Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Lucie Delorme, Administrative Analyst Idelorme(a0ewportbeachca.gov PHONE: 949-644-3394 TITLE: Resolution Certifying Funding Listed in the Federal Transportation Improvement Program (FTIP) ABSTRACT: The Federal Transportation Improvement Program (FTIP) is the primary means of implementing the Regional Transportation Plan through the Orange County Transportation Authority (OCTA) and includes regionally significant projects funded with State and Federal funds. The base FTIP is updated every two years and the 2019 FTIP covers Fiscal Years 2018-19 through 2023-24. OCTA requires the City adopt a resolution certifying that funding listed in current and future city projects is available and committed. RECOMMENDATION: a) Determine that the action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because it will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution 2018-15, A Resolution of the City Council of the City of Newport Beach, California, Certifying that the City of Newport Beach has the Resources to Fund the Projects in the Federal Transportation Improvement Program for Federal Fiscal Years 2018/19 — 2023/24 and Affirming its Commitment to Implement All City Projects in the Program. FUNDING REQUIREMENTS: The current adopted CIP budget includes sufficient funding for the MacArthur Boulevard Pavement Rehabilitation project and the Park Avenue Bridge. Funding for the Newport Beach Bicycle and Pedestrian Bridge project will be included in the Proposed FY18/19 Capital Improvement Program. 7-1 Resolution Certifying Funding Listed in the Federal Transportation Improvement Program (FTIP) March 13, 2018 Page 2 DISCUSSION: The FTIP is a listing of all capital transportation projects proposed over a 6 -year period. Projects include highway improvements, transit, rail and bus facilities, high occupancy vehicle lanes, signal synchronization, intersection improvements, freeway ramps, bike facilities, etc. The OCTA FTIP database includes all projects that are deemed regionally significant, regardless of the funding source and allow local agencies access to view and amend their projects. As part of the 2019 FTIP update, OCTA requires local jurisdictions to adopt a Resolution affirming the City's intent to allocate resources to fund and implement federally funded projects. Currently, the City has three approved improvement projects listed in the FTIP. OCTA recently approved the Newport Beach Bicycle and Pedestrian Bridge project through the Bicycle Corridor Improvement Program (BCIP) with a 20% minimum City match. The recently completed MacArthur Boulevard Pavement Rehabilitation project was partially funded by federal funds through the Arterial Pavement Management program. The recently completed Park Avenue Replacement Bridge project was awarded through a grant from the Federal Highway Administration Highway Bridge Program. The two recently completed projects will remain in the FTIP until all invoices, contractor retentions and reimbursements are settled and the projects closed out. The three projects are further detailed below: 1. Newport Beach Bicycle and Pedestrian Bridge Project — This project, also known as, the Lower Sunset View Park Concept / Overcrossing, provides bicycle and pedestrian access to Sunset Ridge Park and Sunset View Park. 2. MacArthur Boulevard Pavement Rehabilitation Project — This project involved grinding and overlaying MacArthur Boulevard from East Coast Highway to Bonita Canyon Drive with rubberized asphalt concrete. Deteriorated concrete improvements were reconstructed. Construction was partially funded with federal funds as part of the Arterial Pavement Management program. 3. Park Avenue Bridge Over Grand Canal Replacement Project — This project provided for the replacement of the Little Balboa Island Bridge. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENT: Attachment A — Resolution No. 2018-15 7-3 ATTACHMENT A RESOLUTION NO. 2018 -15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, CERTIFYING THAT THE CITY OF NEWPORT BEACH HAS THE RESOURCES TO FUND THE PROJECTS IN THE FEDERAL TRANSPORTATION IMPROVEMENT PROGRAM FOR FEDERAL FISCAL YEARS 2018/19 — 2023/24 AND AFFIRMING ITS COMMITMENT TO IMPLEMENT ALL CITY PROJECTS IN THE PROGRAM WHEREAS, the City of Newport Beach ("City") is located within the metropolitan planning boundaries of the Southern California Association of Governments; WHEREAS, the City Council for the City of Newport Beach has authorized project submittals to the 2017 Orange County Transportation Authority ("OCTA") Federal Transportation Improvement Program ("FTIP") for the MacArthur Boulevard Pavement Rehabilitation Project and the Park Avenue Bridge Replacement Project, which are currently approved and in the FTIP, and OCTA recently approved the City's request for inclusion of the Newport Beach Bicycle and Pedestrian Bridge Project in the FTIP; WHEREAS, by adopting this resolution, the City Council intends to certify that the City has the resources to fund the projects in the FTIP, affirm its commitment to implement the projects in the FTIP, and authorize the submittals of future projects for inclusion in the 2019 FTIP; WHEREAS, the City is the lead agency for projects submitted by the City in the FTIP and will comply with applicable local, state, and federal provisions for the projects, including but not limited to the FTIP, California Environmental Quality Act, National Environmental Policy Act, Americans with Disabilities Act, and Buy America; and WHEREAS, City intends to agree to construct "Transportation Control Measures" for its projects in the FTIP, as noted in the FTIP 2018/19 - 2023/24 Guidelines, as amended, in a timely manner. NOW THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council does hereby certify that the City has the resources to fund the projects in the FTIP, affirm its commitment to implement the projects in the FTIP, and authorize the submittals of future projects for inclusion in the 2019 FTIP. Section 2: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 3: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the 7-4 Resolution No. 2018 - Page 2 of 2 validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 4: The City Council finds the adoption of this resolution is not subject to CEQA pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 5: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution. ADOPTED this 13th day of March 2018.
