What are Drones? �
Per the Federal Aviation Administration (FAA), a
small UAS or drone is:
"An unmanned aircraft system is an unmanned 14
aircraft and the equipment necessary for the safe
and efficient operation of that aircraft. An unmanned
aircraft is a component of a UAS. It is defined by
statute as an aircraft that is operated without the
possibility of direct human intervention from within o
on the aircraft (Public Law 112-95, Section 331(8)).

Flying as a Recreational Pilot-,, �
The FAA defines Recreational flight as:
"Recreational or hobby UAS use is flying for qu
enjoyment and not for work, business purposes, or
for compensation or hire. In the FAA's Interpretation
of the Special Rule for Model Aircraft, the FAA relied
on the ordinary, dictionary definition of these terms.
UAS use for hobby is a "pursuit outside one's regula
occupation engaged in especially for relaxation."
UAS use for recreation is "refreshment of strength4
and spirits after work; a means of refreshment or
division. ))

Drones are allowed to operate in certain controlled
airspace. The below graphic shows how airspace is
layered and the different types of controlled
airspace.
The City of Newport Beach is almost wholly -
contained inside of the John Wayne Airport Class "C
airspace.

(a) (1) Every person who goes to the scene of an emergency, or stops at the scene of an emergency, for
the purpose of viewing the scene or the activities of police officers, firefighters, emergency medical, or
other emergency personnel, or military personnel coping with the emergency in the course of their duties
during the time it is necessary for emergency vehicles or those personnel to be at the scene of the
emergency or to be moving to or from the scene of the emergency for the purpose of protecting lives or
property, unless it is part of the duties of that person's employment to view that scene or those activities
and thereby impedes police officers, firefighters, emergency medical, or other emergency personnel oro
military personnel, in the performance of their duties in coping with the emergency, is guilty of a
misdemeanor.
(2) For purposes of this subdivision, a person shall include a person, regardless of his or her location, wh
operates or uses an unmanned aerial vehicle, remote piloted aircraft, or drone that is at the scene of an
emergency.
No person shall use any property zoned or utilized
for a residential use, public property or public facility
for the purpose of staging, shooting, making,
capturing, taking or recording of images for any
commercial or business purpose without first
applying for and receiving a permit from the City
