Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Peter Tauscher, Civil Engineer, ptauscher@newportbeachca.gov PHONE: 949-644-3316 TITLE: Grand Canal Dredging Project — Phase 1 of 3 Planned Permitted Projects —Award of Contract No. 8171-1 (161-112) ABSTRACT: Staff has received construction bids for the first phase of three planned dredging projects in the Grand Canal utilizing our Army Corp Regional General Permit (RGP 54) and City Eelgrass Plan, and is requesting City Council approval to award the contract to Associated Pacific Constructors, Inc. of Morro Bay, California. RECOMMENDATIONS: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Class 4 Section 15304 (g) (Maintenance dredging where the spoil is deposited in a spoil area authorized by all applicable state and federal regulatory agencies) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment; b) Approve the project drawings and specifications; c) Award Contract No. 8171-1 to Associated Pacific Constructors, Inc. (APC) for the total bid price of $397,000.00, and authorize the Mayor and City Clerk to execute the contract; d) Establish $38,000.00, approximately 10 percent, contingency amount to cover the cost of unforeseen work not included in the original contract; and e) Approve Budget Amendment No. 17BA-012 appropriating $84,000.00 from the unappropriated Tidelands Capital fund balance to Account No. 10101-980000- 16H12 for Grand Canal Dredging Project — Phase 1 project (Attachment B). 6-1 Grand Canal Dredging Project — Phase 1 — Award of Contract No. 8171-1 Project No. 16H12 October 11, 2016 Page 2 FUNDING REQUIREMENTS: Upon approval of the budget amendment, there is sufficient funding for this project. Construction Contingency $ 38,000.00 Various and On -Call Surveying Printing & Incidentals $ 9,000.00 Total: $ 444,000.00 DISCUSSION: In conjunction with the Department of Army Regional General Permit 54 and Santa Ana Regional Water Quality Control Board 401 Permit, California Coastal Commission (CCC) issued Coastal Development Permit 5-14-0200 and Consistency Certificate CC - 0002 -15 for dredging, sand replenishment, and eelgrass protection. In June 2016, CCC issued a Condition Compliance for application DRG2016-1051 permitting maintenance dredging along the Grand Canal (Attachment A). In accordance with permitted eelgrass protection limitations, this dredging effort will require multiple phases. The current contract recommended for approval will address dredging in Grand Canal from Park Avenue Bridge to South Bay Front. At 10 a.m. on September 21, 2016, the City Clerk opened and read the following electronic bid for this project: BIDDER TOTAL BID AMOUNT Low Associated Pacific Constructors, Inc. $397,000.00 The bid generated significant contractor interest; however, only one responsive bid was received. The relatively small project size, restrictive access to the Grand Canal, compounded with the exorbitant cost to mobilize and relocate dredging equipment to the local area may have resulted in contractors' higher than expected bid. Due to the project's specialized scope, location and relatively small size, staff believes rebidding the project will not likely yield better pricing. As such, staff recommends awarding this contract. The low bidder, Associated Pacific Constructors, Inc. possesses a California State Contractors License Classification "A" as required by the project specifications. A check of the contractor's references indicates satisfactory completion of similar projects for the City of Newport Beach and other public agencies. 6-2 Grand Canal Dredging Project — Phase 1 — Award of Contract No. 8171-1 Project No. 16H12 October 11, 2016 Page 3 This proposed project involves coordinating with residents and the ongoing Park Avenue Bridge replacement project; conducting hydrographic surveys; and dredging and disposing material. The suitable dredged material shall be transported off site for placement at the U.S. Environmental Protection Agency's LA -3 Ocean Dredged Material Disposal Site (ODMDS). Pursuant to the contract documents, the Contractor will have forty (40) consecutive working days to complete the work. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Class 4 Section 15304 (g) (Maintenance dredging where the spoil is deposited in a spoil area authorized by all applicable state and federal regulatory agencies) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
