Brown, City Clerk TITLE: Appointment of New Civil Service Board Member to Fill the Unscheduled Vacancy on the Civil Service Board ABSTRACT: Due to the resignation of Doug Wood from the Civil Service Board, the City Council has the opportunity to fill the vacant position pursuant to City Council Policy A-2 (Board, Commission and Committee Appointments), City Charter Sections 702, 705, 710 and the Maddy Act. RECOMMENDATION: a) Determine that the action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because it will not result in a physical change to the environment, directly or indirectly; and b) Appoint 1) Howard Herzog, 2) Hugh Logan or 3) Julia Morton, as ranked by the Police and Fire associations, to fill the unexpired balance of Doug Wood's term, which expires on June 30, 2020. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: On June 13, 2017, Doug Wood was appointed to serve as the City's representative on the Visit Newport Beach Executive Board and, therefore, resigned his position on the Civil Service Board. Pursuant to City Charter Section 710, Mr. Wood was an appointee from a list of nominees provided by the employees in the Classified Service (Police and Fire associations). His term was scheduled to expire on June 30, 2020. 21-1 Appointment to the Civil Service Board July 25, 2017 Page 2 Pursuant to City Charter Sections 702 and 705, and City Council Policy A-2, the City Council's appointee to the Civil Service Board will serve the balance of Mr. Wood's unexpired term. Pursuant to the Maddy Act and City Council Policy A-2, the City Clerk prepared and posted a Notice of Unscheduled Vacancy on Wednesday, June 14 2017, in the City Clerk's Office, at the Central Library, on the bulletin board in the City Council Chambers, and on the City's webpage, and published the Notice in the Daily Pilot on Saturday, June 17, 2017. As provided in the Notice, applications were accepted by the City Clerk's Office until noon on Thursday, June 29, 2017. On Wednesday, June 14, 2017, the applications were forwarded to the Police and Fire associations for their review and have ranked their nominations for City Council consideration as follows: 1) Howard Herzog, 2) Hugh Logan or 3) Julia Morton. Copies of the applications are attached hereto as Attachment A. Appointment Process Pursuant to Council Policy A-2, appointment to the Civil Service Board will take place in the following manner: A. The City Council will vote on the appointment simultaneously. The voting will be by paper ballot and the City Clerk will tabulate and announce the results, including the vote tally. B. Each member of the City Council will cast one vote on the paper ballot. In order to be appointed, the nominee must receive at least four votes. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). The Civil Service Board offers and opportunity to serve the City be ensuring fairness, objectivity, and impartiality in hearings for the City's personnel. The Board serves as an appeal body in disciplinary actions and advises and makes recommendations to the Council on rules for fairness, equal treatment, and how to bring the most talented people into the City's service. Having conducted three disciplinary hearings during the two years I served as chairman; participated in an investigation of events leading to the selection of a previous Police Chief; served on an orals board for the selection of a Fire Chief; had the opportunity to interface regularly with police and fire personnel; graduated from the Citizens Police Academy; and completed CERT training in the Fire Department, I believe I have gained experience in the issues confronting our safety personnel.
