DISCUSSION: Background: The Cities of Newport Beach, Costa Mesa and Huntington Beach signed a Memorandum of Agreement (MOA) on OCRP in the fall of 2006 (Attached). The County of Orange was intended to be a fourth party to the agreement, but never executed it. The agreements contained in the MOA are as follows: • Provide copies of new park plans or modifications in parks within and adjacent to OCRP to other cities and to the OCRP Steering Committee for review and comment prior to approval. • OCRP to provide all parties with equal opportunity to participate in application for funding for park improvements for any part of OCRP. • All parties to use opportunities to promote the OCRP name and logo. • All parties to continue to appoint a staff representative to the OCRP Steering Committee. Despite the County's failure to sign the MOA, the cities and the County have continued to send staff representatives to OCRP Steering Committee meetings. In addition, the cities completed their vision plans and shared them with the OCRP Steering Committee and one another. The Newport Beach City Council accepted our vision plan on April 8, 2008. Review of MOA Regarding Orange Coast River Park September 8, 2009 Page 2 The OCRP Steering Committee hosted a Partnership Meeting on June 5, 2009, to share reports on progress on implementing vision plans and to discuss next steps in furthering the OCRP. Council Member Gardner led the discussion on next steps, which resulted in consensus that the three cities' vision plans should be consolidated into one unified document, and that the Steering Committee should revisit the MOA and perhaps finalize and implement it, with or without the County's participation. Among the provisions that could be included in the MOA is a method for coordinating response to issues that arise on land within the OCRP area. A recent example is a complaint regarding the lack of trash collection from a trail section on the east side of the Santa Ana River. The land is in unincorporated Orange County, and the County maintains responsibility for the dirt and planted areas, but the paved trail is not part of the County trail system. The County has an agreement with Costa Mesa to maintain the paved trail, but this is not a location that's easily accessible to Costa Mesa crews. Questions for Council Discussion: Council Member Gardner requested that this item be discussed, and is seeking the Council's direction on the following questions. • Does the Council support the consolidation of the three cities' vision plans? • If so, should this be a staff - driven or Council- driven project? • Should the MOA be revisited, and finalized by the three cities if the County remains uninterested in becoming a party to the agreement? Should the MOA be expanded to include a method for coordinating response to issues in the OCRP area? • Should other provisions be added to the MOA? Visionary proposals put forth in the Santa Ana River Corridor Vision Plans recently adopted respectively by the Cities of Costa Mesa, Huntington Beach, and Newport Beach. And also, B. Other OCRP- related plans, programs, and projects adopted by these Cities, the County of Orange, the State of California, and the US Corps of Engineers. Accordingly the OCRP Committee has prepared a draft consolidated list/map of the above items. An OCRP representative would be pleased to briefly meet with staff of the respective agencies to confirm the draft information and help with subsequent interagency work to explore how best to carry forward the coordinated implementation of these items, especially as they relate to the Orange Coast River Park. A partial example of the computerized list is attached. The immediate intent of the example is to convey the general scope and breadth of the items which relate to the OCRP and to point out in the "STATUS" column that of the considerable number of Vision Plan proposals listed, almost all remain as visions only - and of the other identified projects, very few are actually being planning, underway, or completed at this time. With more than 200 plus acres of Newport Banning Ranch (NBR) potentially available for inclusion in the park as well as miles of potential trail linkages, we would like to suggest that we be more formally included in discussions, visioning and planning for the OCRP. To date, all of our planning has taken into consideration a future OCRP that we believe has the potential to become a significant coastal asset. Our efforts have been guided by the materials and plans available at the time. The lowland area of NBR, and its proposed bluff top park and associate trails are all designed in a manner that provide for connectivity to both a future OCRP and proposed Sunset Ridge Park. Additionally, we believe that public parking within the NBR can accommodate some of the users of a future OCRP. In reviewing the list of OCRP board members and advisory committee members, to the best of our knowledge, none are property owners within the proposed approximately 1,000 -acre OCRP boundaries. With as much as 25 percent of the OCRP study area included within the boundaries of our property, NBRLLC believes there should be property owner representation as a full partner in new government sanctioned planning efforts or organizations. We believe that we, as well as other property owners, can bring ideas "to the table" that will help expedite implementation of the OCRP. With respect to NBR itself, the Newport Beach General Plan already contemplates public use of a substantial portion of the 401 -acre property, and that any development plan set aside at least 50 percent of the property as preserved open space. The NBR is now an September 8, 2009 Re: Proposed Orange Coast River Park MOA Page 2 of 2 operating oil field with no public access. Substantial acquisition and remediation funding as well as willing participation of property owners would be necessary to achieve OCRP goals and to win necessary regulatory approval. The City of Newport Beach has commissioned an independent study of acquisition possibilities and has learned that little if any funding is available for such an acquisition - certainly not enough funds to acquire the entire NBR property and for rehabilitation. NBRLLC has presented a plan that proposes to utilize approximately 30 percent of the site for a residential village as allowed under the voter approved General Plan and sets asides as much as 70 percent of the site for rehabilitation, public access, parks and stewardship. That plan is now being evaluated and the CEQA review process is underway with public participation. Please let this letter serve as NBRLLC's support for the MOA concept, but also as a recommendation that private property owners be given a significant partnership roll, along with the already included public entities and agencies. This role should include goal setting and planning efforts, and be a process that is transparent, professional and based on sound economic principals. Uly, A.
