Section 108 of the Housing and Community Development Act of 1974 provides for a loan guarantee component of the Community Development Block Grant (CDBG) Program. The loan guarantee program provides communities with a source of financing for economic development, housing rehabilitation, public facilities, and other physical development projects, including improvements to increase their resilience against natural disasters. In fiscal year 2003, the City received $2,400,000 as a Section 108 loan to assist with the funding of the Balboa Village Improvement Program where the City invested over $10,000,000 to improve public spaces. The loan is collateralized by Community Development Block Grant allocations and should the program be eliminated, the General Fund. The CDBG program is a long-term, stable program and the risk to the General Fund is considered low. The original loan was refinanced in fiscal year 2015, lowering the average interest rate from 6.5% to 1.5%, which reduced the total remaining interest payments by $239,998. The economic gain on refinancing is $187,665 (the present value difference between the old and new debt service schedules). Future principal payments range from $169,000 to $208,000. The outstanding balance on June 30, 2017, will be $1,066,000 and the final maturity of the loan is on August 1, 2022. The loan was financed as part of a larger Department of Housing and Urban Development bond issuance with many participating agencies. As is the norm with most tax-exempt bond issues, there is a ten-year lock -out period where the bonds cannot be redeemed under any circumstance. After the lock -out period, the bonds may be optionally redeemed at par without an early redemption premium; however in respect to the City's loan, the lock -out period ends in 2025, which is after its maturity date of August 1, 2022. Therefore, the City will be unable to pay off the loan early. FUNDING REQUIREMENTS: This item provides for City Council approval of the use of an estimated $1,587,031 of CDBG funds for the 2017-2018 fiscal year, to be adjusted by the City Manager as necessary to conform to the final 2017-2018 formula grant allocation from HUD subsequent to completion of the federal budget. The costs associated with staff management of the CDBG program are approximately $17,000 per year and sufficient staff resources will be budgeted with the City's FY2017-2018 General Fund Budget. Source Description Amount 2017-2018 Grant Estimated CDBG Allocation for 2017-2018 $359,743 Unallocated Funds Funds not used by activities implemented $5,335 in prior years Commercial Fagade Imp. The objective of the CDBG program is to develop viable urban communities by providing decent housing and a suitable living environment, and by expanding economic opportunities, principally for low and moderate -income persons. CDBG is authorized under Title I of the Housing and Community Development Act of 1974. CDBG funds may be used for a wide variety of programs, services and facilities improvements, including but not limited to: Community and senior services Fair housing enforcement and landlord/tenant mediation Homeless prevention and domestic violence programs Commercial fapade improvements 15-6 Community Development Block Grant - 2017-2018 Action Plan May 9, 2017 Page 3 Street and sewer improvements Disabled (ADA) accessibility improvements Housing programs Section 108 loan payments Since July 1, 1989, the City of Newport Beach has received from HUD a direct allocation of approximately $12.4 million in CDBG funds, with annual allocations ranging from a low of $323,777 in 2011, to a high of $534,000 in 1995. The 2017-2018 grant allocation is estimated to be $359,743, based on last year's grant amount. According to CDBG regulations, the City may spend up to 20 percent of the annual formula grant allocation of CDBG funds for program administration and 15 percent for community services such as senior meal delivery, domestic violence counseling or homeless prevention programs. The remaining amount of funding may be used for projects such as commercial fagade improvements, street and sidewalk improvements, disabled accessibility improvements, public facilities such as the construction or rehabilitation of park and recreational facilities provided the projects meet applicable CDBG regulations and national objectives. Each year, the City uses a portion of the funds reserved for program administration to comply with Fair Housing Act requirements and make fair housing enforcement and landlord/tenant mediation services available to the community. These services have been provided free of cost to Newport Beach residents by the Fair Housing Foundation since 2011. On December 19, 2016, the City published a Notice of Funding Availability (NOFA) in the Daily Pilot newspaper to announce the availability of CDBG funds and solicit proposals from tax-exempt, nonprofit organizations that provide eligible CDBG services or projects that benefit Newport Beach residents. The notice and application form were also available on the City website. In response to the NOFA, five nonprofit organizations submitted applications for CDBG grants. In consideration of the funding available, the amount of funding requested, past performance, anticipated benefit to Newport Beach residents, and City priorities, staff recommends program/project funding levels in the Action Plan as follows: Public Services (subject to 15% grant cap) Requested Recommended Age Well Senior Services: Home Delivered Meals $25,000 $26,900 Council on Aging Orange County: Long Term Care Ombudsman $7,000 $7,000 Families Forward: Housing Program $15,000 $15,000 StandUp for Kids: Kids Street Outreach Program $5,000 $5,000 Administration (subject to 20% grant cap) CDBG Program Administration $59,948 $59,948 15-7 Community Development Block Grant - 2017-2018 Action Plan May 9, 2017 Page 4 Fair Housing Foundation: Fair Housing Services $12,000 $12,000 Capital Projects Section 108 Loan Repayment $169,323 $169,323 Community Facilities ADA Improvements - $691,860 Community Infrastructure ADA Improvements - $600,000 Total: $293,271 $1,587,031 The Action Plan, found in the draft resolution as Attachment A, describes each program. There is one new public service activity proposed for the upcoming year and two new capital projects. 1. The StandUp for Kids Street Outreach is a public service program that will provide services by reaching out to teens and youths (ages 12-24) who are homeless, at -risk, aging -out foster youth, and runaways. This non-profit organization will provide for necessities (food, hygiene products, and clothing), bus passes, emergency housing, and medical expenses not covered by MediCal (co -payments for medical and dental exams, prescriptions, mental health, and substance abuse treatments). The program is designed to prevent and eliminate youth homelessness, and staff is recommending that $5,000 be allocated to this new program. 2. The Community Facilities ADA project will provide funding to make Americans with Disabilities Act improvements to public facilities throughout the City of Newport Beach. This project would focus on the removal of physical or architectural barriers to accessibility for persons with disabilities. 3. The Community Infrastructure ADA project will provide funding to make Americans with Disabilities Act improvements to public infrastructure such as sidewalks and pedestrian routes throughout the City of Newport Beach. The Harbor View Hills neighborhood will be targeted, as that area does not provide ramps. Other neighborhoods will be examined and improved on a priority need basis. Again, this project would focus on the removal of physical or architectural barriers to accessibility for persons with disabilities. On April 7, 2017, staff published a notice in the Daily Pilot informing the general public that the City of Newport Beach had prepared the Draft 2017-2018 Action Plan. The notice also indicated the plan would be available for review and comment until May 9, 2017. The public has been provided an opportunity to provide oral and/or written comments on the proposed activities included in the Draft 2017-2018 Action Plan. At the time this report was prepared, staff has not received any public comments. Additionally, the current Citizen Participation Plan requires that a public hearing be held to receive testimony from interested residents or parties regarding the Action Plan. The May 9, 2017, public hearing fulfills this requirement. 15-8 Community Development Block Grant - 2017-2018 Action Plan May 9, 2017 Page 5 ENVIRONMENTAL REVIEW: The development of required plans and allocation of CDBG program funds is an administrative activity exempt under 24 CFR Part 58, Section 58.34 of the National Environmental Policy Act of 1969 ("NEPA"), as amended. Staff recommends the City Council find this action is exempt from the California Environmental Quality Act ("CEQA") pursuant to Section 15301 (Existing Facilities) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. The provision of public social services, program administration, and the debt service on the Section 108 loan has no potential for resulting in physical change to the environment, directly or indirectly. Section 15301 allows for the minor alteration of existing public facilities involving negligible or no expansion of the use. The Action Plan includes two Community ADA improvement projects that will result in the removal of physical or architectural barriers within existing public facilities to accessibility for persons with disabilities. The project will also result in the construction of compliant facilities including curb ramps, sidewalks, wheelchair ramps, handrails, building entries, and restrooms within existing public facilities and public rights-of-way. Collectively these improvements to existing public facilities do not expand the existing uses or structures. NOTICING: In accordance with HUD requirements for a 30 -day public review and comment period, notice of the public hearing was published in the Daily Pilot on April 7, 2017. Notice was also sent to each of the applicants requesting funding and emailed to all parties that have signed up to receive notifications of the Planning Division. Further, the agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). Introduction The 2017-2018 Action Plan is the third of five annual plans implementing the 2015-2019 Consolidated Plan Strategic Plan goals for the investment of annual allocations of Community Development Block Grant (CDBG) funds from the U.S. Department of Housing and Urban Development (HUD). The Action Plan identifies available resources, annual goals, projects and activities for the period beginning July 1, 2017 and ending June 30, 2018. The City receives CDBG funds from HUD on a formula basis each year, and in turn, awards grants to nonprofit, for-profit or public organizations for programs and projects in furtherance of the Strategic Plan. The CDBG program generally provide for a range of eligible activities for the benefit of low- and moderate -income Newport Beach residents, as discussed below. Community Development Block Grant (CDBG) The Housing and Community Development Act of 1974 created the CDBG Program with three primary objectives against which HUD evaluates the Consolidated Plan and the City's performance under the Plan. Those primary objectives are decent housing, suitable living environments, and expanded economic opportunities for low- and moderate -income persons. The CDBG regulations require that each activity meet one of the following national objectives: • Benefit low- and moderate -income persons; • Aid in the prevention or elimination of slums and blight; or • Meet other community development needs having a particular urgency (usually the result of a natural disaster). For the 2017-2018 program year, the City estimates receiving $359,743 of CDBG funds from HUD. When this amount is combined with prior year unallocated funds and program income received, the City estimates that will be $1,587,031 available for inclusion in the 2017-2018 Annual Action Plan. The specific sources of funds taken into consideration for the 2017-2018 program year estimated budget are categorized in Table 1. 2017-2018 Action Plan CITY OF NEWPORT BEACH 2 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-17 Table 1— Estimated Sources of Funds Source Description Amount Estimated 2017-2018 Allocation Estimated CDBG Allocation for 2017-2018 $ 359,743 Unallocated Funds Funds not used by activities implemented in prior $ 5,335 years Commercial Facade Program Year 2015-2016 Canceled Project $ 125,320 Improvements West Newport Recreation Program Year 2016-2017 Canceled Project $ 100,831 Facility Program Income Net proceeds from the sale of the Balboa Theater — $ 995,802 originally acquired with CDBG Funds Total: $ 1,587,031 The CDBG program activities to be implemented from July 1, 2017 to June 30, 2018 include: 2017-2018 CDBG Public Service Activities • Age Well Senior Services: Home Delivered Meals $ 26,900 • Council on Aging Orange County $ 7,000 • Families Forward Transitional Housing Program $ 15,000 • Stand Up for Kids Orange County: Youth Street Outreach $ 5,000 2017-2018 CDBG Capital Activities • Section 108 Loan Repayment $169,323 • Community Facilities ADA Improvements $691,860 • Community Infrastructure ADA Improvements $600,000 2017-2018 Program Administration Activities • CDBG Program Administration $ 59,948 • Fair Housing Foundation: Fair Housing Services $ 12,000 TOTAL ESTIMATED ACTIVITIES: $1,587,031 2. Evaluation of past performance The City is currently implementing the projects and activities included in the 2016-2017 Action Plan. As of this writing, all projects and activities are underway. The investment of HUD resources during the 2015-2016 program year was a catalyst for positive change in the community. Together with other federal, state and local investments, HUD resources allowed the City and its partners to accomplish the following goals: • Provide Fair Housing services to 145 residents; • Provide Public Services to 109 residents; • Provide Special Needs to 11 residents; • Provide Homelessness Prevention and Assistance to 243 residents; and • Make the scheduled debt service payments on the City's Section 108 Loan. 4. Summary of citizen participation process and consultation process 2015-2019 Citizen Participation Plan Subsequent to the enactment of the Homeless Emergency Assistance and Rapid Transition to Housing (HEARTH) Act of 2009, HUD revised the Consolidated Plan regulations at 24 CFR Part 91 to emphasize the importance of citizen participation and consultation in the development of the Consolidated Plan. HUD strengthened the consultation process with requirements for consultation with the CoC, Public Housing Authorities (PHA), business leaders, civic leaders and public or private agencies that address housing, health, social service, victim services, employment, or education needs of low-income individuals and families, homeless individuals and families, youth and/or other persons with special needs. Together with the analytic capabilities of the eCon Plan Suite, these requirements created the conditions necessary to implement a collaborative, data -driven and place -based planning process that includes a robust level of citizen participation and consultation. The City adopted its current Citizen Participation Plan on May 12, 2015 that reflects regulatory changes and process improvements. In accordance with the City's adopted Citizen Participation Plan, the City facilitated citizen participation through surveys, community meetings and public hearings. Efforts were made to encourage participation by low- and moderate -income persons, particularly those living in areas and in areas where HUD funds are proposed to be used, and by residents of predominantly low- and moderate -income neighborhoods. The consultation process included representatives of the CoC, PHA, and other specified groups who completed surveys, provided local data and assisted the City to ensure practical coordination of strategies to maximize impact and to avoid duplication of effort. 2017-2018 Action Plan CITY OF NEWPORT BEACH 5 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-20 2017-2018 Action Plan In the development of the Action Plan, the City solicited applications from non-profit organizations and City Departments for fair housing, public services, community and economic development projects. Introduction The City of Newport Beach consulted with representatives from multiple agencies, groups, and organizations involved in the development of affordable housing, creation of job opportunities for low- and moderate -income residents, and/or provision of services to children, elderly persons, persons with disabilities, persons with HIV/AIDS and their families, and homeless persons. To facilitate this consultation, the City solicited feedback through the following methods: • Stakeholder surveys (web -based and paper -surveys) • Individual stakeholder consultations • Community meetings • Public hearings • Receipt of written comments The input gathered from these consultation partners helped establish and inform the objectives and goals described in the current Strategic Plan. Specific comments received from consultation partners are included in the Attachments section of the 2015-2019 Consolidated Plan. In the development of the 2017-2018 Action Plan, the City provided each agency with an opportunity to comment on the draft Action Plan during the public review and comment period. Provide a concise summary of the jurisdiction's activities to enhance coordination between public and assisted housing providers and private and governmental health, mental health and service agencies (91.215(1)). The City recognizes the importance of careful coordination and alignment among various service providers to maximize the effectiveness of the CDBG program. As a result, during the development of this Consolidated Plan, the City consulted closely with organizations that provide assisted housing, health services and other community -focused programs. Outreach efforts included surveys including specific questions associated with coordination, invitations to community meetings and follow-up in-person interviews where appropriate. The City further recognizes the importance of continued coordination and alignment during the upcoming five-year planning period with these organizations and agencies. The City will continue strengthening relationships and alignment among these organizations. 2017-2018 Action Plan CITY OF NEWPORT BEACH 9 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-24 Describe coordination with the Continuum of Care and efforts to address the needs of homeless persons (particularly chronically homeless individuals and families, families with children, veterans, and unaccompanied youth) and persons at risk of homelessness The Continuum of Care (CoC) for Orange County guides the development of homeless strategies and the implementation of programs to end homelessness throughout the region. Orange County's homeless system of care is comprised of a network of public, private, faith - based, for-profit, and nonprofit service providers who utilize several federal, state and local resources to provide services for homeless people. The region's municipalities, including the City of Newport Beach, also provide resources for services that assist the homeless and those at risk of becoming homeless. The County's nonprofit community plays a key role in the Continuum of Care system. Hundreds of agencies throughout the County provide programs ranging from feeding the homeless on the street to creating permanent supportive housing opportunities. These services are available to homeless families with children, and single men and women. The County's nonprofit community also serves special needs populations, such as victims of domestic violence, veterans, the disabled and youth. The CoC guides the development of homeless strategies and the implementation of programs to end homelessness throughout the region. The City provided a detailed questionnaire to the CoC to identify the CoC's perceived needs in the county and its objectives to address the needs of different homeless populations, specifically chronically homeless families and individuals, families with children, veterans, unaccompanied youth and persons at risk of homelessness. Following the delivery and response to this questionnaire, the City followed up with the CoC to clarify existing needs and objectives and understand opportunities for collaboration and coordination during the five-year planning process. Describe consultation with the Continuum(s) of Care that serves the jurisdiction's area in determining how to allocate ESG funds, develop performance standards and evaluate outcomes, and develop funding, policies and procedures for the administration of HMIS In the development of the 2015-2019 Consolidated Plan, the City of Newport Beach consulted with 25 housing, social service and other entities involved in housing, community and economic development in Newport Beach and how CDBG funds and other resources should be invested to provide decent affordable housing, a suitable living environment and economic opportunities for low- and moderate -income residents. The Orange County Continuum of Care was consulted directly by telephone and e-mail to discuss performance standards, outcomes, and policies and procedures for HMIS. 2017-2018 Action Plan CITY OF NEWPORT BEACH 10 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-25 The Orange County CoC established a collaborative implementation and management with the three CoCs located in Los Angeles County (City of Pasadena, City of Glendale, and Los Angeles County). The Collaborative developed and maintains a Policies and Procedures guide for the use of the HMIS system. Additionally, HMIS system administrators provide training as needed to HMIS users and provide troubleshooting assistance on an "as needed" basis. Summary of citizen participation process/Efforts made to broaden citizen participation Summarize citizen participation process and how it impacted goal -setting The City established and followed a process for the development of the five-year Consolidated Plan that included broad participation from the community. To assist in the identification of priority needs in the City, the 2015-2019 Consolidated Plan Needs Assessment Survey was prepared and distributed to residents of the City to solicit resident input in the prioritization of needs related to community services, community facilities, infrastructure, neighborhood services, special needs services, businesses and jobs, and housing. The surveys were available online and also were made available at various public facilities. A community meeting to discuss the housing and community development needs in the community was held on February 26, 2015. The public hearing took place on May 12, 2015 to receive comments on the draft 2015-2019 Consolidated Plan. At each step in the process, the City was careful to ensure that low- and moderate -income residents, members of minority groups, agencies involved in the provision of services to these populations, and others who are directly impacted by the programs and activities supported by the Consolidated Plan programs had the opportunity to be actively involved. In the preparation of the 2015-2019 Consolidated Plan, the City followed the process established for citizen participation set forth in the Citizen Participation Plan. To promote greater public accessibility to program documents, the Citizen Participation Plan, Consolidated Plan, Action Plans, CAPERs and the Analysis of Impediments to Fair Housing Choice are posted on the City website at: https://www.newportbeachca.gov/index.aspx?page=1871 In the preparation of the 2017-2018 Action Plan, the City made the draft Action Plan available for public review and comment from April 7, 2017 to May 9, 2017. Summary. Residents of Public and Assisted Housing 2017-2018 Action Plan CITY OF NEWPORT BEACH 28 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-43 AP -15 Expected Resources — 91.220(c)(1,2) Introduction The projects and activities included in the 2017-2018 Action Plan are based on resources that are reasonably anticipated to be available to the City from federal, state, local and private sources from July 1, 2017 through June 30, 2018. The $995,085 of program income is the net proceeds available from the sale of the Balboa Theater in 2016. The $231,486 of prior year resources is as a result of 1) cancellation of the 2015-2016 Commercial Fagade Improvements Activity; 2) cancellation of the 2016-2017 West Newport Recreation Facility Activity; and 3) unexpended funds from other completed CDBG activities. The actual resources available to support activities during the implementation of the remainder of the 2015-2019 Consolidated Plan may vary significantly due to factors outside of the City's control. For example, HUD formula grant allocations are subject to change each year based on a number of factors such as the amount of the national appropriation, changes in ACS population data applied to the CPD grant formulas, statutory changes to the CPD grant formulas, the addition or removal of entitlements receiving a particular CPD grant and the availability of reallocated funds. Additionally, state, local and private resources will vary significantly depending on economic conditions. 2017-2018 Action Plan CITY OF NEWPORT BEACH 29 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-44 Anticipated Resources Table 7 - Expected Resources — Priority Table Program Source of Funds Uses of Funds Expected Amount Available Year 3 Expected Amount Narrative Description Annual Program Prior Year Total: Allocation: $ Income: $ Resources: $ Available $ Remainder of Con Plan CDBG public - Acquisition Based on level funding federal Admin and Planning from HUD in Economic subsequent years Development Housing Public Improvements Public Services 359,743 995,802 231,486 1,587,031 719,486 2017-2018 Action Plan CITY OF NEWPORT BEACH 30 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-45 Explain how federal funds will leverage those additional resources (private, state and local funds), including a description of how matching requirements will be satisfied The City and its development partners will continue to seek new opportunities to leverage federal funds, such as the Low -Income Tax Credit program and U.S. Department of Housing and Urban Development Section 202 and 811 for the Elderly Program. Depending on the financing structure of a given activity, the City may use CDBG funds to leverage appropriate state, local and private resources, including but not limited to those listed below. State Resources • State Low -Income Housing Tax Credit Program • Building Equity and Growth in Neighborhoods Program (BEGIN) • CalHome Program • Multifamily Housing Program (MHP) • Housing Related Parks Grant • CaIHFA Single and Multi -Family Program • Mental Health Service Act (MHSA) Funding Local Resources • Orange County Housing & Finance Agency (OCHFA) Funding • Southern California Home Financing Authority (SCHFA) Funding • Orange County Continuum of Care Program • Orange County Housing Authority (OCHA) Programs Private Resources • Federal Home Loan Bank Affordable Housing Program (AHP) • Community Reinvestment Act Programs • United Way Funding • Private Contributions 2017-2018 Action Plan CITY OF NEWPORT BEACH 31 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-46 Matching Requirements The City of Newport Beach does not receive HOME funds as part of its entitlement allocation. The amount of matching is therefore; not applicable for the 2015-2019 Consolidated Plan. If appropriate, describe publicly owned land or property located within the jurisdiction that may be used to address the needs identified in the plan The City does not currently own any publicly owned land or property that can be used to address the needs of the Consolidated Plan. Discussion Assuming continued level funding of the CDBG programs, the City expects to utilize approximately $2.9 million of CDBG funds and program income during the five-year period beginning July 1, 2015 and ending June 30, 2020 to achieve the goals of the Strategic Plan. The City does not anticipate receiving any new program income funds during the remainder of the five-year period, based on past and current projects and activities. 2017-2018 Action Plan CITY OF NEWPORT BEACH 32 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-47 AP -20 Annual Goals and Objectives - 91.420, 91.220(c)(3)&(e) Goals Summary Information Table 8 — Goals Summary Sort Goal Name Start End Category Geographic Needs Addressed Funding Goal Outcome Indicator Order Year Year Area FY 2017-2018 FY 2017-2018 1 Fair Housing Services 2015 2019 Affordable Citywide Ensure equal CDBG: $12,000 Other: 105 Other Housing access to housing opportunities Fair Housing Foundation 2 Public Services 2015 2019 Non -Housing Citywide Provide public CDBG: $33,900 Public service Community services for low- activities other than Development income residents Age Well & Low/Moderate Council on Aging Income Housing Benefit: 127 Persons 3 Homelessness 2015 2019 Homeless Citywide Prevent and CDBG: $20,000 Homelessness Prevention Services eliminate Prevention: homelessness Families Forward & 215 persons StandUp for Kids 4 Public Facilities / 2015 2019 Non -Housing Citywide Improve public CDBG: $1,461,183 Other: Section 108 Infrastructure Community facilities and (includes prior year Debt Service & Public Improvements and Development infrastructure funds and PI Facility/infrastructure: Section 108 Debt $1,227,288) 17,190 Persons Service 2017-2018 Action Plan CITY OF NEWPORT BEACH 33 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-48 Goal Descriptions Table 9 — Goal Descriptions 1 Goal Name Fair Housing Services Goal Affirmatively further fair housing choice through the provision of fair housing education, counseling, anti -discrimination and Description landlord -tenant mediation services. 2 Goal Name Public Services Goal Provide public services for low- and moderate -income residents including senior citizens, families and youth including but not Description limited to those concerned with food, essential services, transportation, health, recreation and employment. 3 Goal Name Homelessness Prevention Services Goal Support a continuum of services in Orange County to prevent and eliminate homelessness including, but not limited to, Description homelessness prevention programs, emergency shelter programs and transitional housing. 4 Goal Name Public Facilities/Infrastructure Improvements and Section 108 Debt Service Goal Provide for debt service on the Section 108 Loan previously used to fund public improvements as part of the Balboa Village Description pedestrian and Streetscape Improvement to Balboa Boulevard, Pier Parking Lot, Pier Plaza and Lot A connecting access to Main Street and provide funds for a public facility/infrastructure improvement. 2017-2018 Action Plan CITY OF NEWPORT BEACH 34 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-49 Estimate the number of extremely low-income, low-income, and moderate -income families to whom the jurisdiction will provide affordable housing as defined by HOME 91.215(b) During the 2017-2018 Action Plan period, the City does not anticipate creating any affordable housing units that will meet the HOME Investment Partnerships (HOME) program definitions of affordable housing found at 24 CFR 92.252 for rental and 24 CFR 92.254 for homeownership. Together, these projects will address the needs of low- and moderate -income Newport Beach residents. The Fair Housing Services project will provide fair housing assistance to an estimated 105 moderate -income people, the Public Services project will provide assistance to an estimated 127 presumed low-income elderly people, and the Homelessness Prevention projects will provide supportive services to an estimated 215 presumed extremely -low income homeless people. The primary obstacles to meeting the underserved needs of low- and moderate -income people include lack of funding from federal, state and other local sources and the high cost of housing that is not affordable to low-income residents. All CDBG funds will be directed toward activities benefitting low- and moderate -income residents citywide. The only exception to this approach would be for CDBG projects that are qualified on a low- and moderate -income area basis where a specific proportion of the residents within the service area must be low- and moderate -income residents, such as the new community public facility and community infrastructure. Geographic Distribution Table 12 - Geographic Distribution Target Area Percentage of Funds Citywide 100% Rationale for the priorities for allocating investments geographically For the 2017-2018 program year, the City's investments in Fair Housing Services, Public Services, and Homelessness Prevention Services projects are based on a citywide geography because individuals in need of these services may live anywhere within the jurisdiction— particularly services for seniors with needed assistance and youths that are homeless or at -risk to become homeless. Discussion Based on the Strategic Plan, the City is allocating 100 percent of its non -administrative CDBG funds for program year 2017-2018 to projects and activities that benefit low- and moderate - income people. 2017-2018 Action Plan CITY OF NEWPORT BEACH 44 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-59 AP -55 Affordable Housing — 91.220(g) Introduction As stated in the Consolidated Plan, the City of Newport Beach will continue its efforts to leverage other funding sources such as the Affordable Housing Trust Fund to address the local housing needs identified below. Expand the Supply of Affordable Housing Based on evaluation of 2007-2011 ACS and CHAS data, there is a need for additional rental housing units affordable for households earning less than 50 percent of AMI. Of the households earning 0-80 percent of AMI, 7,790 are cost burdened households — meaning households paying more than 30 percent of their income for housing. Additionally, 5,805 of the cost burdened households are considered severely cost burdened households — meaning that they pay more than 50 percent of their income for housing. Of the 5,805 severely cost burdened households, 3,580 are renters. Of those severely cost burdened renter households, 2,945 households earn less than 50 percent of AMI and are considered the most at risk of becoming homeless. The City will continue to use its Affordable Housing Trust Fund and other available options under the State Density Bonus law to create additional affordable housing. In February 2013, the City approved the Uptown Newport Planned Community consisting of 1,244 units that included the requirement to construct affordable housing pursuant to State Density Bonus Law. In April 2017, the City issued building permit for the first 462 units that include 92 units for very -low income households. The California Statewide Communities Development Authority (CSCDA) has issued $161,620,000 in tax-exempt and taxable multifamily affordable housing bonds that will ensure the affordability for 55 years. The project construction will take approximately 2 years. Preserve the Supply of Affordable Housing As the City's housing stock ages, a growing percentage of housing units may need rehabilitation to allow them to remain safe and habitable. The situation is of particular concern for low- and moderate -income homeowners who are generally not in a financial position to properly maintain their homes. The age and condition of Newport Beach's housing stock is an important indicator of potential rehabilitation needs. Commonly, housing over 15 years of age will exhibit deficiencies in terms of paint, weatherization, heating / air-conditioning systems, hot water heaters and finish plumbing fixtures. Housing over 30 years of age will typically some form of major rehabilitation, such as roof replacement, foundation work and plumbing systems. 2017-2018 Action Plan CITY OF NEWPORT BEACH 45 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-60 According to CHAS data showing the year that housing units were built categorized by owner and renter tenure: • 5,363 or 26 percent of the 20,950 owner -occupied housing units built between 15 and 34 years ago (built between 1980 and 1999). • 12,619 or 61 percent of the 20,950 owner -occupied housing units in Newport Beach were built 34 or more years ago (built prior to 1980). • 3,934 or 23 percent of the 17,098 renter -occupied housing units in Newport Beach were built between 15 and 34 years ago (built between 1980 and 1999). • 11,655 or 68 percent of the 17,098 renter -occupied housing units in Newport Beach were built 34 or more years ago (built prior to 1980). Preservation of the physical and functional integrity of existing housing units occupied by low - and moderate -income households is a cost-effective way to invest limited resources to retain existing housing units that are already affordable to low- and moderate -income households in the community. Addressing substandard housing conditions through housing preservation activities ensures that all economic segments of the community have the opportunity to live in decent housing that meets local standards. Program funding is from the City's Affordable Housing Fund. The first project is complete and repairs were made to the siding, roof, paint, chimney, faucets, outlets, smoke and carbon monoxide detectors. Five additional units are under consideration and it is anticipated that the City may complete approximately 10 additional projects in the coming program year. The City of Newport Beach is registered as a Qualified Preservation Entity with the California Department of Housing and Community Development (HCD). When notification is received of the expiration of a prior affordable housing agreement, City staff evaluates the potential use of funds to preserve the affordable units. 2017-2018 Action Plan CITY OF NEWPORT BEACH 47 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-62 AP -60 Public Housing — 91.220(h) Introduction The Newport Beach Housing Authority does not administer Section 8 and does not own HUD Public Housing. Newport Beach is within the service area of the Orange County Housing Authority (OCHA) for the purposes of Section 8 and Public Housing. As of 2016, OCHA administered a total of 9,973 housing vouchers throughout the County. Of these, 115 were issued to Newport Beach residents. Families received 34 housing vouchers, 23 housing vouchers were issued to Newport Beach's disabled population, and 58 housing vouchers were issued to elderly households. OCHA monitors all units to ensure they are in adequate condition, meeting the Section 8 Housing Quality Standards (HQS). Actions planned during the next year to address the needs to public housing OCHA's stated goals include: • Apply for additional housing assistance funding and programs that may become available. • Explore the use of Project -Based Housing Choice Vouchers or other housing funds to promote the construction or acquisition activities that will result in additional units or developments that will serve special needs populations. • Ensure consistent quality of assisted housing services by maintaining high performer status in Section Eight Management Assessment Program (SEMAP) scores. • Promote Family Self -Sufficiency incentives and homeownership opportunities for Housing Choice Voucher participants in partnership with local programs and related service providers. • Expand assisted housing choices by conducting outreach efforts to increase the number of property owners and their participation in housing assistance programs. • Identify and utilize technology to enhance operational effectiveness and efficiency in delivery of housing assistance services Actions to encourage public housing residents to become more involved in management and participate in homeownership OCHA supports resident councils and actively seeks input from PHA residents on the management and implementation of OCHA policies and procedures. Housing prices in Orange County are so high that homeownership opportunities are limited for OCHA residents. On a limited basis, OCHA has partnered with Habitat for Humanity to provide 2017-2018 Action Plan CITY OF NEWPORT BEACH 48 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-63 two affordable homeownership units, but these types of efforts are limited. OCHA also manages a Housing Choice Voucher Homeownership Program that it markets to all OCHA program tenants. If the PHA is designated as troubled, describe the manner in which financial assistance will be provided or other assistance Not applicable. OCHA is designated as a High Performing PHA. Discussion Newport Beach continues to support OCHA in effective administration of its limited affordable housing resources. The City also continues to work with OCHA to include the residents with Section 8 Housing Choice Vouchers in the federally -funded programs administered by the City, including any homeownership programs. 2017-2018 Action Plan CITY OF NEWPORT BEACH 49 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-64 AP -65 Homeless and Other Special Needs Activities — 91.220(i) Introduction The City will invest CDBG funds during the 2017-2018 program year to address high priority needs identified in the 2015-2019 Consolidated Plan including preventing homelessness and providing public services to homeless populations. Homelessness Prevention Services According to the results of the most recent data available from the bi-annual Point -In -Time Homeless Count (PIT Count) held on January 24, 2015, on any given night in Orange County, approximately 4,450 people are homeless, and over a course of a year, more than 15,291 people are expected to experience homelessness. To address incidences of homelessness in Newport Beach and to prevent extremely -low income Newport Beach families from becoming homeless, the City places a high priority on programs that work to prevent homelessness or rapidly assist homeless individuals living in the community. To address this need, the City will support CDBG public service activities that help prevent homelessness and that provide a structured path to stable housing for individuals and families who become homeless. Services for Residents with Special Needs Analysis of available data and consultation with organizations providing services for special needs populations revealed a high need for a range of additional services including, but not limited to, those concerned with domestic violence, human trafficking, mental disabilities, physical disabilities, developmental disabilities, substance abuse/alcoholism and HIV/AIDS. Describe the jurisdictions one-year goals and actions for reducing and ending homelessness including reaching out to homeless persons (especially unsheltered persons) and assessing their individual needs To reach out to unsheltered homeless persons and assess their individual needs for the purpose of connecting them with available emergency shelter and transitional housing resources, the City of Newport Beach, through its Planning Division will provide information and referrals — primarily to 2-1-1 Orange County. Additionally, to reduce and end homelessness, the City of Newport Beach will provide CDBG public service funds to the following activities: • Families Forward: Housing Program (200 people) • Stand Up for Kids Orange County: Youth Street Outreach Program (15 people) 2017-2018 Action Plan CITY OF NEWPORT BEACH 50 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-65 Addressing the emergency shelter and transitional housing needs of homeless persons To address the emergency shelter and transitional housing needs of homeless persons, the City supports the Families Forward Housing Program that provides transitional housing, counseling and case management to families at risk of homelessness. Each year, Families Forward serves approximately 200 unduplicated people. Additionally, the City supports Stand Up for Kids, an organization providing services by reaching out teens and youths (ages 12-24) who are homeless, at -risk, aging -out foster youth, and runaways. The organization provides for necessities (food, hygiene products and clothing), bus passes, emergency housing and medical expenses not covered by Medi -Cal (co -payments for Medi -Cal and dental exams, prescriptions, mental health, and substance abuse treatments). The organization will serve approximately 15 unduplicated people. Other organizations in the Continuum of Care (CoC) addressing the emergency shelter and transitional housing needs of homeless persons include Orange Coast Interfaith Shelter, Orange County Rescue Mission and WISE Place. Helping homeless persons (especially chronically homeless individuals and families, families with children, veterans and their families, and unaccompanied youth) make the transition to permanent housing and independent living, including shortening the period of time that individuals and families experience homelessness, facilitating access for homeless individuals and families to affordable housing units, and preventing individuals and families who were recently homeless from becoming homeless again To address the needs of homeless families, families with children, veterans and their families, the City supports the Families Forward Housing Program, which provides transitional housing, counseling and case management to families at risk of homelessness. Each year, Families Forward serves approximately 200 unduplicated people through its transitional housing program. When paired with financial counseling, career coaching and other available case management services, Families Forward makes certain that families are ready to succeed in their transition to permanent housing. Helping low-income individuals and families avoid becoming homeless, especially extremely low-income individuals and families and those who are: being discharged from publicly funded institutions and systems of care (such as health care facilities, mental health facilities, foster care and other youth facilities, and corrections programs and institutions); or, receiving assistance from public or private agencies that address housing, health, social services, employment, education, or youth needs 2017-2018 Action Plan CITY OF NEWPORT BEACH 51 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-66 The Orange County CoC Ten Year Plan to End Homelessness included a goal to establish countywide protocols and procedures to prevent people from being discharged from public and private institutions of care into homelessness that will help decrease the number of persons being discharged into homelessness. The CoC is seeking improve coordination among publicly and privately funded institutions of care and local service agencies in the County of Orange in order to decrease the number of persons being discharged into homelessness annually. Discussion The City of Newport Beach considers ending and preventing homelessness a high priority and will support CDBG public service activities that help prevent homelessness and that provide a structured path to stable housing for individuals and families who become homeless. 2017-2018 Action Plan CITY OF NEWPORT BEACH 52 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-67 AP -75 Barriers to affordable housing — 91.220(j) Introduction: A barrier to affordable housing is a public policy or nongovernmental condition that constrains the development or rehabilitation of affordable housing, such as land use controls, property taxes, state prevailing wage requirements, environmental protection, cost of land and availability of monetary resources. Barriers to affordable housing are distinguished from impediments to fair housing choice in the sense that barriers are lawful and impediments to fair housing choice are usually unlawful. Based on information gathered during community meetings, the Consolidated Plan Needs Assessment Survey, the 2014-2021 Housing Element and market analysis, the primary barriers to affordable housing in Newport Beach are housing affordability and the lack of monetary resources necessary to develop and sustain affordable housing. The two barriers are related in the sense that demand for affordable housing exceeds the supply and insufficient resources are available to increase the supply of affordable housing to meet demand. For low- and moderate -income households, finding and maintaining decent affordable housing is difficult due to the high cost of housing in Newport Beach and throughout the region in general. Over 20 percent of the City's 38,048 households experience a cost burden or severe cost burden, meaning that they pay more than 30 or 50 percent of their income for housing, respectively. Consistent with available data, responses to the 2015-2019 Consolidated Plan Needs Assessment Survey indicate a high need for additional affordable housing in Newport Beach. Actions it planned to remove or ameliorate the negative effects of public policies that serve as barriers to affordable housing such as land use controls, tax policies affecting land, zoning ordinances, building codes, fees and charges, growth limitations, and policies affecting the return on residential investment In the development of the 2014-2021 Housing Element, the City evaluated significant public policies affecting affordable housing development such as land use controls, tax policies affecting land, zoning ordinances, building codes, fees and charges and growth limitations. Based on this evaluation, the City determined that it has taken all appropriate and necessary steps to ameliorate the negative effects of public policies that may have been a barrier to affordable housing. Moreover, the City will continue to use its Affordable Housing Trust Fund to fund future affordable housing projects. 2017-2018 Action Plan CITY OF NEWPORT BEACH 53 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-68 Discussion: To address housing affordability and the lack of monetary resources for affordable housing, the City will invest Affordable Housing Trust Fund resources to incentivize the development of affordable housing during the five-year period of the Consolidated Plan. In addition, the City will continue to work with the County and refer low- and moderate income residents for participation in their Housing Rehabilitation Program. 2017-2018 Action Plan CITY OF NEWPORT BEACH 54 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-69 AP -85 Other Actions — 91.220(k) Introduction: In the implementation of the 2017-2018 Annual Action Plan, the City will invest CDBG resources to address obstacles to meeting underserved needs, reduce the number of poverty -level families, develop institutional structure and enhance coordination between public and private social service agencies. Actions planned to address obstacles to meeting underserved needs The primary obstacles to meeting the underserved needs of low- and moderate -income people include lack of funding from federal, state and other local sources, and the high cost of housing that is not affordable to low-income people. To address these obstacles, the City is investing CDBG funds through the 2017-2018 Action Plan in projects that provide assistance to those with special needs, projects that prevent homelessness for low- and moderate -income residents. To address underserved needs, the City is allocating 100 percent of its non- administrative CDBG investments for program year 2017-2018 to projects and activities that benefit low- and moderate -income people or people presumed under HUD regulations to be low- and moderate -income. Actions planned to foster and maintain affordable housing In early 2016, the City awarded $1,600,000 Affordable Housing Trust Funds to Seaview Lutheran Plaza for the rehabilitation of 100 apartments for senior citizens, extending the project's affordability period and additional 30 years. Additionally, $1,975,000 was awarded to Newport Veterans Housing to rehabilitate 12 former market rate units to be rented affordably for a period of 55 years, with a priority for low-income seniors and veterans. The City will continue to evaluate alternate funding sources and programs to preserve and maintain existing affordable housing such as the County's Residential Rehabilitation Program. In the implementation of the 2017-2018 Annual Action Plan, the City will continue to look at alternate funding sources and programs to preserve and maintain existing affordable housing such as the County's Residential Rehabilitation Program. The City also continues to consider Density Bonuses and other incentives on a project -by -project basis to encourage the construction of housing for persons and families of very low, low, and moderate income. Actions planned to reduce lead-based paint hazards In the implementation of any future Residential Rehabilitation Programs, the City will disseminate brochures provided by the U.S. Environmental Protection Agency to all applicants as part of the transmittal of the program application. Any unit receiving assistance through the 2017-2018 Action Plan CITY OF NEWPORT BEACH 55 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-70 program that was built prior to January 1, 1978 will be tested for lead-based paint. If lead-based paint is present, appropriate abatement procedures are implemented as part of the rehabilitation contract consistent with the requirements of 24 CFR Part 35. Actions planned to reduce the number of poverty -level families The implementation of CDBG activities meeting the goals established in the 2015-2019 Consolidated Plan -Strategic Plan and this Annual Action Plan will help to reduce the number of poverty -level families by: • Supporting activities that expand the supply of housing that is affordable to low- and moderate -income households, including investment of the City's Housing Trust Fund resources and using the State Density Bonus law to incentivize the development of additional affordable housing units; • Supporting a continuum of housing and public service programs to prevent and eliminate homelessness; • Supporting housing preservation programs that ensure low income households have a safe, decent and appropriate place to live; • Supporting public services through various nonprofits funded by CDBG that serve the community's youth, seniors, families and those with special needs; and • Promoting economic opportunity for all residents working for employers doing business with the City of Newport Beach through the Commercial Fagade Improvement Program. In addition to these local efforts, mainstream state and federal resources also contribute to reducing the number of individuals and families in poverty. Federal programs such as the Earned Income Tax Credit and Head Start provide a pathway out of poverty for families who are ready to pursue employment and educational opportunities. Additionally, in California, the primary programs that assist families in poverty are CaIWORKs, CalFresh (formerly food stamps) and Medi -Cal. Together, these programs provide individuals and families with employment assistance, subsidy for food, medical care, childcare and cash payments to meet basic needs such as housing, nutrition and transportation. Other services are available to assist persons suffering from substance abuse, domestic violence and mental illness. Actions planned to develop institutional structure The institutional delivery system in Newport Beach is high -functioning and collaborative — particularly the relationship between local government and the nonprofit sector comprised of a network of capable community-based organizations that are delivering a full range of services to residents. Affordable housing development and preservation activities will be carried out by the Planning Division of the Community Development Department in partnership with other 2017-2018 Action Plan CITY OF NEWPORT BEACH 56 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-71 agencies. Public service activities will be carried out by nonprofit organizations to achieve the Strategic Plan goals. The Planning Division and the Public Works Department will work together with contractors to implement public facility improvement projects. One of the key ways the City is developing and expanding institutional structure to meet underserved needs is by funding a wide variety of services targeted to seniors, special needs populations and individuals or families at risk of homelessness with CDBG public service grants. Actions planned to enhance coordination between public and private housing and social service agencies To enhance coordination between public and private housing and social service agencies, the City will continue consulting with and inviting the participation of a wide variety of agencies and organizations involved in the delivery of housing and supportive services to low- and moderate - income residents in Newport Beach. Discussion: In the implementation of the 2017-2018 Annual Action Plan, the City will invest CDBG resources to address obstacles to meeting underserved needs, reduce the number of poverty -level families, develop institutional structure and enhance coordination between public and private social service agencies. 2017-2018 Action Plan CITY OF NEWPORT BEACH 57 OMB Control No: 2506-0117 (exp. 07/31/2015) 15-72 AP -90 Program Specific Requirements — 91.220(1)(1,2,4) Introduction: In the implementation of programs and activities under the 2016-2017 Annual Action Plan, the City of Newport Beach will follow all HUD regulations concerning the use of program income, forms of investment, overall low- and moderate -income benefit for the CDBG program.
