Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: John Kappeler, Senior Civil Engineer, jkappeler@newportbeachca.gov PHONE: 949-644-3218 TITLE: Bayview Heights Drainage Project — Award of Contract No. 7109-1 (15X11) ABSTRACT: Staff has received construction bids for Bayview Heights Drainage Project and requests City Council approval to award the construction contract to Jeremy Harris Construction, Inc. (Jeremy Harris Construction) of Riverside, California. RECOMMENDATIONS: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15333 (Small Habitat Restoration Projects) and Section 15304 (Class 4 Minor Alterations to Land) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; b) Approve the project drawings and specifications; c) Award Contract No. 7109-1 to Jeremy Harris Construction for the total bid amount of $313,874.70, and authorize the Mayor and City Clerk to execute the contract; d) Establish a contingency of $31,300.00 (approximately 10% of Total Bid) to cover the cost of unforeseen work not included in the original contract; and e) Approve Budget Amendment No. 18BA-038 transferring $77,000.00 from project savings from Account No. 10001-980000-15H19 (Tidegate Retrofit Project) to Account No. 10001-980000-15X11 for the Bayview Heights Drainage Project. FUNDING REQUIREMENTS: Upon approval of the proposed budget amendment, sufficient funding is available for the award of this contract. Jeremy Harris Construction possesses a California State General Building "A" Contractors License and one of its Subcontractors, possess a "Class C-27" License, as required by the project specifications, and has satisfactorily completed similar grading and pipeline projects for other local agencies. Pursuant to the contract specifications, Jeremy Harris Construction is allotted 120 Calendar days to complete the work. Liquidated damages in the amount of $500.00 per calendar day will be assessed in case of tardy completion. This project includes installation of 520 linear feet of 24 -inch reinforced concrete pipe from Mesa Drive to a vegetated basin designed for energy dissipation and to improve water quality. Eroded areas will be filled and the hillside slope revegetated to provide erosion protection. Proposed improvements at the upper end of the project will be constructed within easements that have been granted by the owners on two residential properties (2600 and 2612 Mesa Drive) with the improvements on the lower end of the project constructed on property owned by County of Orange and State of California. At that time, the Coastal Commission also reaffirmed the CEQA finding for the project. Construction is expected to start this summer and be substantially complete in the Fall. Staff is expecting to work closely with the regulatory agencies during the construction and anticipates the need for professional biological monitoring which will be performed under a separate agreement. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15333 (Small Habitat Restoration Projects) and Section 15304 (Class 4 Minor Alterations to Land) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
