Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Peter Tauscher, Senior Civil Engineer, ptauscher@newportbeachca.gov PHONE: 949-644-3316 TITLE: Central Avenue Public Dock — Award of Contract No. 8197-1 (17H12) ABSTRACT: Staff has received construction bids for Central Avenue Public Dock project and is requesting City Council approval to award the contract to Associated Pacific Constructors, Inc. RECOMMENDATIONS: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Class 4 Section 15303 Class 3 New Construction or Conversion of Small Structures of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment; b) Approve the project drawings and specifications; c) Award Contract No. 8197-1 to Associated Pacific Constructors, Inc. (APC) for the total bid price of $232,100.00 and authorize the Mayor and City Clerk to execute the contract; and d) Establish $23,900.00, approximately 10 percent, contingency amount to cover the cost of unforeseen work not included in the original contract. FUNDING REQUIREMENTS: The current adopted budget includes sufficient funding for this project. Additionally, on October 26, 2016, the City Council accepted a $350,000 donation from Newport Harbor Yacht Club (NHYC) as a condition of its Coastal Development Permit as mitigation to providing public access elsewhere in the harbor. Therefore, the State DBAW grant and the NHYC donation will fund 100 percent of this project. After the public dock is constructed, remaining funding from the NHYC donation will augment the funding needed for Central Avenue Plaza improvements. The plaza project is in the final planning stage, and staff anticipates construction after the pier project is complete. DISCUSSION: The Central Avenue Public Dock, located adjacent to the Newport Boulevard bridge and near Lido Marina Village, has been recommended by the Harbor Commission as an ideal location for providing public access to and from the water in an underserved part of the harbor. Primary users of this dock are expected to be small dinghies from the anchorage, and other smaller craft who will visit the local businesses. The following summary illustrates a few of the design considerations noted during the bid process: • The proposed dock design was developed to allow the bidder to construct the new dock from a variety of standard material including wood, concrete and even fiberglass. • The 50 -foot gangway length maximizes accessibility to the greatest extent possible. In addition, its diagonal position to the float relative to the seawall also minimizes the extension of the float into the adjacent navigational channel that leads to/from the Newport Boulevard Bridge. • Cleat pattern: There are fourteen cleats spaced four feet apart on the backside of the float for small dinghies. A 20 -foot vessel may dock on either end of the float, and at least three to four smaller 20 -foot vessels may dock on the bayward side of the float. • The bulkhead height will be raised less than one foot to comply with the City's Harbor Standards. • The float is ten feet wide to better accommodate side -tied 20 -foot vessels. 7-2 Central Avenue Public Dock — Award of Contract No. 8197-1 (17H12) April 11, 2017 Page 3 At 10:00 a.m. on March 22, 2017, the City Clerk opened and read the following electronic bids for this project: BIDDER TOTAL BID AMOUNT Low Associated Pacific Constructors, Inc. $232,100.00 2nd Bellingham Marine Industries, Inc. $338,762.00 3rd John S. Meek Company Inc. $377,270.00 The low bidder, Associated Pacific Constructors, Inc. possesses a California State Contractors License Classification "A" as required by the project specifications. A check of the contractor's references indicates satisfactory completion of similar projects for the City of Newport Beach and other public agencies. This proposed project involves constructing an 84 -foot long public dock system, piles, gangway and accessories. Pursuant to the contract documents, the Contractor will have eighty (80) consecutive working days to complete the work. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Class 4 Section 15303 Class 3 New Construction or Conversion of Small Structures of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
