RECOMMENDATIONS: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (Existing facilities) based on the fact the project is a minor alteration of a public facility involving negligible expansion of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, and has no potential to have a significant effect on the environment; b) Approve the project drawings and specifications; c) Award Contract No. 8130-2 to Green Giant Landscape, Inc. (Green Giant) for the total bid price of $531,100.00, and authorize the Mayor and City Clerk to execute the contract; d) Establish $53,900.00, approximately 10 percent, contingency amount to cover the cost of unforeseen work not included in the original contract; and e) Approve Budget Amendment No. 17BA-031 appropriating $303,000.00 from the Contributions (Park Fees) unappropriated fund balance to Account No. 13501- 980000-17P12. 12-1 Bonita Canyon Sports Park Pickleball Courts - Award of Contract No. 8130-2 (Project No. 17P12) April 25, 2017 Page 2 FUNDING REQUIREMENTS: Upon approval of the budget amendment, there is sufficient funding for this project. Park fees are collected by the City from persons or entities who subdivide properties for the purpose of developing or rehabilitating park, open space or recreational facilities as allowed in Council Policy B-1. Volunteers organized matches, conducted regular demonstrations, and offered classes for players to improve their skills. On June 6, 2014, the Park, Beaches, and Recreation (PB&R) Commission approved the San Joaquin Hills tennis courts for temporary pickleball use. The temporary courts were satisfactory for establishing pickleball in the city but it has not been without complications. These include impacted parking for tennis and lawn bowling; the second set of lines on the tennis courts confuse tennis and pickleball players; and the limited usage from 8 a.m. to 12 p.m. (noon). On September 2, 2015, the PB&R Commission approved the conceptual design to construct four permanent pickleball courts at Bonita Canyon Sports Park. A few residents at this meeting had concerns over noise from the courts. Following the meeting staff hired a noise mitigation and management consultant to conduct a sound study. The Study included 16 players on four courts at the Bonita Canyon Sports Park near the location of the proposed courts. The Study findings indicate noise from the proposed pickleball courts are within the City sound limits and largely inaudible to the nearby houses. On December 6, 2016, staff presented this project and noise study results to the PB&R Commission. The PB&R Commission then deliberated the presentation and asked questions of staff and the consultant. The majority of the public comments were favorable of the project and are looking forward to the new pickleball courts. Following the presentation and discussion, the PB&R Commission voted unanimously in support of the Bonita Canyon Sports Park pickleball court project. 12-2 Bonita Canyon Sports Park Pickleball Courts - Award of Contract No. 8130-2 (Project No. 17P12) April 25, 2017 Page 3 At 10 a.m. on April 6, 2017, the City Clerk opened and read the following electronic bids for this project: The bidder, Green Giant Landscape, Inc., possesses a California State Contractors License Classification "A" as required by the project specifications. A check of Green Giant's references indicates satisfactory completion of capital improvement projects for the City and other local municipalities. Green Giant's total bid amount is approximately four percent above the Engineer's Estimate of $510,000.00. The initial project budget was estimated at $400,000 some time ago. Since then, the project has stopped and started several times, including changes in size and location. As part of the last year's CIP process, a budget amendment was planned from the Park Fees account to account for the final product. The project will install 4 pickleball courts using post -tensioned concrete slabs, walkways and site fencing. The work necessary consists of mobilizing; notifying residents; providing erosion control; verifying utility locations; completing site demolition, earthwork, and site grading; constructing drainage improvements, post -tensioned concrete pickleball court, concrete walk, mow curb, seat and retaining walls and court surfacing; furnishing and installing black vinyl chain link fence and gates, windscreen fabric, court posts, nets, trash receptacles, benches, landscaping and irrigation improvements; and all other work described in the contract documents. Pursuant to the contract specifications, the contractor will have 80 working days to complete the work and liquidated damages are set at $1,000.00 per calendar day. Completion is expected in the fall of this year.
