Brown, City Clerk TITLE: Appointment of New Civil Service Board Member to Fill the Unscheduled Vacancy on the Civil Service Board ABSTRACT: Due to the resignation of Jeff Herdman from the Civil Service Board, the City Council has the opportunity to fill the vacant position pursuant to City Council Policy A-2 (Board, Commission and Committee Appointments), City Charter Sections 702, 705, 710 and the Maddy Act. RECOMMENDATION: a) Determine that the action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because it will not result in a physical change to the environment, directly or indirectly; and b) Appoint Jane Della Grotta or Sharon Wood to fill the unexpired balance of Jeff Herdman's term, which expires on June 30, 2018. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION - On August 5, 2016, Jeff Herdman resigned his position on the Civil Service Board. Pursuant to City Charter Section 710, Mr. Herdman was an appointee of the City Council. His term was scheduled to expire on June 30, 2018. Pursuant to City Charter Sections 702 and 705, and City Council Policy A-2, the City Council's appointee to the Civil Service Board will serve the balance of Mr. Herdman's unexpired term. 17-1 Appointment to the Civil Service Board September 27, 2016 Page 2 Pursuant to the Maddy Act and City Council Policy A-2, the City Clerk prepared and posted a Notice of Unscheduled Vacancy on Monday, August 8, 2016, in the City Clerk's Office, at the Central Library, on the bulletin board in the City Council Chambers, and on the City's webpage, and published the Notice in the Daily Pilot on Saturday, August 13, 2016. As provided in the Notice, applications were accepted by the City Clerk's Office until 12 p.m. on Monday, August 29, 2016. The City Council Ad Hoc Appointments Committee consisting of Mayor Diane Dixon, Mayor Pro Tem Kevin Muldoon, and Council Member Tony Petros conducted interviews on Tuesday, September 20, 2016, and are recommending that the City Council choose either Janet Della Grotta or Sharon Wood to fill the unexpired balance of Jeff Herdman's term. Copies of the applications are attached hereto as Attachment A. Appointment Process Pursuant to Council Policy A-2, appointment to the Civil Service Board will take place in the following manner: A. The City Council will vote on the appointment simultaneously. The voting will be by paper ballot and the City Clerk will tabulate and announce the results, including the vote tally. B. Each member of the City Council will cast one vote on the paper ballot. In order to be appointed, the nominees must receive at least four votes. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). As a Law Clerk for the City of Santa Ana (1978-80) an as an Attorney and Benefits Coordinator for the cities listed above, concentrated on negotiating the best employee benefits for all employee groups, including Police and Fire. In Fullerton, I administered all employee benefits, oversaw the hiring policies and process and was part of the City's negotiating team. i have had many experiences including working with PIERS, appearing in Federal Court while I was eight months pregnant when a pregnant employee alleged discrimination, and oversaw the drug testing program. I was at a Police negotiation when they brought the canines with them, wrote ordinances and resolutions and generally interacted with the entire employee population. I loved what I did and still maintain many valuable friendships from City employment. I would bring to the Civil Service Board that skill set. I know how a city works, and ani especially well -versed in employee negotiations and disciplinary actions. Among my responsibilities as Assistant City Manager, I managed the Human Resources Department for a year when its position in the organizational structure was being evaluated. I was Secretary to the Civil Service Board during that time, became familiar with NBMC Chapter 2.24, the Civil Service Rules and Regulations and the Personnel Policies, and worked on revisions to the latter two. I also considered disciplinary appeals from employees that did not rise to the level of the Board. Finally, I was the point person for labor negotiations, a role that I continued to fill for several years.
