Makana Nova:
I had planned to attend the City Council hearing on this issue when it was scheduled for today, November 22,
but I see that it has been moved to the agenda of November 29. Unfortunately, I am unable to attend the 29th to
provide comments during the hearing. Therefore, I hope staff and Council can accept my comments by this
email.
I have lived in the City for 13 years and have not attended a single Council hearing. And I would not have
weighed in on this development, except I received a mailer at my home which alarmed me. It showed a tower
completely out of scale with Fashion Island. So I actually took the time to look up the proposed building on the
internet, and found that the mailer dramatically exaggerated the look of the proposed building. Have you seen
that mailer? I find it offensive that the project opponents would change the look of the building in such a
misleading way. In fact, I see the project is about the same height as some of the other tall buildings ringing
Fashion Island.
I cannot see a reason why I would not oppose this project. I sometimes stay at a resort in Puerto Vallarta built
by the same developer called The Icon, and it is absolutely first class. So I believe it will be a high quality
product. It is the kind of place that my wife and I (and I expect many of my Port Street neighbors) might
consider downsizing to after our kids move out, so I like that it adds to the diversity of high quality housing in
our fine City. Finally, I am not worried that it will set a precedent of urban density for Newport Beach, as I
have read that we have some sort of housing caps that are almost reached. Let me be clear - if this was the first
of ten such projects, I would oppose each one. But one or two of these projects around Fashion Island do not
alarm me.
For these reasons, I would count myself as a supporter of the project.

Dear Council Members,
As a 13 -year, voting resident of Newport Beach, I am very much against the construction of The Museum
House high-rise tower.
I have lived in various cities across our country and the world, including New York city and Hong Kong, so I
am very familiar with high-rise buildings and their impact. They have their suitable place. Newport Beach is not
one of those places.
I chose to live in our beautiful city partly because of the more serene atmosphere and the feeling that we are not
a metropolis.
To believe that the impact of this building will not lead to over -crowding and congestion is to bury one's head in
the sand. And that's not even considering the impact of so many new residents on our water consumption. Did
everyone forget we are still in a major drought? There's more to life than just profit. There is quality of life.
This is the first time I have ever put pen to paper against any item coming up before the City Council.
I strongly oppose this project and hope you will consider the voice of your residents and constituents when
casting your vote.

Please vote in favor of Museum House. I have attended several presentations and the project warrants your support. Done by a
major internationally known architect, its style reflects the best of Newport Beach.
I've listened to many of the critics and find while passionate, their comments reflect not a vision for the future but rather an
attitude that " ..I'm here and no one else should come or matter...".
The conclusion of the indiependent studies released indicate there would be absolute minimal increase in traffic, noise, or
fire/police challenge. Robert Stern has given thought and reflection as to the style of living many now want here in the City.
Please vote in favor of Museum House.

RE: MUSEUM HOUSE RESIDENTIAL PROJECT (PA2015-152)
Dear Mayor Dixon and Members of the City Council:
SPON and LITS (Line in the Sand PAC) partnered to circulate a petition to Newport Beach voters. To date
nearly 1,625 signatures have been gathered supporting the request for a NO Vote by the City Council for
the proposed Museum House Condo Tower project, for the reasons noted below:
• The proposed 25 -story, 295 feet high, 100 -unit residential condominium tower is
completely incompatible with surrounding development
• It requires a major amendment to the General Plan to add development WITHOUT a public
vote.
• The Museum House Condo Tower takes away one of the few cultural facilities we have been
able to maintain for the City and which are part of the City's General Plan.
• Granting approvals of these amendments sets a precedent for changing, rather than
respecting the City's governing land use plans set in place by the voter -approved 2006
General Plan.
The voter -approved 2006 General Plan laid out a rational blueprint for the development of Newport
Center. All of the development allowed under the 2006 General Plan has been built. This project
inappropriately uses spot zoning and makes an end run around a zoning process that puts limits on size
and bulk.
The Museum House Tower project requires planning commissioners and council members, who are tasked
to enforce our voter -approved General Plan, to authorize a major General Plan Amendment for this
project to proceed.
Our city has reached the tipping point with regard to massive developments such as this project. Your vote
determines whether Newport Beach looks like Laguna Beach or like Los Angeles.

Newport Beach Residents' Petition: VOTE NO on
the 25 -story Museum House Residential Tower
project!
Dear Newport Beach Planning Commission and City Council:
Please vote to deny the project proposed at the current location of the Orange County Museum of Art, a 2 -acre site located at 850
San Clemente Drive.
Here's why.
• IT'S OUT OF PLACE.
The proposed 25 -story, 295 feet high, 100 -unit residential condominium tower is completely incompatible with surrounding
development and will stick out like a sore thumb.
• IT'S TOO TALL.
No other development in San Joaquin Plaza is even close to the proposed building height.
• IT'S NOT COMPLIANT.
The high rise height of 300 feet applies only to nonresidential development. Therefore, the proposed residential project is not
eligible for the high rise height limit.
• IT'S NOT ALLOWED.
Residential use of the site is not currently permitted and requires approval of an amendment to the General Plan, a zoning change
and a Greenlight vote.
• IT SETS A BAD PRECEDENT.
Granting approvals of these amendments sets a precedent for changing, rather than respecting the City's governing land use plans
set in place by the voter -approved 2006 General Plan.

Dear Newport Beach Planning Commission and City Council:
Please vote to deny the project proposed at the current location of the Orange County Museum of Art, a 2 -acre site located at 850
San Clemente Drive.
Here's why.
• IT'S OUT OF PLACE.
The proposed 25 -story, 295 feet high, 100 -unit residential condominium tower is completely incompatible with surrounding
development and will stick out like a sore thumb.
• IT'S TOO TALL.
No other development in San Joaquin Plaza is even close to the proposed building height.
• IT'S NOT COMPLIANT.
The high rise height of 300 feet applies only to nonresidential development. Therefore, the proposed residential project is not
eligible for the high rise height limit.
• IT'S NOT ALLOWED.
Residential use of the site is not currently permitted and requires approval of an amendment to the General Plan, a zoning change
and a Greenlight vote.
• IT SETS A BAD PRECEDENT.
Granting approvals of these amendments sets a precedent for changing, rather than respecting the City's governing land use plans
set in place by the voter -approved 2006 General Plan.

has occurred but with a valid reason to substantiate its approval -
that is something for the residents which offsets its negative
impacts and offsets that fact that it takes away something like
open space or another facility. The Museum house takes away
one of the few cultural facilities we have been able to maintain for
the City and which are part of the City's General Planning. It
changes the face of Newport for residents in many ways and
offers nothing in return. It should be denied. If the development
fees are what is driving its approval then it should definitely be
put to a vote - where there could be a city-wide discussion about

cultural asset to the community. When the land was designated
as PI, there was clearly an intent to make the museum a local

No more added traffic on Jamboree, PCH, and MacArthur. No to
using an additional 50,000 gallons of precious water for the
development while the residents are fined for going past what the
City has rationed for them. The voters approved the property in
the 2006 General Plan to be "institutional," so keep it that way.
We should not have to sacrifice our water and quality of life so
that the Art Museum can move. Most non-profits have fund-
raisers to benefit their needs, not force the residents be the
benefactors. What if we don't even like the kind of art displayed
at the museum?

1 have lived in Corona del Mar and Newport Beach for 33 years.
During that time, I have seen open spaces taken over by
multimillion dollar homes. The City hall built so that you can no
longer see the Pavillion on Lido as you come down Mac Arthur
Blvd after a long day at work. No one expects that traffic will
remain as it was in the 80's, but I do not want to see us become
like Los Angeles which is one big traffic jam. Our homes should
be where we get away from the stressful city life, that is why a lot
of us moved to this area to enjoy outdoor living and rest our eyes
from the endless views of concrete and buildings that impede our
view of the sunrise or sunset. Leave something of beauty for the
coming generations to enjoy.

High Density residential builds like the Museum House degrades
the quality of life for existing residents. Also, this project is
starting before we realize the traffic and congestion that the
apartments on the corner of San Joaquin and Jamboree are

This is not downtown LA, it's Newport Beach. Those of us who

crowded with tons of buildings and people. We want to live in a

Unfortunately the Irvine Co controls the Newport Beach planning
& building dept.
Money Talks and TIC "Donald Bren" has plenty to pay for what
project they want to develop. TIC will not stop until every square
mile is built out. The standing joke is Don Bren states certain
areas will be open space & preserved... but only until Bren wants
more money!!! Then the open space is No Longer important only
another source of money.
The impact with all the dense building to the streets, freeways,
and community is detrimental.

Our leaders are failing us. The PIMCO tower, the new Irvine
Company tower, the apartments, the old City Hall site, the new
Lido Village etc etc. It is time to hold to account the City Council
and demand that they preserve and maintain the quality of life of
all residents, not just enrich developers.

gentleman on the Museum Board is also the exec at the

residential / commercial area in Newport Beach, Costa Mesa and
surrounding areas are being built on. Tall, cramped , high
density, ugly style condos and apartments are multiplying like
rabbits. All surface streets are now into gridlock let alone the

The resources available to us during this time of water
restrictions and traffic congestion should temper the desire of
developers looking to build in Newport Beach. Our City
commissions and council are well aware of the unbridled
proliferation of oversized residential and commercial
developments that have plagued us and continue to be a blight
on our fair city, swallowing precious resources and adding to
already congested traffic.
Let cooler heads prevail and put the brakes on McMansions and
out-of-proportion towers built to house many more people than
we can rationally supply water or roads to during this time of
such limited resources. I am continually surprised the City of
Newport Beach even contemplates considering large projects
that will use tremendous amounts of these limited resources as
well as destroying the character of surrounding areas and
neighborhoods.
I suggest we preserve what is left of Newport Beach by thinking
smaller, not larger.

replacements on Jamboree Blvd. This will affect traffic going to
CDM HS as well work traffic towards the 73 Fway. It may take

The Villas at Fashion Island destroyed the historic feel of fashion

condominium tower is completely incompatible with surrounding
development and will stick out like a sore thumb. • IT'S TOO
TALL. No other development in San Joaquin Plaza is even close
to the proposed building height. • IT'S NOT COMPLIANT. The
high rise height of 300 feet applies only to nonresidential
development. Therefore, the proposed residential project is not
eligible for the high rise height limit. • IT'S NOT ALLOWED.

1 am very tired of developers asking to rezone areas. The
residents of Newport Beach voted approval of the General Plan.
Why should a developer's interests be more important that those
of the residents? I sincerely doubt that people who would live in
these extremely expense condos would be walking to the shops
and restaurants in Fashion Island. The proposed Museum
Tower is totally out of keeping with this area, and there is already
sufficient housing for those who want to live in Newport Center. I

It's too tall, especially so close to flight path where we also get
very dense fog (next to bay and golf course). Also, will be 2-4
stories higher than stated when driving by on Jamboree (like the
new apartments at San Joaquin). If anything put on the other
side of Newport Center & change flight path to other side of bay.
Also effects our privacy when its taller than current residential
zoning, especially since we all have skylights and large windows
that were zoned & bought to NOT have any buildings towering
over our backyards & in our own home.
Traffic has not even taken effect yet from 1,000 + cars from new
apartments, let alone the hundreds of new residences being built
on Jamboree near MacArthur and Campus Drive.
This is not New York. Please don't set a bad precedent. The
voters of this city WILL remember as it's permanent, and we'll
see it EVERYDAY.

As a resident of the neighbor city, Huntington Beach, and
someone who works in Fashion Island, our traffic and freeway
situation is already impossible in Orange County. We must stop
high density housing in Orange County because our highways
and infrastructure cannot handle it.
This proposed building will block over 20% of my current view of
the ocean. It will seriously impact the value of my property.
Please give some consideration to this major negative impact of

present and future residents, what are doing is continuing to
break the trust we placed in them to represent all of our interests
- not just wealthy real estate developers and not abrogate the
spirit of Greenlight and subsequent efforts to slow development.
In face the opposite is occurring and while it is true the new
PIMCO building, new Newport Center Drive tower, new San
Joaquin/Jamboree apartment blocks, new city hall, new hotel at
old city hall site, new retail/residential buildings on 19/20th
Balboa Blvd, new Lido Village, and the new City Hall are just
some of the major projects underway they do enhance the city.
However, we have reached a tipping point. The quality of life that
supports property values and sustains Newport is under duress,
and not only us there plenty of redevelopment and building
occurring in Newport the new retail. residential and commercial in
our surrounding areas such as University Research Park,
Jamboree corridor, Newport Coast etc etc Or even the Spectrum
Aliso Viejo, Eastside Costa Mesa - all together these areas crush
in on Newport as a work and entertainment destination.
There is a line where the freedom of the real estate developer
ends and our rights as homeowners and residents begins - and
our elected officials were supposed to guard that barrier in
accordance with our expressed wishes - and they are derelict of
duty and they should be ashamed.

cars a day, which was very unwanted in the community. I object
to the new project due to perceived congestion. The best
museum is called Nelson Akins Museum in Kansas City, MO. It
would be worth a look as to how much was put underground. It
may be on 4 or 5 stories and I am sure much more land than the
museum seems to require.

As noted in the Museum House staff report, on November 17, 2016, the Airport
Land Use Commission (ALUC) reviewed the proposed project and found it
consistent with the Airport Environs Land Use Plan upon receipt of
documentation from the Federal Aviation Administration (FAA) that confirms the
FAA Aeronautical Study considered heliports as part of their Determination of No
Hazard for the proposed project. The ALUC determination has been attached.
Today, the City received an additional correspondence dated November 29,
2016 from Kari A. Rigoni, ALUC Executive Officer. Ms. Rigoni states in this
correspondence that ALUC staff has received adequate documentation to
conclude that the intent of the condition for the Museum House Project has been
met for determining the project's consistency with the Airport Land Use Environs
Plan. Please see the attached correspondence.

Dear Mayor Dixon & Council Members.
Tonight, you will be reviewing the Planning Commission's approval of the Museum
House project. I believe that a high-quality, architecturally significant, and minimally
impactful project with tremendous public benefits like Museum House will be an
enormous positive for Newport Beach.
Robert A.M. Stern is one of the world's most celebrated architects. It is a distinct honor
for Newport Beach that his classic and world-class design will be housed in Fashion
Island.
Museum House will generate close to $22 million in confirmed public benefits and more
than $18 million in additional taxes over the next 30 years. These needed dollars will
significantly lighten the tax burden on all residents and businesses.
This is not an impactful project and complies with our strict Greenlight standards. After
rigorous independent studies, it has been detemined that Museum House will generate
minimal traffic impacts, is consistent with Newport Beach general plan policies on height
and mass, and helps with existing water conservation efforts.
It is for all these reasons that the I strongly endorses Museum House. I urge the City
Council to join me and vote Yes on Museum House.
