TITLE: Appointments to the Harbor Commission
ABSTRACT:
Two vacancies exist on the Harbor Commission due to Brad Avery being elected to the
Newport Beach City Council and Joe Stapleton being appointed to the Finance
Committee. The City Council is being asked to appoint two candidates from the list of
nominees presented to the City Council at the April 11, 2017 City Council meeting.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
b) Make appointments from nominees Ira Beer, Scott Cunningham, Jamshed Dastur,
John Drayton, Paul Prioleau or Donald Yahn to fill the two vacancies on the Harbor
Commission; and
c) Determine if the term for one of the new Harbor Commissioners should expire on
June 30, 2017 or be extended to June 30, 2021.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
On April 11, 2017, the City Council confirmed the nominations of Ira Beer, Scott
Cunningham, Jamshed Dastur, John Drayton, Paul Prioleau and Donald Yahn for
potential appointment to the Harbor Commission.

Pursuant to City Council Policy A-2, Boards, Commission, and Committee Appointments,
the following is the procedure for voting on appointments to City Boards, Commissions,
and Committees:
A. The City Council will vote on all appointments and seats simultaneously. The
voting will be by paper ballot and the City Clerk will tabulate and announce the
results, including the vote tally.
B. Each member of the City Council will cast two votes for the Harbor Commission,
as indicated on the paper ballot from the list of the nominees. In order to be
appointed, the nominees must receive at least four votes.
The vacant seat formerly held by Council Member Brad Avery is scheduled to expire on
June 30, 2019. Since the vacant seat formerly held by Finance Committee Member Joe
Stapleton is scheduled to expire on June 30, 2017, the City Council has the discretion to
determine whether they want one of the Harbor Commission terms to expire on June 30,
2017 or be extended to June 30, 2021, as permitted by City Council Policy A-2.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING -
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

Most of my life I've held elected positions of service. ASB/Class Presidents, fraternity officer all years at UCLA. Most recently President of
Beacon Bay HOA. I enjoy serving people and giving back to the community. I have a strong track record of execution and success. I am
sunsetting 33 years of semiconductor sales. The past 18 years at Broadcom, where I amassed $3B+ personal sales and many accolades.
My success is built on lifelong personal relationships, combined with long-term vision, and superb negotiation skills. The Harbor is a
beautiful place. I do believe it needs higher focus and can be a better asset to the community. I have the skill set to investigate, promote,
and deliver on programs with high integrity. I have experience dealing with the Coastal Commission, dredging on the bay front,
rebuilding harbor beaches, rebuilding Beacon Bay docks, and working with the Harbor Resources staff. I have owned too many boats.

I have a life -time of experience, nationally and internationally, engineering and building marine terminals, dams, bridges and
other marine structures using cutting edge technology for such iconic projects as (1) The Itaipu Dam in Brazil (2) Post Katrina
flood protection for New Orleans, (3) the third Panama Canal concepts, (4) Major docks for the Ports of L.A. and Long Beach, etc.
Over the long term, Newport Beach faces serious challenges protecting several miles of water -front property from rising ocean
levels. Newport Beach harbor is the life blood of the City. I have retired from gainful employment and have the time, energy and
knowledge to contribute to shaping practical solutions for what may be an existential threat to the welfare of our citizens. The
Harbor Commission would be an ideal venue for me to serve and be of maximum benefit in this endeavor.

I am applying to serve on the Harbor Commission. I grew up sailing, swimming and playing in Newport Harbor, and have a life long
interest in preserving and enhancing this important community access.
While the City has invested recently in improved harbor assets such as the recently opened Marina Park, there continues to be a lot of
work to do. There still needs to be improved waterfront access at many locations throughout the harbor. We still need to look at better
coordination between commercial and recreational users. We should be looking for ways to reduce the footprint of mooring fields. We
should also be evaluating whether the City should expand their direct control over Harbor Dept/Harbor Patrol and related activities. The
City should consider whether to establish a small City -run dredging operation for the harbor. John Drayton, 5/5/16

For the last 26 years, I have been very actively involved in a number of organizations on or around the harbor. I was the Executive
Director for the Newport Aquatic Center in the early 1990's, and have coached junior and collegiate rowing teams for the NAC and
Orange Coast College. I helped found a charitible organization (the Newport Harbor Rowing Foundation) to support young athletes,
and am very involved in the rowing community. Currently, I work for several harbor related businesses as well as my own business as a
yacht captain and manager. I have taught sailing, powerboat, and US Coast Guard licensing classes for OCC since 1991, and am a
reserve captain for their 92' yacht "Nordic Star". I am also a captain for Hornblower Cruises, regularly operating 4 of their dinner cruise
yachts. In addition, I own a 40' sailboat which I keep on a rented mooring in front of the Newport Harbor Yacht Club. I have an active
interest in the future of the harbor, and with my experience in almost all groups that use it (rowers, sailors, mooring users, charter boats,
private owners, etc), I can bring a broad and unique perspective to solving the issues that the commission is facing today.

I AMA 46 YEAR RESIDENT OF NEWPORT BEACH AND HAVE SPENT THE MAJORITY OF THAT TIME ON THE BAY. MY EXPERIENCE ON THE
BAY INCLUDES: SAILING SABOTS AND LASERS AT THE AGE OF 8, TEACHING SAILING AT THE BALBOA ISLAND YACHT CLUB (BIYC) AND
BAHIA CORINTHIAN YACHT CLUB (BCYC). I WORKED ON THE FERRY. I AMA MEMBER OF THE BALBOA YACHT CLUB (BYC), NEWPORT
HARBOR YACHT CLUB (NHYC) AND THE AMERICAN LEGION YACHT CLUB. I OWN A 50' SPORTSFISHER THAT I KEEP ON LITTLE BALBOA
ISLAND. I BELIEVE MY BROAD EXPERIENCE ON THE BAY WILL HELP ME UNDERSTAND THE POINT OF VIEW OF THE RESIDENCES (BOTH ON
