AYES: Kleiman, Koetting, Lowrey, Weigand and Zak NOES: None ABSENT: None ABSTAIN: Dunlap, Kramer STUDY SESSION ITEMS ITEM NO. 2 STAFF PRESENTATION: WEBSITE RESOURCES AND STAYING INFORMED SUMMARY: Staff presentation on using the City's News Alerts and other online features to keep informed on current planning applications. ACTION: Study Session conducted, no action taken. PUBLIC HEARING ITEMS ITEM NO. 3 AGAPE ART COLLECTIVE (PA2017-232) Site Location: 365 Old Newport Boulevard SUMMARY: A minor use permit to allow the establishment of a tattoo studio (Personal Services, Restricted Land Use) in conjunction with an artist's studio within an existing commercial tenant space. On February 27, 2018, the Zoning Administrator referred the project to the Planning Commission for consideration. The Planning Commission continued the item to April 5, 2018, due to a noticing e rro r. AYES: Dunlap, Kleiman, Koetting, Kramer, Lowrey, Weigand and Zak NOES: None ABSENT: None ABSTAIN: None ll Planning Commission Agenda Report for March 22, 2017 March 27, 2018 Page 2 ACTION: Item continued to the April 5, 2018 Planning Commission Meeting CONTINUED BUSINESS: ITEM NO. 4 TACO BELL CANTINA CONDITIONAL USE PERMIT (PA2017-198) Site Location: 2121 West Balboa Boulevard SUMMARY: A conditional use permit to allow a food service, eating and drinking establishment, Taco Bell Cantina, with late hours (7 a.m to 2 a.m), and a Type 41 (On Sale Beer and Wine) Alcoholic Beverage Control (ABC) license. Currently a legal nonconforming restaurant use with a Type 40 (On Sale Beer Only) is allowed to operate with no limitaiton of business hours. Tenant improvements for Taco Bell Cantina are currently in progess with an anticipated opening date in mid December. The floor plan includes a dining room with 32 seats. If approved, the restaurant as described requires the owner/operator to obtain an Operator License through the City because of the issuance of a new conditional use permit for a restaurant with alcohol sales operating after 11 p.m., pursuant to NBMC 5.25. The Planning Commission conducted a public hearing approved the project as recommended with modifications to the conditions. AYES: Kleiman, Koetting, Kramer, Lowrey, Weigand and Zak NOES: None ABSENT: None ABSTAIN: None ACTION: Approve as amended ITEM NO. 5 CRAFT BREWERY ORDINANCE (PA2017-181) Site Location: Citywide SUMMARY: An Amendment to the Zoning Code revising the City's regulations related to alcoholic beverage manufacturing. Specifically, the amendment would establish regulations permitting alcoholic beverage manufacturing with tasting rooms in the Industrial Zoning District. The Planning Commission conducted a public hearing and continued the item to the December 7, 2017, meeting for the applicant and staff to consider additional design options. The Planning Commission conducted a public hearing, directed changes to the draft ordinance and recommends adoption of an ordinance to allow alcohol manufacturing with limited tasting rooms in the IG zoning district. Adopt Resolution No. PC2018-011 approving Minor Use Permit No. UP2017-031. IX. Currently a legal nonconforming restaurant use with a Type 40 (On -Sale Beer Only) is allowed to operate with no limitation of business hours. Taco Bell Cantina opened in mid-December and is currently open Sunday - Thursday 7 a.m. to 2 a.m and Friday -Saturday 7 a.m. to 3 a.m. The floor plan includes a dining room with 32 seats. If approved, the restaurant as proposed requires the owner/operator to obtain an Operator License through the City because of the issuance of a new conditional use permit for a restaurant with alcohol sales operating after 11 p.m., pursuant to Newport Beach Municipal Code (NBMC) 5.25. Recommended Action: Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 under Class 1 (Existing Facilities) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; and 3. Adopt Resolution No. PC2018-012 approving Conditional Use Permit No. UP2017-028 (Attachment No. PC 1). ITEM NO. 5 CRAFT BREWERY ORDINANCE (PA2017-181) Site Location: Citywide Summary: An amendment to the Zoning Code revising the City's regulations related to alcoholic beverage manufacturing. Specifically, the amendment would establish regulations permitting alcoholic beverage manufacturing with tasting rooms in the Industrial Zoning District. Recommended Action: Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15305 (Minor Alterations in Land Use Limitations), because it has no potential to have a significant effect on the environment; and 3. Adopt Resolution No. PC2018-010 recommending the City Council approve Zoning Code Amendment CA2017-004. X.
