Brown, City Clerk TITLE: Water Quality/Coastal Tidelands Committee Appointments ABSTRACT: On November 27, 2012, the City Council adopted Resolution No. 2012-115 which established the Water Quality/Coastal Tidelands Committee. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; b) Confirm Mayor Kevin Muldoon's appointment of Council Member Brad Avery as the Chair of the Water Quality/Coastal Tidelands Committee; c) Waive the portion of Council Policy A-2 (Board, Commission and Committee Appointments) which requires two or more applications for each vacant seat; and d) Reappoint Carl Cassidy to the Water Quality/Coastal Tidelands Committee. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: The purpose of the Water Quality/Coastal Tidelands Committee is to improve and preserve the Newport Beach coastline and Newport Bay as a resource for recreational use and as healthy habitats. The Committee is comprised of seven members appointed by the City Council and two non-voting Council Members appointed by the Mayor, subject to confirmation by the City Council. The Mayor also appoints one of the two non-voting Council Members as the Chair and Vice Chair of the Committee. Appointments to the Water Quality/Coastal Tidelands Committee February 28, 2017February 28, 2017 Page 2 On January 10, 2017, the City Council confirmed Mayor Muldoon's appointments to serve on various City Council Committees, City Council/Citizens Committees, Citizens Advisory Committees, and Joint Governmental Committees, pursuant to City Council Policy A-9 (City Council Committees). At this meeting, he appointed Council Member Diane Dixon as the Chair and Council Member Jeff Herdman as the Vice Chair. Following her appointment, Council Member Diane Dixon asked Mayor Muldoon to allow her to remove herself from the Committee due to a scheduling conflict. Mayor Muldoon is requesting the City Council confirm his appointment of Council Member Brad Avery to serve as the Chair, replacing Council Member Diane Dixon, on the Water Quality/Coastal Tidelands Committee. On February 14, 2017, the City Council confirmed the reappointments of Dennis Baker, Louis Denger, Fred Galluccio, Lawrence Houston, and George Robertson, and appointment of Erin Delman to the Water Quality/Coastal Tidelands Committee; and directed the City Clerk to re -advertise for the last vacant seat. The City Clerk published the Notice of Vacancy in the Daily Pilot on Saturday, February 18, 2017; and on Wednesday, February 15, 2017, posted the Notice of Vacancy in the City Clerk's Office and the City Hall bulletin board, and placed the Notice of Vacancy on the City's webpage. Only one application was received to fill the vacant seat (Attachment A). Staff is recommending that the City Council waive the portion of Council Policy A-2 (Board, Commission and Committee Appointments) which requires two or more applications for each vacant seat. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
