TITLE: Newport Theater Arts Center Building Improvements — Notice of
Completion of Contract No. 7022-2 (Project No. 15F02)
ABSTRACT:
On June 28, 2016, City Council awarded Contract No. 7022-2 for the Newport Theater Arts
Center Building Improvements project to Optima RPN (Optima) of Irvine, California. The
total contract award was $188,851.00 plus $29,000.00 allowance for contingencies. The
required work is now complete and staff requests City Council acceptance and close out of
the contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for
the project (This project was found exempt from the California Environmental Quality Act
(CEQA) pursuant to Sections 15301(a));
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of the
Civil Code; and
c) Release Faithful Performance Bond one year after acceptance by the City Council.

Contract No. 7022-2, Newport Theater Arts Center Building has now been completed to the
satisfaction of the Public Works Department. A summary of this contract's construction cost
is as follows:
Original bid amount: $188,851.00
Actual Cost of Bid Items Constructed: $179,747.00
Total Change Orders: $ 12,202.00
Final contract cost: $191,949.00
The final cost of bid items constructed was $179,747.00, which was $9,104 less than the
original bid amount. During construction, after removal on the existing roofing material, field
inspection determined that more roof sheathing remained in suitable condition then
originally anticipated resulting in the bulk of this bid item savings.
Also during construction two change orders were issued totaling $12,202.00, which was
approximately 6.5 percent of the original contract amount and within the contingency
allowance. The first change order was issued that provided for replacement of two
additional structural beams. A second change order was issued to provide 15 additional
working days beyond the original contract time to allow the contractor to address a building
code requirement that 20% of the contract cost be used for Americans with Disabilities Act
(ADA) related improvements. This ADA effort was included in the Bid item allowance,
however the change order was needed to define the work effort and provide the necessary
time to complete the work to provide greater accessibility to the Newport Theater Arts
Center. Final ADA improvements included restriping ADA parking stalls, upgrading stair
access, and instating a dual height drinking fountain.

ENVIRONMENTAL REVIEW:
The Newport Theater Arts Center Building Improvement project was found exempt from the
California Environmental Quality Act (CEQA) pursuant to Section 15301 (Existing Facilities).
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the
meeting at which the City Council considers the item).
