Request for encroachment within Buffalo Hills Park adjacent to the Newport Hills
Community Association Clubhouse located at 1900 Port Carlow Place.
RECOMMENDATION
Staff's position is neutral regarding this request and have no formal recommendation.
Background
The Newport Hills Community Association (NHCA) submitted the following:
• Attachment A — Letter from David A. Anderson
• Attachment B — Plan as it currently exists
• Attachment C — Conceptual Plan for land and hardscape improvements
The proposed plan calls for an expanded clubhouse, but preserves the existing pool facilities. In
addition to the improvements in the immediate pool area, the Association is requesting an
encroachment into the adjacent park area in order to accomplish the following park/land
improvements:
1. Demolish and replace the existing sidewalk in the front of the clubhouse providing a more
cohesive entrance into the newly remodeled facility.
2. Demolish, realign and replace sidewalk along the east side of the property line of the clubhouse and
pool area. As shown in the pictures, this sidewalk currently curves around the existing block wall and
then follows along the pool gate. The Association feels that there is a line of site hazard for persons
on bikes, scooters etc... and is proposing to straighten out the sidewalk to eliminate the hazard. In
addition, the sidewalk is distressed in a few areas and in need of repair.
3. Encroachment into the Park on the north side of the pool area in order to install a new pool
entrance at the north east corner of the pool deck to allow pool users easier access to the park.
4. Encroachment into the Park on the north side of the pool area to enhance the perimeter
landscaping and provide more screening between the pool activities and the Park.
As noted in their request, the NHCA will be responsible for all costs associated with these
improvements as well as the costs for the ongoing maintenance of the landscape improvements.
You may also note that this request is significantly scaled back from the request submitted to the
Commission several months ago. For numerous reasons the Association is not ready to move forward
with their extensive expansion plans as previously submitted and what is now requested only involves
minor encroachments into the park in order to better accommodate the pool patrons, provide aesthetic
enhancements and a safer walkway.
As is our practice, staff has noticed all homeowners within 500 feet of the perimeter of the project of
the request and the opportunity for comment at the September 2, 2003 Commission meeting.

Recommendation
Staff reconunends that the Parks, Beaches and Recreation Commission approve the reforestation
request of the Newport Hills Community Association (NHCA), property owner of the NHCA's
Clubhouse at 1900 Port Carlow Place.
Discussion
City Council Policy G -1, Reforestation of City Trees requires that individual property owners living
within a legally established community association area with mandatory association membership
must petition for reforestation through their respective association.
Per City Council Policy G -1, the City has received a request from the Newport Hills Community
Association Board of Directors approving the removal of two City Lemon Scented Gum park trees
within the Buffalo Hills Park adjacent to 1900 Port Carlow Place. In addition to planting two 24-
inch replacement trees, the Newport Hills Community Association Board of Directors are proposing
to incur the cost for the planting of two additional 24 -inch box trees within the specified area for
park enhancement.
The property owner has complied with the requirements of the G -1 Policy, and has agreed to assume
the full cost of the removal and replacement of the City trees, approximately $1,248.00 (5390 for the
required two 24 -inch box replacement trees, $390 for the additional planting of two 24 -inch box
trees, and $468 for two removals).
Staff has attached a Tree Inspection Report, Tree Inventory Detail, and photographs related to the
request.
The Newport Hills Community Association has received a copy of this report and a notice of the
Commission meeting.

Dear Staff Members,
On behalf of the Newport Hills Community Association ( "NHCA ") would like to request the
Parks, Beaches and Recreation ( "PB &R ") Commission's approval to proceed with the following
park land improvements:
1. Demolish and replace existing side walk at new Clubhouse entry.
2. Demolish, realign and replace side walk along east property line of Clubhouse and pool
area.
3. Request approval to encroach into park land for the installation of new pool entrance at
the north east corner of the pool deck.
4. Enhance perimeter landscaping around new clubhouse and existing pool deck as defined
on the proposed landscape plan prepared by Charles Towbridge and Associates
• (attached).
As discussed during our on -site meeting with the PB &R Commission Staff Members, NHCA will
be responsible for all costs associated with the requested improvements. In addition, NHCA will
provide and pay for the associated landscape maintenance for the new landscaped areas.
We thank the staff members again for taking the time to workout this public improvement that
will ultimately benefit the community. We look forward to addressing any questions the staff
peffiFeN or commissioners may have during the September PB &R Commission meeting.
