Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Fong Tse, Assistant City Engineer, ftse@newportbeachca.gov PHONE: 949-644-3321 TITLE: Balboa Ocean Pier Pile Repairs - Approval of Additional Work and Contract Contingency - Contract No. 8188-2 (17H03) ABSTRACT: In February, the Balboa Ocean Pier sustained damage to the below -deck timber pile bracings and access system due to heavy winter storms and surf. Staff is requesting City Council's approval to amend the current Ocean Pier maintenance contract with John S. Meek Company, Inc. to include repairing this recent storm damage related work. RECOMMENDATION: a) Find this work exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (Existing Facilities) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment; b) Approve additional storm repair work funding in the amount of $39,865.00 to be added to the original Ocean Pier maintenance contract scope of work, for a new total contract amount of $151,165.00; and c) Approve a new total contingency amount of $15,000.00 (approximately 10%) of the amended total contract scope of work to cover the cost of other unforeseen below -deck work that has not been identified. FUNDING REQUIREMENTS: The current adopted budget includes sufficient funding for these repairs. Meek Company DISCUSSION: Balboa Ocean Pier Piles Repairs- Approval of Additional Work and Contract Contingency - Contract No. 8188-2 May 9, 2017 Page 2 Purpose Construction Contract Construction Contingency Total: Amount $ 151,165.00 $ 15,000.00 $ 166,165.00 Late last year, the City's ocean piers inspection consultant, COWI, reported a number of existing pilings under both the Newport and Balboa Ocean Piers have deteriorated and their repairs were required in advance of the City's normal bi-annual ocean piers maintenance project that is currently scheduled for next fall. After addressing the more urgent damaged piles at Newport Pier under a separate contract last December, staff then prepared the contract documents to make repairs to the Balboa Pier damaged piles as well as install a new pile to replace a piling that broke off in the fall of 2016. On January 12, 2017 at 10 a.m., the City Clerk opened and read the two received bids as follows: BIDDER TOTAL BID AMOUNT Low John S. Meek Company, Inc. $ 111,300.00 2nd Schock Contracting Corporation $ 157,500.00 The low bid amount was essentially the same as the Engineer's Estimate ($120,000). John S. Meek Company, Inc. (Meek) possesses a valid California Contractor General Engineering "A" license as required by the Specifications. They have satisfactorily completed pier repair projects for the City. Per the contracting authority provided by City Council Policy F-14, the City Manager approved John S. Meek's $111,300 base bid plus an $8,700 contingency amount to cover the cost of unforeseen work, for a total contract amount of $120,000, and awarded the contract. While the contract documents were being processed, the Balboa Pier suffered additional significant damage during the February 14t"/15t" winter storms. Specifically, a few of the below -deck timber pile bracings and the under pier access system (stairs, gangways, and catwalks) used by the maintenance crews to inspect and service the utilities systems under Ruby's restaurant was destroyed and lost by the storm surge waves. Being that these support items need to be restored at the earliest opportunity, staff requested a proposal from Meek to make these repairs in addition to the originally contracted work. 4-2 Balboa Ocean Pier Piles Repairs- Approval of Additional Work and Contract Contingency - Contract No. 8188-2 May 9, 2017 Page 3 After confirming the field conditions, Meek proposed to repair the missing bracings, split pile cap, and the below -deck access system for $39,865. Staff reviewed this proposed cost and believes it is reasonable for the nature of the work being performed, and taking into account that Contractor availability for this type of specialty work is very limited, and that mobilization cost alone for this work would be many thousands of dollars if contracted through another separate contract. Staff believes the best alternative to correcting the recent storm damage to the Balboa Pier is to add this work to the current Ocean Pier Maintenance contract with Meek, while their crews are on location. Pursuant to the contract specifications, Meek is allowed ten (10) consecutive working days to complete original scope of work. Upon extra work approval, ten (10) additional working days will be added to the time allotment for Meek to complete the extra work, for an overall total of twenty (20) working days. Liquidated damages in the amount of $1,000.00 per calendar day will be assessed in case of tardy completion. ENVIRONMENTAL REVIEW: The work consists of making repairs to an existing facility. As such, Staff recommends the City Council find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (Existing Facilities) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
