experienced 6 rain out dates. We will, hopefully, get a chance to reschedule all games prior to the summer schedule beginning May 20. Contract Classes 1991 winter classes have come to a close. 2,965 participants, an increase of 580 over last winter, took advantage of our offerings. Some of the increase was due to new programs, including the swim team, music classes, and another increase in gymnastics participants. The winter tennis program also came to a close with 333 participants. This also represents an increase of 18 participants from this past winter. Corona del Mar Scenic 5K Plans are going along very well. out mid - April. Summer Brochure The June 8 event flyer will be The summer brochure is set to be out May 15. The summer message from the Commission needs to be completed as soon as possible. Senior Programs Oasis Many volunteers were honored this month. A tea was given on their behalf at which Opera Pacific performed. One hundred fifty volunteers were in attendance. The event was a success. Oasis held a Casino Night in conjunction with Costa Mesa Senior Corp. and the Orange County Ombudsman program on March 17. It was a successful fund raiser and cooperative effort. Three hundred tickets were sold. Many companies, individuals and banks sponsored the event and donated prizes. The Friends of Oasis had another wonderful Sunday jazz concert on March 3. The concert was paid for by the Schonek fund. Four hundred people were in attendance. West Newport West Newport has been picking up in activity. Its presence is becoming more familiar to people. Currently there are six class /activities at the center. The new coordinator is doing a great job in the area of publicity. Special Report On April 18 Grant and Inez Howald will receive a California Parks and Recreation Society, District Ten, Volunteer Award for their many years of supporting the youth in Corona del Mar and, specifically, the Community Youth Center of which Grant is the . Booster Club President. Most recently the Howalds have donated, through the Booster Club, one eight foot pool table, one "Hoop Shoot" basketball game, a ping pong table and a skee ball game. As you are all aware, the Howalds were the major contributing factor to the beginnings of the youth center concept in Corona del Mar in 1954. And, when removal is necessary, that Eucalyptus Citradoras be replanted with root barriers installed. Staff agrees with the premise as described in the petition and we do follow these guidelines when replanting street trees. The problem occurs when decisions are made after sidewalk, curb and gutter are removed that root pruning of large established trees, especially those with no tap root, make them unsafe and a public liability. • If there are questions, please feel free to call. Whitley C� 11 0 We, the undersigned residents of the Baycrest Community of the City of Newport Beach, hereby petition the City Council to retain our-street tree designation as "Citradora Eucalyptus" on the following streets: Commodore, Starlight, Glenwood, Candlestick and Sandlewood. This beautiful community was built approximately 25 to 30 years ago by the renowned pbuilder- architect, Ivan Wells, and the Citradoras that were planted throughout our neighborhood then, identify and distinguish our neighborhood like no other in the city. These graceful trees should be retained whenever possible by sensible "root- pruning" and where this absolutely unfeasible, new 15 gallon Citradoras should be planted with bottomless "root- barriers" to promote the downward growth of top roots for stability and the elimination of surface roots. A February 5, 1991 memo from Nancy Beard outlines existing events that the Recreation Division is involved in on a co- sponsored basis. The purpose of the policy is to allow staff to be consistent with requests as they are received and to improve communication with the public, Commission and the City Council on these events. The City solicits the co- sponsor. 2. The co- sponsor solicits the City by completing an application for review by the Parks, Beaches and Recreation Commission. Applicants shall be required to satisfy the Department's self - supporting nature by sharing profits. 3. Co- sponsored events or programs that are not self- supporting shall be subject to being approved by the annual budget process that would appropriate funds for the activity. • ' 1 ,s • 0 • CITY OF NEWPORT BEACH Parks, Beaches and Recreation Department DATE: February 5, 1991 TO: Parks, Beaches and Recreation Director FROM: Nancy Beard, Recreation Superintendent SUBJECT: CITY CO- SPONSORED EVENTS The City sponsors special events throughout the calendar year. The following 9 events are City generated: Rose Parade Excursion, Easter Egg Hunt, Arbor Day, Surf Contest, Scenic 5K Run, Golf Tourney, Halloween, Arts and Crafts Fair, and Winter Wonderland. Of these 9 events, four retain co- sponsorship. They include the Easter Egg Hunt co- sponsored by the Eastbluff Village Merchants Association, the Surf Contests by Maui & Sons, Scenic 5K Run by the CdM Chamber of Commerce, and Winter Wonderland by the Elks Lodge. These are events in which the City has, requested sponsorship - not vice versa. The co- sponsoring agency may donate products, services or, in the case of Winter Wonderland, a cash donation towards the purchase of snow. The remaining five events, Rose Parade Excursion, Arbor Day, Golf Tourney, Halloween and the Arts and Crafts Fair, are solely City sponsored and staffed. That leaves 2 events, the Memorial Day Celebration and the 4th of July Picnic. The events were created by area homeowner associations and designed to serve their specific locations. These events are becoming very expensive on the City's behalf as we are not reimbursed for costs out of any profits gained. In the case of the 5th Annual Memorial Day Picnic, the following is a detailed breakdown of City costs incurred: Personnel Parks Division Recreation (part -time) Printing Typesetting Posters (In- House /G.S. costs) Brochures (In- House) Insurance (1 Day Special q Port -A- Pottys d� Event Insurance) TOTAL: $618.20 256.00 $874.20 $ 70.00 100.00 200.00 $1,500.00 $ 180.00 $2,924.20 Our common practice is, as this is an event in which funds are • raised, the total costs should be, at the minimum, split by the group. This is not practiced by this group at this time. This event falls under our tax supported budget. My recommendation would be to retrieve our costs out of any profits over and above expenses. A second option would be to let it remain as a tax supported event. The Mariners 4th of July Celebration is in its 18th year. We have been co- sponsoring the event for the past 7 years. We were initially brought in on the event to assist the committee with City permits as the event was rapidly growing. We were then asked to purchase special event insurance and are now requested to pay for the entertainment. Total costs for the day's events are approximately $2,000. This event is also planned for under our tax supported budget. These are good events and well appreciated by the community. As long as we may continue to work off our tax supported budget, this department may easily continue to support the events. One City sponsored special event., the City Golf Championship, is currently under evaluation as it is no longer paying for itself. We cannot afford, due to our self supporting nature, to continue a • program which does not pull its own weight. This program would be inappropriately placed in the tax supported budget. It is my recommendation to drop this event. Attached is an attempt at a policy dealing with sponsorship requests. Mission Maintain and enhance recreation, both active and passive, opportunities for residents and guests of the City of Newport Beach by creating a quality recreation and open space system and ensuring its use through active interface and encouragement of the system users. B. Responsibilities of Commission 1. To advise the Council on matters of budget, planning, parking and recreation programs and establish acquisition policies for development and improvement of facilities. 2. Ensure that the facilities are used to capacity when demand exists. 3. Encourage the active implementation of the . recreation and open space element. 4. For details, see the City Charter. C. Administration /Overview Goals: 1. Increase Subcommittee's role of dealing with the public, i.e., volleyball, trees, recreation (re. field schedule) so entire Commission gets an approval or approvals only. 2. Spend more time on big issues. 3. Formalize goals and objectives for Commission, Committees and staff divisions. 4. Get capital projects done in a more timely manner. 5. Actively look for new Commissioners and encourage their application for a position. 6. Create a more meaningful agenda for our meetings with the City Council. • 7. Encourage the positive working relationship, between the School District and the City at all levels. • 8. Have two Parks, Beaches and Recreation social functions. 9. Continue providing for all of the maintenance requirements of the Parks, Right -of -Ways, and City facilities. 2. Continue with a comprehensive Safety and Training Program for both the welfare of the employees and reduce public hazards liabilities. 3. Establish a computerized inventory system of our water meters, backflow units along with their service dates, and irrigation controllers by location, make and the number of stations being used. 4. Strive for the mandated 20% water reduction by our Department. 5. Redevelopment or improvement as needed of our property sites. • 6. Provide training to our employees to maximize in house as • advancement for job openings. 7. Strive for cooperative working relations with other Departments. 8. Continue to strive for a positive public perception towards our Department. Long Term Objectives 1. Establish a master plan for the redevelopment and improvement of our property sites. 2. Provide ongoing water conservation by utilizing new technology in irrigation and the use of drought tolerant plants and grasses. 3. Research and implement new training techniques to keep up with industry changes so that we can utilize new products and technology. 4. Minimize the use of chemicals as alternatives become available. B. Street Tree Division • Goals: 1. Establish a proactive management strategy by the utilization computerized inventory system. 2. Maintain a two (2) year trim cycle. 3. Reduce public hazards /liabilities caused by street trees. 4. Establish Arborist Certification training. 5. Continue a comprehensive safety and training program. Long Range Objectives: 1. Fill all possible planting sites with healthy trees. 2. Establish a master removal and replacement program. 3. Establish public awareness of the value of our street trees. 4. Maintain the City's status of Tree City U.S.A. L� • �L C Recreation Division Mission Statement: It is the goal of the Recreation Division to provide activities, services and facilities to Newport Beach residents of all ages beginning with infants through "seasoned citizens." The Division is responsible for analysis of the community's parks and recreation needs and continuous development of new and existing programs. It is also responsible for routine building maintenance and capital improvements. As necessary, the Division will also provide support and input to other City functions regarding recreation programs and acts as liaison to various community organizations. The Recreation Division provides service delivery through four specific sections operated by Recreation Supervisors. Special Activities /Tennis/Acruatics The Special Activities /Tennis Section is responsible for annually developing over 1,000 self- supporting special interest classes for residents of all ages, including fitness, dance, arts /crafts and drama. The Section also operates the self - supporting instructional tennis program which registers 1,900 participants annually at various age and skill levels. Additional activities include . outdoor theme excursions, tennis tournaments and the Corona del Mar Scenic 5K. A full aquatics program utilizing Newport Harbor High School and the Marian Bergeson Aquatic Center is supervised in this section. Youth Activities /Facilities The Youth Activities /Facilities Section provides playground and park inspections and sports activities for youth and building maintenance services to City facilities. The Section also provides for the reservation of City buildings and athletic fields. Specific theme activities and events developed and programmed by the Section include annual Halloween, Holiday and.Spring vacation celebrations, 4th of July and Memorial Day celebrations and the City Golf Tournament. Youth and Adult Sports /Sailing The Youth anbd Adult Sports Section provides self- supporting adult sports leagues in softball and basketball. The Section also programs the Annual Rose Parade Excursion and supervises the instructional sailing program. over 800 adult teams compete annually on City and School District facilities through leagues organized by this Section. Youth Track and Field, Flag Football and Basketball Leagues and a field maintenance program are also organized and evaluated through this Section. 0 ao Senior Citizen Programs and Services • The Senior Citizens Programs and Services Section provides a wide range of programs for older adults through the Oasis Senior Center, West Newport Community Center and satellite facilities. The Section also operates the Oasis Center and works cooperatively with the Friends of Oasis, the Center's non - profit volunteer support group. Over 2,800 older adults belong to the Friends of Oasis and over 30,000 volunteer hours are required to staff the co- sponsored programs. Examples of activities and services include dance, bridge, housing, advocacy, health services and special events. Goals: The goals of the Recreation Division for the upcoming year will include: 1. Expanding senior services at the West Newport Community Center. 2. Develop a senior transportation plan. 3. Provide preventative health care screening services through the County by contracting with "Elder Care." 4. Increase the case management council and referral program for • homebound seniors and their families. 5. Raise the Recreation Division's visibility through the development of a marketing plan and multi media departmental showcase for Cable production. 6. Decrease the amount of time spent by the sports supervisor on scheduling softball umpires by possibly contracting for services. 7. Advance the amount of recreation registration by• offering a charge (Visa /Mastercard) method of payment. 8. Due to the increased youth programs, elevate part -time youth coordinators to full time status. 9. Install the facility management computer program to better schedule building facilities. 10. Assist the participants of the Bonita Creek facility with the lack of parking. (Perhaps working a deal with the State for use of land adjacent to Bonita Creek.) 11. Expand the ETC program. 12. Develop an 18th Street sailing base. • 13. Resolve the Lincoln Athletic Field lighting situation. c� n LJ • 14. Offer a chance for disabled persons to participate in a City sponsored event. (Special Olympics Basketball Tourney) 15. Develop a close working relationship with the Newport -Mesa School District. 16. Move a portion of the Aquatics Section from the self - supporting budget to tax supported budget to offset the rising costs of staffing and Red Cross services. III. COMMITTEES A. Beach Committee Mission: To provide the best possible services and facilities for both residents and non - residents using the public beaches in Newport Beach. Goals: 1. To provide safe and well supervised areas for all beach activities, i.e., swimming, body surfing, surfing, volleyball and beach sports, sunbathing, etc. 2. To standardize authorized volleyball courts so that they have uniform poles and are maintained in accordance with official regulations. 3. To maintain beache's in proper condition and with adequate sand, especially Little Corona and Balboa Island. 4. To see that restrooms and trash containers are properly maintained. 5. To encourage contests and stimulate interest in beach activities. B. Recreation Program Committee Goals: 1. Monitor and work with Recreation Division to ensure fair scheduling and to increase recreation programs. 2. Ensure winter and spring recreation brochures are reviewed by Parks„ Beaches and Recreation, articles written and presented to Parks, Beaches and Recreation Commissioners on time. Tree Committee Mission: Provide and encourage an atmosphere and method to enhance the overall tree environment in the City of Newport Beach. Goals: 1. Ensure trees are planted where needed. 2. Provide programs to allow residents to add trees easily. 3. Increase citizen awareness for the need for trees and their benefits. 4. Ensure preservation of trees wherever practical. 5. Reduce Commission's time spent on preserving trees while not losing effectiveness of program. • 6. Encourage new choices of designated trees to drought resistant varieties. 7. Reforest 2 and 3 block areas as identified by the Tree Committee. S. Communicate and inform residents in the care of existing and newly planted trees. 9. Develop more pleasing grouping of several varieties of trees in park plantings. Obl ectives 1. City Council study Session Agenda Item No. 8 March 25, 1991 TO: MAYOR AND CITY COUNCIL FROM: General Services Director SUBJECT: SIDEWALK REPAIRS Discussion In an effort to decrease the backlog of sidewalk repairs,, a procedure has been developed with the cooperation of the City Attorney to require residents to pay for damages to public sidewalks caused by private trees. The procedure commences with the identification by the City inspection crews of a private tree causing sidewalk damage. An initial letter to the property owner explains the procedures associated with repairs if the owner chooses to perform the work. The second letter of notice is sent if no action occurs within 90 days to allow the owner an additional two weeks further delay before City crews will repair the damage and back charge the owner. We expect the majority of residents will opt for City crew repairs. The attachments provide examples of the two letters and procedure checklist. From initial discussions with some effected property owners in regards to the proposed procedure, we expect some minor citizen opposition to paying for the repairs, However, the Municipal Code. (Section 13.04.090) clearly authorizes this remedial action at the expense of the property owner. Substantial amounts are involved in some cases. For example, in one recent case three large private pine trees had caused extensive damage to a street corner (sidewalk, curb, and gutter). The replacement materials alone cost over $8,000. Recommendation That the General Services Department be allowed to implement the proposed program of repairing sidewalks damaged by private trees at private expense. Very respectfully, David E.
