TITLE: Resolution Authorizing CalRecycle Rubberized Pavement Grant
Program Application
ABSTRACT:
The California Department of Resources Recycling and Recovery, known as CalRecycle,
administers the Rubberized Pavement Grant Program to promote the use of rubberized
pavement materials derived from waste tires generated in the state of California. In order
to qualify for the Fiscal Year 2017-2018 Rubberized Grant Program, a resolution
authorizing the grant application is required.
RECOMMENDATION:
a) Determine that the action is exempt from the California Environmental Quality Act
(CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines
because it will not result in a physical change to the environment, directly or indirectly;
and
b) Adopt Resolution No. 2017-68, A Resolution of the City Council of the City of Newport
Beach, California, Authorizing Submittal ofApplication(s) forAll CalRecycle Grants for
which the City of Newport Beach is Eligible.
FUNDING REQUIREMENTS:
If the City's application is approved, the City will receive approximately $254,000 in State
grant funds, which can be used on upcoming pavement rehabilitation projects and reduce
the City's net cost of the projects.

DISCUSSION:
The Rubberized Pavement Grant Program (Program) provides assistance to local
governments to fund rubberized asphalt concrete (RAC) projects, including Asphalt
Rubber Hot Mix (ARHM) pavement material used on the City's arterial roadways. The
purpose of the Program is to promote markets for RAC products with crumb rubber
derived from California -generated waste tires and divert tires to the landfill. The Program
is designed to encourage first-time or limited users of rubberized pavement. RAC is a
proven road paving material, used in California since the 1970's.
For FY 2017-2018, the Program has $7,750,000 in funding available, with a maximum
individual application amount of $350,000 per agency. Staff has prepared an application
requesting $254,000 in grant funds. CalRecycle will review all applications and if the
City's application is approved, award of the grant is scheduled for December 2017.
The Rubberized Pavement Grant application requires any applicant subject to a
governing body submit a Resolution related to specific grant -related matters. The
Resolution must identify the period of time during which the authorization is valid and
identify the signatory authorized to sign all grant related documents necessary to
implement and close out the grant on behalf of the City.
ENVIRONMENTAL REVIEW
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, AUTHORIZING
SUBMITTAL OF APPLICATIONS AND RELATED
DOCUMENTS FOR ALL CALRECYCLE GRANT
PROGRAMS FOR WHICH THE CITY OF NEWPORT
BEACH IS ELIGIBLE FOR FIVE YEARS
WHEREAS, Public Resources Code sections 42872, 42872.1 and 42873
authorize the Department of Resources Recycling and Recovery ("CalRecycle") to
administer various grant programs in furtherance of the State of California's ("State")
efforts to reduce, recycle and reuse solid waste generated in the State thereby preserving
landfill capacity and protecting public health and the environment,
WHEREAS, in furtherance of this authority, CalRecycle is required to establish
procedures governing the application, awarding, and management of grant programs;
and
WHEREAS, CalRecycle grant application procedures require, among other things,
an applicant's governing body to declare, by resolution, certain authorizations related to
the administration of grant programs.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The City Council does hereby authorize the submittal of applications
and related documents to CalRecycle for any grant programs for which the City of
Newport Beach is eligible (collectively, the "Grants").
Section 2: The City Council does hereby authorize the City Manager, or his
designee, to execute all documents necessary to apply for and secure the Grants and
implement all approved Grants.
Section 3: The authorizations set forth in this resolution are effective for five (5)
years from the date of adoption of this resolution.
Section 4: The recitals provided in this resolution are true and correct and
incorporated into the operative part of this resolution.
Section 5: If any section, subsection, sentence, clause or phrase of this resolution
is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the
validity or constitutionality of the remaining portions of this resolution. The City Council
hereby declares that it would have passed this resolution, and each section, subsection,
sentence, clause or phrase hereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses or phrases be declared invalid or unconstitutional.
Section 6: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the

activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or indirectly.
Section 7: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution.
