It is the desire of Council Member Brad Avery (District 2) and Council Member Herdman (District 5) to make appointments, subject to City Council confirmation. RECOMMENDATION: a) Determine that the action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because it will not result in a physical change to the environment, directly or indirectly; b) Confirm Council Member Avery's appointment of Charles (Steve) Byers as the District 2 Representative Member to the Aviation Committee; and c) Confirm Council Member H.erdman's appointment of Patricia Janssen as the District 5 Alternate Member to the Aviation Committee. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: Resolution No. 2011-31, which established the membership of the Aviation Committee states, in part, that the Aviation Committee shall consist of seven members, one from each City Council District, nominated by the District Council Member and confirmed by the City Council; seven alternates, one from each City Council District, nominated by the District Council Member and confirmed by the City Council; and a member of the General Aviation Community, nominated by the Mayor and confirmed by the City Council. 12-1 Appointments to the Aviation Committee October 24, 2017 Page 2 The District 2 representative position is vacant and Council Member Avery has nominated Charles (Steve) Byers to fill the seat. The District 5 alternate position is vacant and Council Member Herdman has nominated Patricia Janssen to fill the seat. Pursuant to City Council Policy A-2 (Boards, Commissions and Committees) and the Maddy Act, an Unscheduled Vacancy Notice was prepared by the City Clerk. The notice was posted in the City Clerk's Office, Central Library, and on the City's bulletin board on July 10, 2017, and again on September 27, 2017. The City Clerk's Office also published the notice on July 15, 2017 and October 2, 2017. The applications are attached as Attachment A. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). Having lived in the Heights for 39 years, I have seen many changes in the city. I would like to help keep the things that attracted my wife and I here available for future generations. I am interested in representing my area with regards to the John Wayne Airport and its flight departures/ landings as well as the environmental and safety issues. My goal is to have changes made to the current situation to minimize the impacts from noise, pollution and improve the health and safety of our community. The current proposals do not go far enough. Changing departures to fly over Collins Island isn't the answer. The planes need to fly over water and then go over the least amount of homes. If this isn't possible then the departures should take off and "fan" out so that the entire city shares in the impacts resulting in a fair solution. There should be no unfair advantage or influence from any one individual, group or organization in decisions made regarding flight patterns and other activities from the Airport. There must be a "fair" approach with acceptable results. The FAA and the Airline Industry needs to take this situation more seriously governed by a conscience which I hope to influence towards that end.
