TITLE: Revised Bus Parking Rates for Zone 29, the Balboa Pier Parking
Lot
ABSTRACT:
The off-street parking rates were revised in 2015 with the adoption of Resolution 2015-
56. The rates for bus parking, however, remained unchanged and are charged at a daily,
rather than hourly, rate. Resolution 2017-24, if approved, would change the bus parking
rates for the Balboa Pier parking lot from a daily fee to an hourly fee and charge different
rates for buses used for transporting students and those used for commercial purposes.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Adopt Resolution No. 2017- 24, A Resolution of the City Council of the City of Newport
Beach, California, Establishing a Revised Schedule of Rates for Users of Buses that
Park in Off -Street Parking Meter Zone 29, Commonly Known as the Balboa Pier
Parking Lot.
FUNDING REQUIREMENTS:
There are no funding requirements associated with this recommendation. Revenues
generated by bus parking in the Balboa Pier parking lot currently represent less than .01 %
of the total revenue generated in the parking lot. Many buses use the spaces for loading
and unloading only, and leave without paying the daily parking rate. City records indicate
that 83 buses paid to park in the Balboa Pier parking lot in 2016 and 92 buses paid to
park there in 2015. If an hourly rate is offered, bus operators may be more likely to park
their vehicles and pay the fee.

DISCUSSION:
A representative of Discovery Cube's Ocean Quest (formerly known as ExplorOcean)
recently relayed to City staff the organization's concerns about the rates charged for bus
parking in the Balboa Pier parking lot. Ocean Quest offers educational programs for
school children and estimates that 100 to 150 school buses carry students to and from
the facility each year. The educational programs last two to four hours, however, the fee
for bus parking in the Balboa Pier lot is currently a flat, daily rate. The 2017 rates become
effective effect May 1 and provide that buses with 10-24 passengers pay a $55 flat rate
per day and buses with 25 or more passengers pay a $110 flat rate per day. With many
schools operating on tight budgets, Ocean Quest contacted the City for help in identifying
less expensive places for the buses to park for the few hours that the students participate
in its programs.
City staff considered alternative locations, but ultimately determined that parking buses
in the Balboa Pier lot is the preferred option as it helps keep sections of on -street parking
open to other motorists and helps contain the number of bus trips to and from Balboa
Village. Staff also reviewed the parking fees, revenues and counts for commercial users
of buses and school users of buses in Zone 29 and found these revenues and counts
were low in comparison those generated by automobiles and motorcycles in the Balboa
Pier parking lot. Therefore, staff is recommending revising the bus parking fee rate
structure and levels to incentivize bus drivers, and groups retaining bus services, to utilize
the Balboa Pier lot.
There are two components to the recommendation. The first involves changing the
parking rate structure for all buses utilizing the Balboa Pier parking lot from a flat, daily
rate to an hourly rate. This change would align the bus parking rate structure with the
hourly fee charged for automobile and motorcycle parking. It would also reduce parking
costs for groups only in the area for a portion of the day.
The second component of the recommendation involves charging different parking rates
for buses used by school users and commercial users. Staff is recommending that school
users pay 50 percent of the commercial user rate. The rationale is that reducing parking
costs for school visitors could help to alleviate some of the funding challenges related to
student field trips and potentially increase the number of school groups that visit the area.
Parking fees for the Balboa Pier parking lot are scheduled to increase on May 1, 2017.
The proposed bus fee schedule reflects the 2017 rates.

It should be noted that the California Coastal Commission (Commission) granted Coastal
Development Permit No. 5-13-0506 (CDP) to the City in January 2014. The CDP pertains
to the parking equipment and rates in the Balboa Pier parking lot. It was granted subject
to certain conditions, including the condition that any change to the parking rates would
require review by the Commission's executive director. On March 31, 2017, staff notified
the Commission of the recommendations contained in this staff report and requested its
executive director review the changes.
Should Council approve Resolution 2017-24, the revised bus parking rates will be
implemented after Coastal Commission review.

RESOLUTION NO. 2017-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, ESTABLISHING A
REVISED SCHEDULE OF RATES FOR USERS OF
BUSES THAT PARK IN OFF-STREET PARKING METER
ZONE 29, COMMONLY KNOWN AS THE BALBOA PIER
PARKING LOT
WHEREAS, California Vehicle Code Sections 32 and 22508 as well as Newport
Beach Municipal Code ("NBMC") Section 12.44.030 authorize the City Council of the City
of Newport Beach ("City Council") to establish off-street parking meter zones by
resolution;
WHEREAS, the City Council adopted Resolution No. 2013-33 that established, in
part, off-street parking meter Zone 29 ("Zone 29"), commonly known as the Balboa Pier
Parking Lot, and established parking meter fees and hours of use for Zone 29;
WHEREAS, the City Council adopted Resolution No. 2014-16 amending
Resolution No. 2013-33 to modify the parking fees to be consistent with Coastal
Development Permit No. 5-13-0506, which generally authorized the installation of
electronic automated payment machines and related signage in Zone 29;
WHEREAS, the City Council adopted Resolution No. 2014-102 establishing a
revised schedule of rates for off-street parking meter zones, including Zone 29;
WHEREAS, the City Council adopted Resolution No. 2015-56 establishing new
fees for the off-street parking zones, including Zone 29 (which, due to scrivener's error,
was erroneously referenced in that resolution as Zone 30 instead of Zone 29);
WHEREAS, the City Council, by adopting this Resolution, desires to establish new
fees for users of buses seeking to park in Zone 29, and set the fees for such users of
buses seeking to park in Zone 29;
WHEREAS, it has been a long-standing goal of the City of Newport Beach ("City")
to improve traffic circulation and parking management in Balboa Village and promote
more efficient use of the available parking spaces in and adjacent to such area, including
Zone 29;
WHEREAS, the City Council finds a revised bus parking fee rate structure will
incentivize the groups, owners, and other users of buses to utilize parking in Zone 29;
and
WHEREAS, California Vehicle Code Section 22508 further authorizes the City
Council to establish fees for parking meter zones and allows fees to be variable based
upon criteria identified by the City.

NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The fees for the parking for commercial users of buses and school
users of buses in Zone 29, as established in Resolution No. 2013-33 and amended by
Resolution No. 2014-16, Resolution No. 2014-102, and Resolution No. 2015-56, are
hereby established as follows:
Section 2: The City Manager is authorized to waive the aforementioned fees
established herein for Zone 29 when a special event of charitable or civic nature is being
held and it is in the best interest of the City and the general public that fees not be charged
for the use of any such parking lot in connection with said special event.
Section 3: The recitals provided in this resolution are true and correct and are
incorporated into the operative part of this resolution.
Section 4: If any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this resolution. The City
Council hereby declares that it would have passed this resolution, and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 5: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
