Niederhaus, General Services Director Andrea McGuire, Senior Recreation Manager Teri Craig, Administrative Assistant APPROVAL OF MINUTES Motion by Commissioner Macfarland to approve the minutes of August 7, 2001. Motion carried by acclamation. Public Comments John O'Hara representing Newport -Mesa Junior Basketball League stated that he had just been made aware that the light fees had increased from $10 to $30 an hour. He noted his concern that they would be unable to raise the fees needed for this year but would be willing • to work with the City to increase the fees in phases. Manager McGuire stated that Council had passed these fees in July with all sports groups notified of the pending change in June. Consent Calendar 1. Correspondence - The following communication was added and acknowledged. To: Newport Village HOA, August 28, 2001 2. Park and Tree Division 3. Item pulled by Manager McGuire 4. Item Pulled by Chair Skoro 5. Bench it Tree Donation - Accept a bench and tree donation (species to be determined by staff) from Colleen Howes. Bench to be installed at Balboa Pier; tree to be planted at Grant Howald Park. Motion by Commissioner Macfarland to accept items 1, 2 and 5 of the Consent Calendar. Motion carried by acclamation. 3. Community Services - Manager McGuire stated that that Youth Flag Football has requested lights at Arroyo Park from dusk to 9pm on Fridays from October 5 to December 7. She noted that the Commission had approved this but that it had not been • in use. Parks, Beaches & Recreation Commission Regular Meeting September 4, 2001 • Page 2 Motion by Commissioner Allen that Youth Flag Football be allowed to use the lights at Arroyo Park from October 5 to December 7 from dusk to 9pm. Motion carried by acclamation. 4. Facility Inspections - Chair Skoro reminded the Commission of the facility inspections 6. Tree Removal Discussion /decision request by Catherine O'Brien to remove two City. 6. Tree Removal - Director Niederhaus stated that Catherine O'Brien has requested the removal of two City Ficus rubinginosa trees at 1300 Nottingham Road. He stated that the request does meet the minimum requirements of the City tree policy based upon a repeated history of damage to private property. Commissioner Beek asked if invoices are checked provided by homeowners regarding repeated damage. Director Niederhaus stated that where possible the Utilities Department verifies problems regarding lateral sewer lines and plumbers are usually asked to provide tree • roots. Chair Skoro opened the public hearin¢ Jan Vandersloot, 2221 E. 16th Street, asked why they are requesting that two trees be removed? He also noted that the 2d invoice looks to be an estimate and not for services provided and would like that to be confirmed. He also noted that annual clean -outs should not be considered repeated damage but maintenance needed on your home. Chair Skoro closed the public hearing Director Niederhaus apologized that the homeowner was unable to attend because of cancer surgery but noted he had confirmed that that $89.50 had been paid and was not an estimate. Discussion ensued regarding required normal plumbing maintenance and that it should not be considered as part of repeated damage but that a homeowner should take it upon themselves to have it done once a year. Motion by Commissioner Beek to deny the request for the removal of two City Ficus rubinginosa trees at 1300 Nottingham Road by Catherine O'Brien. Substitute motion by Commissioner Allen to continue this item until November when homeowner is able to attend. Motion failed by the following vote: • Ayes: Allen, Skoro Nays: Beek, Franklin, Macfarland Parks, Beaches a Recreation Commission Regular Meeting September 4, 2001 • Page 3 Commissioner Beek stated that should the homeowner decide to appeal that they are able to contact their Council Member and or City Manager. Motion carried by the following vote to deny the request of Catherine O'Brien: Ayes: Beek, Franklin, Macfarland Nays: Allen, Skoro 7. Tree Removal - Director Niederhaus stated that Thomas Kelleher has requested the removal of City Eucalyptus sideroxylon parkway street tree at 428 Marguerite Avenue. He stated that the request does not meet the minimum requirements of the City tree policy for removal, but that based on the number of sewer blockages, cost of plumbing repairs and the fact that the resident has personally absorbed the expenses; staff recommends removal, as they do not feel that the roots can be mediated. Director Niederhaus distributed homeowner costs from 1990 to date. Commissioner Macfarland stated that the frequency does not meet the criteria in the Council Policy G -1. Chair Skoro opened the public hearing. • Tom Kelleher, 428 Marguerite Avenue, stated that he has owned the property for 13 years and stated that the plumber ran into roots at 20 feet and recommends a clean out at least every nine months. He stated that he has fallen $4 short of the amount stated in the policy and asked that the Commission approve his request. He also noted that he would personally fund the change of the lateral line to the City sewer line on the condition that the tree is removed. Commissioner Beek asked Mr. Kellerher if it is known that you must do a scheduled maintenance every nine months, shouldn't you try to save the tree? Mr. Kelleher stated that with the past problems of the tree for the last thirteen years that he would just like to have another tree that will not cause the problems that a Ficus does. Jan Vandersloot, 2221 E. 16`h Street, stated that the costs incurred by homeowner are really quite average costs. He stated that the G -1 policy was never intended to include costs for just maintenance. He urged the Commission to deny the removal. Chair Skoro closed the public hearing. 7. Tree Removal Discussion /decision request by Thomas Kelleher to remove one. • Motion by Commissioner Beek to deny the request for the removal of one City Eucalyptus sideroxylon parkway street tree by Tom Kelleher at 428 Marguerite Avenue. Parks, Beaches @ Recreation Commission Regular Meeting September 4, 2001 • Page 4 Commissioner Allen stated that she would not support the motion as continued maintenance on clay sewers is probably endangering the household and suggested that staff return with a report on clay sewers. Motion carried by the following vote to deny the request of Thomas Kelleher: Ayes: Beek, Franklin, Macfarland Nays: Allen, Skoro 8. Committee Reports 38`" Street Ad Hoc - Manager McGuire stated that the first meeting would be held September 17, and that there will be public notice and updated police reports. Budget - Nothing new to report. Castaways Park - Nothing new to report. Park Development - Commissioner Allen stated that the Committee had met to discuss Newport Village and discussed a timeline. She noted that there was $35,000 on hold to design the passive view park. She also stated that letters had been sent to homeowners associations and will public notices will be sent regarding the October 2 meeting. Recreation ft Open Space Element - Nothing new to report . Recreation Services - Commission Franklin stated that staff is working on different wording for the policy and will bring to the Commission in October for their review. Seniors - Nothing new to report FUTURE AGENDA ITEMS • Vendor at CdM State Beach Viability of clay sewers Review fees for youth sports groups.
