Brown, City Clerk TITLE: Mayor Appointment to the Orange County Sanitation District ABSTRACT: Mayor Kevin Muldoon would like to appoint Council Member Brad Avery as the City of Newport Beach's (City) alternate member to the Orange County Sanitation District (OCSD). RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Confirm Mayor Kevin Muldoon's appointment of Council Member Brad Avery as the alternate member to the OCSD. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: On January 10, 2017, the City Council confirmed Mayor Muldoon's appointments to serve on various City Council Committees, City Council/Citizens Committees, Citizens Advisory Committees, and Joint Governmental Committees, pursuant to City Council Policy A-9 (City Council Committees). Mayor Muldoon is unable to serve as the OCSD's alternate member and requests that the City Council confirm his appointment of Council Member Avery to take his place. This appointment may receive compensation and was reported on FPPC Form 806 (Agency Report of Public Official Appointments) per FPPC Regulation 18702.5(b)(3). Mayor Appointment to the OCSDMayor Appointment to the Orange County Sanitation District February 14, 2017 Page 2 ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENTS: 1►= 18-2
