RECOMMENDATION: Remove this item from the calendar. FUNDING REQUIREMENTS: There is no fiscal (budget) impact related to this item. DISCUSSION: AutoNation has withdrawn the appeal (Attachment A). The Planning Commission's denial is now effective. The city council and former Mayors for the most part have made great decisions in the interest of the community concerning city planning. However, the latest decision to deny the proposed AutoNation project on Coast Highway adjacent to Dover I believe is a misguided one. Based on the findings and discussed in detail at the planning commission I find its decision to deny this new state of the art project not making much sense. Leaving that stretch of Coast Highway with functionally obsolete structures does not add a lot of value to our community. A new state of the art AutoNation Porsche facility is exactly what that stretch of the highway needs as it has become the home to other exotic car dealerships. This new dealership would add to the American Rivera lifestyle that Newport Beach has become known for. Based on the noise meters used to show that noise is a non -issue, the roof covering and putting in a new 3rd traffic lane I cannot understand why this project should not be approved. The large and impressive turnout clearly demonstrates the great interest and concerns of the homeowners. Community concerns were that the AutoNation Prosche Development Project will (1) not enhance the surrounding community, (2) be incompatible with the surrounding neighborhoods, and (3) have an adverse impact. Concerned Homeowners, Patrick and Janice Gormley Community of Bayshores 12-13 2441 Marino Drive Newport Beach, California 92663 Patrick and Janice Gormley Re: AutoNation Porsche proposal to build a dealership and service center/garage on 11 lots along West Coast Highway on Mariners Mile across from Bayshores and below Newport Heights September 25, 2016 Dear City Council and Planning Commission, The City of Newport Beach Planning Commission and City Council must hold the proposed use of this land situated between two residential neighborhoods, Newport Heights and Bayshores, to a much higher standard than any other development location along Mariners' Mile. The City's in- herent responsibility is to assure all proposed development projects will enhance the community and be compatible with the surrounding neighborhoods without adverse impacts. At the very least, an Environmental Impact Report (EIR) must be required. In conducting this study, AutoNa- tion Porsche business plan data (actual historical sales combined with projected increase in sales) used to justify moving to this stand-alone facility must be the foundation and basis for the projected increases in traffic, noise, pollution, etc. Moving the Porsche auto dealership showroom and service/garage/parking has been justified because there are other Auto Dealerships in the vicinity. This is faulty and unacceptable. The new AutoNation will span 11 lots and 500+ feet along Coast Highway, which is about three times big- ger than currently or previously has occupied the space. AutoNation proposed to break with tradi- tion by introducing service operations, which are not part of the existing companies, such as Fer- rari, Maserati, McLaren, and Phillips Auto Dealerships along Mariners Mile. According to AutoNation Officials, Porsche Headquarters in Germany dictated the complete de- sign and street appearance of the structure. AutoNation stated, at the September 21, 2016 meet- ing at Balboa Bay Club, that it had no choice and must comply with Porsche. Simply put, an In- ternational Company and a Nationwide Company are telling the City of Newport Beach and the residential communities of Newport Heights and Bayshores what to do. They disregard communi- ty design criteria and standards, such as the dictum that Mariners Mile buildings are to have a nautical appearance. The AutoNation Project proposes a massive commercial industrial development that is incompati- ble with the intent of the Mariners Mile Master Plan and undermines the reasons residents have chosen to live in the Bayshores and Newport Heights communities. Further, the proposed 500+ foot long structure spanning 11 lots along West Coast Highway is overwhelming and far too mas- sive for the physical dimensions and limitations of the site. If the height of the structure is mea- sured from the curb level along West Coast Highway to the highest point of the structure, the height exceeds 50 feet. To achieve a clearer community understanding of the length, hight and depth of the proposed buildings, I request the Planning Commission require AutoNation Porsche to online the structure with Story Poles. This proposed use of the land will have significant negative impacts (design, hours of operation, noise, traffic congestion, safety, light and reflection, elevation, water consumption) on the daily lives of the families living in the two adjacent residential neighborhoods of Newport Heights to the North atop the bluff and Bayshores South across West Coast Highway. There are few, if any, characteristics of the proposed use of the site that enhances the neighborhoods, the quality of life, and the property values of the residents living in these communities. 12-14 September 22, 2016 Page 2 Previously, on August 18, 2016, during the Planning Commission Hearing, I expressed the follow- ing observations: • The City of Newport Beach is becoming too industrialized. This proposed project is incompatible with the surrounding communities and inconsistent with other buildings along this section of West Coast Highway. • The project includes a Porsche Service Center while most of the other Auto Dealerships along PCH are limited to showrooms with their Service Centers located near the John Wayne Airport. • The proposed building is too massive for the site and should be limited to a single story. • The City of Newport Beach is requiring AutoNation to widen PCH to three lanes on the North bound side. A third lane will increase the speed of vehicles along this corridor and present safe- ty issues. Also, the proposed construction project is occurring shortly after the completion of the lengthy storm drain project, which has caused considerable vibrations felt by those living near- by, as well as congestion, noise and filth. When will the City say an enough is enough for these neighborhoods? • Should there by construction in this vicinity, the city should require that the power lines behind the proposed buildings be underground. When the Mariners' Point Building at the corner of Dover and PCH was under construction, the power lines were put underground. The Newport Beach City Council must not allow the AutoNation Porsche proposed development or any development of this size to be built along Mariners' Mile until the Mariners' Mile Revitaliza- tion Master Plan is finalized, and finalization should not occur until after the Planning Commission Public Workshops involving all stakeholders have been held. Moreover, the finalized plan should include criteria and design standards. Further, the Initial Mitigated Negative Declaration Study dated July 8, 2016, falls short of fulfilling the city's lead agency responsibility to assure no harm as required by the California Environmental Quality Act (CEQA). Accordingly, the more complete and thorough Environmental Impact Report (EIR) must be required. It is important to understand that community involvement regarding this development project in unusually high and clearly demonstrates the great interest and concerns of homeowners living in the immediate vicinity. We trust that the city's planning process will work to the benefit of all. In view of the above, the City Council should decide this project. Only the City Council elected by and accountable to the Citizens of Newport Beach should make the final decision. The Planning Commission's role should be limited to a review and a recommendation. Although I know the property owner for this project and developers on other projects approved and denied recently, I am alarmed at the pattern, or more importantly, the lack of pattern in recent decisions by the City about future development. Of all the proposed new developments being considered today, approval of the Porsche dealership should seem easy. The project doesn't require a general plan amendment, it's not a new use for the area, there are already two or three other dealerships there, and it's an economically proven long term use. An auto dealership is likely to have less traffic and other impacts than restaurants, offices, or retail; uses recently approved for other sites along Mariner's Mile, including a large project at Dover and Coast Highway. Is there anyone who believes the existing old one and two story stores represents the best use of the property? I spent three years on a committee of dedicated citizens involved with the update of the General Plan in the early 2000's. Committee members in most cases put aside their own interests to achieve a plan that would incorporate a "vision" for the entire community, protect individual property owner's rights, and preserve the character of the City. I don't recall the Vision then, or ever, allowing transforming the nature of Fashion Island, nearly instantaneously, from a world class commercial center to a massive residential city by adding 550 identical looking apartments, and another proposed 100 units to replace land whose value for office and job oriented development IN THAT LOCATION is irreplaceable to the City. Are all low rise offices in Fashion Island destined to become housing? The plan and the vision for the community disappears or gets chiseled away every election or decision affecting development. Other than the importance of balancing individual property rights with planning and sticking to a vision, another takeaway from being on the commission was the impact of these decisions on the fiscal health of the city. It was an eye popping experience to review the City budget at that time. Surprisingly, hotel tax and even all the retail sales at Fashion Island were not significant revenue generators to the City. But, auto sales tax from car dealerships in the City appeared to dwarf all other revenue sources by comparison. Complaints about the project: noise, traffic, etc. have been addressed and others don't appear to be supported by facts. Would a more intensive commercial use of restaurants, offices, and retail be more acceptable to these opponents? Be less of an impact? Provide more revenue to the City? 12-18 Robert Hendrickson Page 2 Auto Nation is the largest car dealership in the nation, and the Porsche Dealership has been in the City for years. The development will be a great long term revenue generator for the City. Do we (collectively as a community) want them to go away? As a 30 -year resident, I don't want to lose them or their revenue stream to the City. I'd like to see future land use decisions made with a long term perspective, consider the financial, economical, and social health of the City, and be consistent with the community's "Vision". Approving the Auto Nation project fits this criteria. Hope other land use decisions will too. A citizen group has been circulating arguments and petitions against the relocation. Unfortunately there is much misinformation in their solicitations. I have included an email I recently received at the end of this email and wish to address some of their concerns.. I have been a home owner in the Bayshores community for 41 years and live only a few blocks from the proposed relocation site. In addition, I am a licensed Orange County luxury car dealer. Thirteen years ago we moved our service center to a property very similar to the proposed Autonation location. Our property is long and narrow between a busy street and residences and apartments. I wish to share my experience with the council. Mariners Mile has been a traditional location for Newport Beach Auto dealerships for as long as I can remember, and that goes back to the 1950's. Today current dealerships on Mariners mile are BMW, Ferrari, Maserati, McLaren plus several high line used car dealerships. The proposed location is in keeping with the historic location of Newport's car dealerships. There is an existing multi story building, with elevators next to the east end of the proposed site. So the proposed size and height of the building is compatible with the existing multi story building. Modern new car dealerships are not noisy nor do they create pollution. Quite the opposite is true. New car dealerships are tightly controlled by the California Air Resources board, The California New Motor Vehicle board, the California Department 12-23 of motor vehicles. For example, every drop of rain water that falls on my property must go through a clarifier before it flows into the flood control channels. All toxic items must be properly stored and disposed of in the manner prescribed by law. New car dealerships are a multi million dollar investment and are subject to audits and reviews by all governmental agencies. With modern technology and buildings I would venture to say that a new Porsche dealership would produce less pollution than the existing older, smaller businesses that now occupy the site. The visual impact from roof top parking can be mitigated with car ports, roof top landscaping or solar panels. And parking lots are generally very quite. My service center is located on a long narrow strip of land between a busy commercial street and private residences and apartments. I believe we actually reduced noise to the residences by having the building block highway noise. In our 13 years at this location we have never had a noise complaint or a toxic spill or pollution of any kind. I modern new car dealership is not any nosier then a super market or shopping center. Our service centers are clean, high tech facilities and I would invite council members to call me for a tour of our facility or tour any of the new dealerships in Newport Beach. I doubt the traffic from the proposed dealership would be any greater then the traffic flow from the existing businesses at proposed location. The McDonalds restaurant at the west end of the proposed site will have a much higher traffic count then the car dealership. Moving a dealership location is a very difficult process and often takes years to find and negotiate a suitable location. Plus we have to deal with state licensing laws and the manufactures requirements. I doubt if there is any other property that would qualify in the city of Newport Beach as a relocation site for Autonation Porsche. The city receives a large part of the sales tax revenues generated by the sale of new cars and service plus the dealership provides high paying jobs for the community. So letting the dealership expand is to the benefit of everyone in the city. One negative comment that I do have is the architectural rendering shows a modern all glass building. I worry that the glare from the mirrored glass would cause problems for traffic on PCH. I think the design style should be changed to better fit into the location. Although there are some challenges to the project I think overall that a practical, efficient, beautiful building can be built at the proposed location that would benefit the city and the neighborhood. The AutoNation Porsche development would not serve local residents well. It is an inappropriate project for this spot and we urge the City Council to deny the application and insist that this corridor between two residential neighborhoods be developed thoughtfully with an emphasis on maintaining the local Newport flavor. I am certain that the City views these improvements both exciting for visitors, locals, pedestrians and bicycle enthusiasts. With the onslaught of these projects there remains a need for smart and thoughtful planning that would maintain a safe and harmonious transportation corridor. The City of Newport must be sensitive to approximately 1,725 residential homes with three major schools that are located directly above and/or adjacent to Pacific Coast Highway. These communities include Bayshores, Cliff Haven and Newport Heights. At both of the Planning Commission Meetings, the Commissioners, except Mr. Kramer, agreed that this project did not fit the Maritime Nautical theme and it was simply too massive of project for 1.6 acre area. They recommended that the service areas be relocated by the airport where many local dealerships conduct their services. It has been documented and very apparent that Autonation has not been a good neighbor to our surrounding communities. It is to my understanding that Mr. Jim Campbell has been diligently trying to address these serious violations with the applicant. Recently, driving from San Clemente, Dana Point, Laguna Beach, Corona Del Mar and Huntington Beach, I noted that all of these transportation corridors in these Coastal Downtown Cties are two lanes in each direction. Increasing the lanes on Pacific Coast Highway increases speed. Porsche Autonation's test drives are from Bayside to Brookhurst in Huntington Beach and back. These test drives exceed the legal speed limits and decibel levels. As you may know, Avon Village is planning to be 50% residential and 50% commercial. We simply can not have a race track going through a pedestrian scramble, retail and luxury town homes as was presented by the consultant Placeworks at the recent Mariners' Mile Community Workshop. In closing, this project is in direct conflict with adopted policies, plans, or programs regarding public transit, bicycle, or pedestrian facilities, that would otherwise decrease the performance or safety of surrounding developments. The proposed Porsche Autonation as currently planned will have a significant negative impact to the Mariners' Mile Vision. The added cost to build new curbs, gutters, sidewalks, paving, relocation of street lights and underground utilities would add several hundred thousand dollars to the cost of the development but the owner and the dealership again consented to these new requirements. At a second hearing the Planning Commission rejected the development entirely. If the City Council turns this project down the future costs to widen the 500 feet of frontage will no doubt be higher than today and the City will bear the cost of the Highway improvements. Plus the City will have to pay the owner rather than have it deeded for free. The land is fairly shallow and by taking fifteen feet of its depth it will reduce the potential develop potential. When the City files its eminent domain lawsuit to acquire the frontage for widening, all of the existing buildings must be destroyed. The damages incurred will be substantial. By approving the project as agreed by Porsche, the City will obtain the needed land for widening, have the roadway constructed at no cost to the City and be relieved of future litigation for damages to the remaining land. If the dealership chose to move to Costa Mesa or Irvine there would be a tremendous loss of sales tax to the City. These are all reasons why we are very supportive of the new dealership opening at 600 West Coast Hwy on Mariner's Mile. Funny story several years back. Our neighbors complained on occasion about two loud porsches (maybe) going too fast down Bayside. They blamed the dealership, then later found out it was my neighbor and I acting like kids. The most embarrassing part was that it was discovered at our annual association meeting in front of everyone(whoops).
