Based on strategies adopted as part of the 2015-2019 Consolidated Plan, the 2018-2019 Action Plan will appropriate approximately $370,685 of CDBG funds to specific programs and projects. RECOMMENDATION: a) Conduct a public hearing to receive comments on the Action Plan; b) Find the approval of 2018-2019 Action Plan exempt from the National Environmental Policy Act (NEPA) pursuant to 24 CFR Part 58, Section 58.34; c) Find the approval of 2018-2019 Action Plan exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly; d) Adopt Resolution No. 2018-37, A Resolution of the City Council of the City of Newport Beach, California, Approving the 2018-2019 Action Plan for the Allocation of the Federal Community Development Block Grant for the 2018-2019 Fiscal Year, and e) Authorize the City Manager to: 1) Adjust appropriations to specific programs and projects as necessary to conform with the final 2018-2019 formula grant allocation of CDBG funds from HUD; 2) Execute all necessary agreements and documents as per the adopted resolution; and 3) Implement the program on behalf of the City. 22-1 Community Development Block Grant — 2018-2019 Action Plan June 12, 2018 Page 2 FUNDING REQUIREMENTS: This item provides for City Council approval of the use of an estimated $370,685.41 of CDBG funds for the 2018-2019 fiscal year, to be adjusted by the City Manager as necessary to conform with the final 2018-2019 formula grant allocation from HUD. The costs associated with staff management of the CDBG program are approximately $17,000 per year and sufficient staff resources will be budgeted with the City's FY2018-2019 General Fund Budget. The objective of the CDBG program is to develop viable urban communities by providing decent housing and a suitable living environment, and by expanding economic opportunities, principally for low and moderate - income persons. CDBG is authorized under Title I of the Housing and Community Development Act of 1974. CDBG funds may be used for a wide variety of programs, services and facilities improvements, including but not limited to: • Community and senior services • Fair housing enforcement and landlord/tenant mediation • Homeless prevention and domestic violence programs • Public facilities and infrastructure improvements • Disabled (ADA) accessibility improvements • Housing programs • Section 108 loan payments Since July 1, 1989, the City of Newport Beach has received total direct allocation of approximately $12.4 million CDBG funds from HUD with annual allocations ranging from a low of $319,676 in 2017, to a high of $534,000 in 1995. The 2018-2019 formula grant allocation is estimated to be $358,444. According to CDBG regulations, the City may spend up to 20 percent of the annual formula grant allocation of CDBG funds for program administration and 15 percent for community services such as senior meal delivery, senior services or homeless prevention programs. The remaining amount of funding may be used for projects such as street and sidewalk improvements, disabled accessibility improvements, public facilities improvements such as the construction or rehabilitation of park and recreational facilities provided the projects meet applicable CDBG regulations and national objectives. 22-2 Community Development Block Grant — 2018-2019 Action Plan June 12, 2018 Page 3 Each year, the City uses a portion of the funds reserved for program administration to comply with Fair Housing Act requirements and make fair housing enforcement and landlord/tenant mediation services available to the community. These services have been provided free of cost to Newport Beach residents by the Fair Housing Foundation since 2011. On January 13, 2018, the City published a Notice of Funding Availability (NOFA) in the Daily Pilot newspaper to announce the availability of CDBG funds and solicit proposals from tax- exempt, nonprofit organizations that provide eligible CDBG services or projects that benefit Newport Beach residents. The notice and application form were also available on the City website. In response to the NOFA, six (6) nonprofit organizations submitted applications for CDBG grants. In consideration of the amount of public service funding available and the amount of public service funding requested, staff recommends fully funding the requests of the three (3) existing public service providers serving senior citizens and persons experiencing homelessness, and partially funding one (1) new provider of supportive services and job training for recovering addicts. Funding for Second Chance Orange County, the next highest rated applicant, became possible when HUD announced the final formula grant allocations in early May, creating an additional $6,266.60 under the 15 percent public service cap. As a result, the original version of the draft 2018-2019 Action Plan was pulled from public review, revised and re -posted for a 30 day public review and comment period. 22-3 Community Development Block Grant — 2018-2019 Action Plan June 12, 2018 Page 4 The past levels of performance of the existing three (3) service providers was a key factor considered by the staff tasked with reviewing applications and formulating funding recommendations for City Council consideration. Staff did not recommend funding the one (1) remaining new public service applicant because doing so would preclude the City's ability to fully -fund the requests of the three (3) existing providers. Staff did not recommend CDBG funding for a specific Capital Project other than for Section 108 Loan Repayment because there were no applicants for the available $55,427.60. In prior years, the Public Works Department has applied for funding for public facilities and infrastructure projects and there have been applications from other City Departments for other housing and community development activities. The $55,427.60 and unallocated balance of $12,241.41 from Fiscal Year 2017-2018 may be carried forward to the 2019-2020 Action Plan and may be appropriated to a new project at that time. Each of the programs/projects recommended by staff for CDBG funding in the Draft Action Plan are eligible for CDBG funding, meet the national objective of serving low- and moderate -income people and are contemplated within the Strategic Plan priorities of the 2015-2019 Consolidated Plan. On May 11, 2018, staff published a revised notice in the Daily Pilot informing the general public that the City of Newport Beach had prepared the Draft 2018-2019 Action Plan. The notice also indicated the plan would be available for review and comment until June 12, 2018. The public has been provided an opportunity to provide oral and/or written comments on the proposed activities included in the Draft 2018-2019 Action Plan. At the time this report was prepared, no public comments have been received. Additionally, the current Citizen Participation Plan requires that a public hearing be held to receive testimony from interested residents or parties regarding the Action Plan. The June 12, 2018, public hearing fulfills this requirement. ENVIRONMENTAL REVIEW: The development of required plans and allocation of CDBG program funds is an administrative activity exempt under 24 CFR Part 58, Section 58.34 of the National Environmental Policy Act of 1969 ("NEPA"), as amended. Staff recommends the City Council find the adoption of the 2018-2019 Action Plan is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. 22-4 Community Development Block Grant — 2018-2019 Action Plan June 12, 2018 Page 5 NOTICING: In accordance with HUD requirements for a 30 -day public review and comment period, notice of the public hearing was published in the Daily Pilot on May 11, 2018. Notice was also sent to each of the applicants requesting funding and emailed to all parties that have signed up to receive notifications of the Planning Division. Further, the agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENT: Attachment A — Resolution No. 2018-37 (2018-2019 Action Plan included) 22-5 Attachment A Resolution No. 2018-37 Approving the 2018-2019 Action Plan for the Allocation of the Federal Community Development Block Grant for the 2018-2019 Fiscal Year 22-6 RESOLUTION NO. 2018- 37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, APPROVING THE 2018- 2019 ACTION PLAN FOR THE ALLOCATION OF THE FEDERAL COMMUNITY DEVELOMENT BLOCK GRANT FOR THE 2018-2019 FISCAL YEAR WHEREAS, the City of Newport Beach ("City") participates in the United States Department of Housing and Urban Development's ("HUD") Community Development Block Grant ("CDBG") program; WHEREAS, HUD requires the City to prepare a Five Year Consolidated Plan for the use of HUD grant programs outlining the use of the CDBG and the strategic vision for housing and community development in the City, WHEREAS, the current 2015-2019 Consolidated Plan was adopted on May 12, 2015, and was amended on May 9, 2017; WHEREAS, HUD also requires the City to prepare an annual Action Plan for the appropriation of the CDBG annual grant and other available grant funds during any given fiscal year; WHEREAS, the City anticipates receiving approximately $358,444.00 in grant funds for the 2018-2019 Fiscal Year and will have an additional $12,241.00 in unallocated funds and program income to spend during the year; the draft 2018-2019 Action Plan appropriates these funds to various programs and projects consistent with the amended 2015-2019 Consolidated Plan and HUD requirements; WHEREAS, on January 13, 2018, a Notice of Funding Availability was published in the Daily Pilot newspaper and sent to known non-profit community organizations currently operating within the City requesting proposals from non-profit organizations to provide public services to low- and moderate -income residents within the City and to provide fair housing services to all residents of the community; WHEREAS, five (5) proposals to provide public services and one (1) proposal to provide fair housing services were received by the City; WHEREAS, the City prepared the 2018-2019 Action Plan in accordance with applicable sections of 24 Code of Federal Regulation Part 91; WHEREAS, on May 11, 2018, a public notice was published in the Daily Pilot newspaper indicating that the draft 2018-2019 Action Plan would be available to the public for review and comment from May 11, 2018, to June 12, 2018; and 22-7 Resolution No. 2018 - Page 2 of 3 WHEREAS, on June 12, 2018, the City Council conducted a public hearing regarding the draft 2018-2019 Action Plan and a notice of this public hearing was published in the Daily Pilot on May 11, 2018, consistent with requirements of the City's Citizen Participation Plan. NOW THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: Section 1: The City Council finds that the development of required plans and allocation of CDBG program funds is an administrative activity exempt under 24 CFR Part 58, Section 58.34 of the National Environmental Policy Act of 1969 ("NEPA"), as amended. Section 2: The City Council approves the 2018-2019 Action Plan attached as Exhibit A of this resolution, which is incorporated herein by reference. Section 3: The City Council authorizes the City Manager, or his/her designee, to: 1) Proportionally adjust appropriations to specific programs and projects as necessary to conform with the final 2018-2019 formula grant allocation of CDBG funds from HUD if the appropriation is more than $358,444.00 or less than $358,444.00; 2) Submit the 2018- 2019 Action Plan to HUD; 3) Execute the Fiscal Year 2018-2019 CDBG Program Grant Agreement and all related documents on behalf of the City; 4) Execute all subrecipient agreements with the nonprofit organizations receiving allocations of CDBG funds in the Action Plan; and 5) Authorize the Community Development Department Director, or his/her designee, to be the official representative of the City to administer the program and submit required environmental documentation to HUD for CDBG projects. Section 4: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 5: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. Introduction The 2018-2019 Action Plan is the fourth of five annual plans implementing the 2015-2019 Consolidated Plan Strategic Plan goals for the investment of annual allocations of Community Development Block Grant (CDBG) funds from the U.S. Department of Housing and Urban Development (HUD). The Action Plan identifies available resources, annual goals, projects and activities for the period beginning July 1, 2018 and ending June 30, 2019. The City of Newport Beach (City) receives CDBG funds from HUD on a formula basis each year, and in turn, awards grants to nonprofit, for-profit or public organizations for programs and projects in furtherance of the Strategic Plan. The CDBG program generally provides for a range of eligible activities which benefit low- and moderate -income Newport Beach residents, as discussed below. Community Development Block Grant (CDBG) The Housing and Community Development Act of 1974 created the CDBG Program with three primary objectives against which HUD evaluates the Consolidated Plan and the City's performance under the Plan. Those primary objectives are decent housing, suitable living environments, and expanded economic opportunities for low- and moderate -income persons. The CDBG regulations require that each activity meet one of the following national objectives: • Benefit low- and moderate -income persons; • Aid in the prevention or elimination of slums and blight; or • Meet other community development needs having a particular urgency (usually the result of a natural disaster). For the 2018-2019 program year, the City will receive $358,444 of CDBG funds from HUD. When this amount is combined with prior year unallocated funds and program income received, a total of $370,685 is available in the Action Plan. Table 1 provides the amount of CDBG funds available for the 2018-2019 program year. Evaluation of past performance The City is currently implementing the activities included in the 2017-2018 Action Plan. As of this writing, all activities are underway. The investment of HUD resources during the 2016-2017 program year was a catalyst for positive change in the community. Together with other federal, state and local investments, HUD resources allowed the City and its partners to accomplish the following goals: • Provide Fair Housing services to 123 residents; • Provide Public Services to 124 residents; • Provide Special Needs to 7 residents; • Provide Homelessness Prevention and Assistance to 202 residents; and • Make the scheduled debt service payments on the City's Section 108 Loan. 4. Summary of citizen participation process and consultation process 2015-2019 Citizen Participation Plan Subsequent to the enactment of the Homeless Emergency Assistance and Rapid Transition to Housing (HEARTH) Act of 2009, HUD revised the Consolidated Plan regulations at 24 CFR Part 91 to emphasize the importance of citizen participation and consultation in the development of the Consolidated Plan. HUD strengthened the consultation process with requirements for consultation with the Continuum of Care of Orange County (CoC), Public Housing Authorities (PHA), business leaders, civic leaders and public or private agencies that address housing, health, social service, victim services, employment, or education needs of low-income individuals and families, homeless individuals and families, youth and/or other persons with special needs. Together with the analytic capabilities of the eCon Plan Suite, these requirements created the conditions necessary to implement a collaborative, data -driven and place -based planning process that includes a robust level of citizen participation and consultation. The City adopted its current Citizen Participation Plan on May 12, 2015 that reflects regulatory changes and process improvements. In accordance with the City's adopted Citizen Participation Plan, the City facilitated citizen participation through surveys, community meetings and public hearings. Efforts were made to encourage participation by low- and moderate -income persons, particularly those living in areas and in areas where HUD funds are proposed to be used, and by residents of predominantly low- and moderate -income neighborhoods. The consultation process included representatives of the CoC, PHA, and other specified groups who completed surveys, provided local data and assisted the City to ensure practical coordination of strategies to maximize impact and to avoid duplication of effort. The draft Action Plan was available for public review and comment from May 11, 2018 to June 12, 2018. S. Summary of public comments 2018-2019 Action Plan The City received [to be inserted after CC meeting] public comments during the Public Hearing meeting held on June 12, 2018: • [comments to be added after CC meeting] • [comments to be added after CC meeting] 2015-2019 Consolidated Plan In the development of the Consolidated Plan, the City convened a community meeting to discuss the housing and community development needs in the community on February 26, 2015 at the Newport Beach Civic Center. Community residents and stakeholders attended the meeting and received a presentation on the importance of the Consolidated Plan, Action Plan and the Analysis of Impediments to Fair Housing Choice. Many questions were answered concerning each of the planning documents and participants commented on the extensive efforts made to reach out to the low- and moderate -income community through traditional methods such as newspaper advertisements and flyers distributed to affordable housing sites, senior community centers, libraries, and other public places as well as new technology-based methods such as the City's News Splash email newsletter and the city website. A community meeting/hearing to discuss the housing and community development needs in Newport Beach was held on February 26, 2015 at the Community Room in the Newport Beach Civic Center. Participants and staff discussed the CDBG program and attendees were encouraged to complete the City's 2015-2019 Consolidated Plan Needs Assessment Survey. A public hearing to receive comments on the draft 2015-2019 Consolidated Plan was held before the Newport Beach City Council on May 12, 2015. One public comment was received during the public hearing prior to the adoption of the Consolidated Plan: DRAFT 2018-2019 Action Plan CITY OF NEWPORT BEACH 6 OMB Control No: 2506-0117 (exp. 06/30/18) 22-16 • Jim Mosher, who summarized his understanding of the Consolidated Plan, Action Plan and Citizen Participation Plan and pointed out the importance of the Citizen Participation Plan and citizen involvement in the grants planning process. 6. Summary of comments or views not accepted and the reasons for not accepting them All comments and views received by the City in the development and approval of the Consolidated Plan and Action Plan were accepted and taken into consideration. 7. Introduction As a component of the Consolidated Plan process, the City of Newport Beach consulted with representatives from multiple agencies, groups, and organizations involved in the development of affordable housing, creation of job opportunities for low- and moderate -income residents, and/or provision of services to children, elderly persons, persons with disabilities, persons with HIV/AIDS and their families, and homeless persons. Orange County's homeless system of care is comprised of a network of public, private, faith - based, for-profit, and nonprofit service providers who utilize several federal, state and local resources to provide services for homeless people. The region's municipalities, including the City of Newport Beach, also provide resources for services that assist the homeless and those at risk of becoming homeless. The County's nonprofit community plays a key role in the Continuum of Care system. Hundreds of agencies throughout the County provide programs ranging from feeding the homeless on the street to creating permanent supportive housing opportunities. These services are available to homeless families with children, and single men and women. The County's nonprofit community also serves special needs populations, such as victims of domestic violence, veterans, the disabled and youth. The CoC guides the development of homeless strategies and the implementation of programs to end homelessness throughout the region. The City provided a detailed questionnaire to the CoC to identify the CoC's perceived needs in the county and its objectives to address the needs of different homeless populations, specifically chronically homeless families and individuals, families with children, veterans, unaccompanied youth and persons at risk of homelessness. Following the delivery and response to this questionnaire, the City followed up with the CoC to clarify existing needs and objectives and understand opportunities for collaboration and coordination during the five-year planning process. The Orange County Continuum of Care was consulted directly by telephone and e-mail to discuss performance standards, outcomes, and policies and procedures for HMIS. DRAFT 2018-2019 Action Plan CITY OF NEWPORT BEACH 45 OMB Control No: 2506-0117 (exp. 06/30/2018) 22-55 AP -55 Affordable Housing — 91.220(g) Introduction As stated in the Consolidated Plan, the City of Newport Beach will continue its efforts to leverage other funding sources such as the Affordable Housing Trust Fund to address the local housing needs identified below. Expand the Supply of Affordable Housing Based on evaluation of 2007-2011 ACS and CHAS data, there is a need for additional rental housing units affordable for households earning less than 50 percent of AMI. Of the households earning 0-80 percent of AMI, 7,790 are cost burdened households — meaning households paying more than 30 percent of their income for housing. Additionally, 5,805 of the cost burdened households are considered severely cost burdened households — meaning that they pay more than 50 percent of their income for housing. Of the 5,805 severely cost burdened households, 3,580 are renters. Of those severely cost burdened renter households, 2,945 households earn less than 50 percent of AMI and are considered the most at risk of becoming homeless. The City will continue to use its Affordable Housing Trust Fund and other available options under the State Density Bonus law to create additional affordable housing. In February 2013, the City approved the Uptown Newport Planned Community consisting of 1,244 units that included the requirement to construct affordable housing pursuant to State Density Bonus Law. In April 2017, the City issued building permit for the first 462 units that include 92 units for very -low income households. The California Statewide Community Development Authority (CSCDA) has issued $161,620,000 in tax-exempt and taxable multifamily affordable housing bonds that will ensure the affordability for 55 years. The project construction will take approximately 2 years. Preserve the Supply of Affordable Housing As the City's housing stock ages, a growing percentage of housing units may need rehabilitation to allow them to remain safe and habitable. The situation is of particular concern for low- and moderate -income homeowners who are generally not in a financial position to properly maintain their homes. The age and condition of Newport Beach's housing stock is an important indicator of potential rehabilitation needs. Commonly, housing over 15 years of age will exhibit deficiencies in terms of paint, weatherization, heating / air-conditioning systems, hot water heaters and finish plumbing fixtures. Housing over 30 years of age will typically some form of major rehabilitation, such as roof replacement, foundation work and plumbing systems. DRAFT 2018-2019 Action Plan CITY OF NEWPORT BEACH 46 OMB Control No: 2506-0117 (exp. 06/30/2018) 22-56 According to CHAS data showing the year that housing units were built categorized by owner and renter tenure: • 5,363 or 26 percent of the 20,950 owner -occupied housing units built between 15 and 34 years ago (built between 1980 and 1999). • 12,619 or 61 percent of the 20,950 owner -occupied housing units in Newport Beach were built 34 or more years ago (built prior to 1980). • 3,934 or 23 percent of the 17,098 renter -occupied housing units in Newport Beach were built between 15 and 34 years ago (built between 1980 and 1999). • 11,655 or 68 percent of the 17,098 renter -occupied housing units in Newport Beach were built 34 or more years ago (built prior to 1980). Preservation of the physical and functional integrity of existing housing units occupied by low - and moderate -income households is a cost-effective way to invest limited resources to retain existing housing units that are already affordable to low- and moderate -income households in the community. Addressing substandard housing conditions through housing preservation activities ensures that all economic segments of the community have the opportunity to live in decent housing that meets local standards. The Cove Apartments was fully occupied as of March 2018 and will continue to be rented affordably for a period of 55 years, with priority for occupancy directed toward low- income seniors and veterans. To preserve affordable housing, the City awarded $1,600,000 of Affordable Housing Trust Funds to Seaview Lutheran Plaza for the rehabilitation of 100 existing apartments for senior citizens, extending the project's affordability period an additional 30 years. On July 26, 2016, the City and Seaview Lutheran entered into an affordable housing grant agreement for the first $800,000 of the award for upgrades to existing bathrooms. The design and permits were approved late 2016 and construction was underway throughout 2017. By the end of 2017, 60 of the 100 units were complete, with the balance of units anticipated to be complete in 2018. The remaining $800,000 will be provided in the form of a loan for kitchen upgrades. As a result of this award, the affordability requirements will remain in place through 2069. To preserve housing that is affordable to current owner -occupants, the City created a Senior Housing Assistance Repair Program (SHARP) in 2016, operated in partnership with Habitat for Humanity Orange County (Habitat OC). Initial program funding of up to $600,000 was granted by the City Council from the City's Affordable Housing Trust Fund. This two-year program to perform critical home repairs for lower-income seniors was extended for an additional two years so that assistance will be available into 2020. To date, seven projects have been approved and two applications were denied. Of the seven total projects, four have been completed at a total cost of $129,897. As of this writing, three applications are under contract for rehabilitation and two additional projects are in the application phase. The scope of work for SHARP projects generally includes some combination of the following repairs: roofing, painting, plumbing, electrical, structural/accessibility (repairing and modifying hazardous steps and landings), landscaping (when in violation of City codes), installation of smoke detectors and addressing "hoarding" conditions. It is anticipated that the City (OASIS Senior Center) and Habitat OC will complete three additional projects in the coming program year. The City of Newport Beach is registered as a Qualified Preservation Entity with the California Department of Housing and Community Development (HCD). When notification is received of the expiration of a prior affordable housing agreement—whether monitored by the City or as part of a different affordable housing program not sponsored by the City—staff evaluates the potential use of local Affordable Housing Trust funds to preserve the affordable units, subject to funding availability. Newport Beach is within the service area of the Orange County Housing Authority (OCHA) for the purposes of Section 8 and Public Housing. As of January 2018, OCHA administered a total of 9,794 housing vouchers throughout the County. The 145 housing vouchers in use in the City of Newport Beach include: • 14 Veterans Affairs Supportive Housing (VASH) vouchers; • 3 Continuum of Care Program Permanent Supportive Housing Certificates; • 3 Family Unification Program vouchers; and • 125 Housing Choice Vouchers (Section 8). OCHA monitors all units to ensure they are in adequate condition, meeting the Section 8 Housing Quality Standards (HQS). Actions planned during the next year to address the needs to public housing OCHA's stated goals include: • Apply for additional housing assistance funding and programs that may become available. • Explore the use of Project -Based Housing Choice Vouchers or other housing funds to promote the construction or acquisition activities that will result in additional units or developments that will serve special needs populations. • Ensure consistent quality of assisted housing services by maintaining high performer status in Section Eight Management Assessment Program (SEMAP) scores. • Promote Family Self -Sufficiency incentives and homeownership opportunities for Housing Choice Voucher participants in partnership with local programs and related service providers. • Expand assisted housing choices by conducting outreach efforts to increase the number of property owners and their participation in housing assistance programs. • Identify and utilize technology to enhance operational effectiveness and efficiency in delivery of housing assistance services. Housing prices in Orange County are so high that homeownership opportunities are limited for OCHA residents. On a limited basis, OCHA has partnered with Habitat for Humanity to provide two affordable homeownership units, but these types of efforts are limited. OCHA also manages a Housing Choice Voucher Homeownership Program that it markets to all OCHA program tenants. If the PHA is designated as troubled, describe the manner in which financial assistance will be provided or other assistance Not applicable. OCHA is designated as a High Performing PHA. Discussion Newport Beach continues to support OCHA in effective administration of its limited affordable housing resources. The City also continues to work with OCHA to include the residents with Section 8 Housing Choice Vouchers in the federally -funded programs administered by the City, including any homeownership programs. DRAFT 2018-2019 Action Plan CITY OF NEWPORT BEACH 50 OMB Control No: 2506-0117 (exp. 06/30/2018) 22-60 AP -65 Homeless and Other Special Needs Activities — 91.220(i) Introduction The City will invest CDBG funds during the 2018-2019 program year to address high priority needs identified in the 2015-2019 Consolidated Plan including preventing homelessness and providing public services to homeless populations. Homelessness Prevention Services According to the most recent bi-annual Point -In -Time Homeless Count (PIT Count) data available from the PIT Count held on January 28, 2017, on any given night in Orange County, approximately 4,792 people are homeless. To address incidences of homelessness that may occur in Newport Beach and to prevent extremely low-income families from becoming homeless, the City places a high priority on programs that work to prevent homelessness or rapidly assist homeless individuals living in the community. To address this need, the City will support CDBG public service activities that help prevent homelessness and that provide a structured path to stable housing for individuals and families who become homeless. Services for Residents with Special Needs Analysis of available data and consultation with organizations providing services for special needs populations revealed a high need for a range of additional services including, but not limited to, those concerned with domestic violence, human trafficking, mental disabilities, physical disabilities, developmental disabilities, substance abuse/alcoholism and HIV/AIDS. To address the needs of those residents addicted to drugs and/or alcohol, the City is providing CDBG funds to the following activity: • Second Chance Orange County: More Second Chances for Those in Recovery (9 people) Describe the jurisdictions one-year goals and actions for reducing and ending homelessness including reaching out to homeless persons (especially unsheltered persons) and assessing their individual needs To reach out to unsheltered homeless persons and assess their individual needs for the purpose of connecting them with available emergency shelter and transitional housing resources, the City of Newport Beach, through its Planning Division will provide information and referrals — primarily to 2-1-1 Orange County. Additionally, to reduce and end homelessness, the City of Newport Beach will provide CDBG public service funds to the following activity: • Families Forward: Housing Program (215 people) DRAFT 2018-2019 Action Plan CITY OF NEWPORT BEACH 51 OMB Control No: 2506-0117 (exp. 06/30/2018) 22-61 Addressing the emergency shelter and transitional housing needs of homeless persons To address the emergency shelter and transitional housing needs of homeless persons, the City supports the Families Forward Housing Program that provides transitional housing, counseling and case management to families at risk of homelessness. Each year, Families Forward serves approximately 215 unduplicated people with an array of services beyond housing, including career services, childcare and a food pantry. Families Forward continues to grow its partnerships with affordable housing developers throughout Orange County, securing access to affordable housing units while providing the supportive case management services necessary to ensure a long-term stable housing outcome for its clients. Other organizations in the Continuum of Care (CoC) addressing the emergency shelter and transitional housing needs of homeless persons include Orange Coast Interfaith Shelter, Orange County Rescue Mission and WISE Place. Helping homeless persons (especially chronically homeless individuals and families, families with children, veterans and their families, and unaccompanied youth) make the transition to permanent housing and independent living, including shortening the period of time that individuals and families experience homelessness, facilitating access for homeless individuals and families to affordable housing units, and preventing individuals and families who were recently homeless from becoming homeless again To address the needs of homeless families, families with children, veterans and their families, the City supports the Families Forward Housing Program, which provides transitional housing, counseling and case management to families at risk of homelessness. Each year, Families Forward serves approximately 215 unduplicated people through its transitional housing program. When paired with financial counseling, career coaching and other available case management services, Families Forward makes certain that families are ready to succeed in their transition to permanent housing. Helping low-income individuals and families avoid becoming homeless, especially extremely low-income individuals and families and those who are: being discharged from publicly funded institutions and systems of care (such as health care facilities, mental health facilities, foster care and other youth facilities, and corrections programs and institutions); or, receiving assistance from public or private agencies that address housing, health, social services, employment, education, or youth needs The Orange County CoC Ten Year Plan to End Homelessness included a goal to establish countywide protocols and procedures to prevent people from being discharged from public and private institutions of care into homelessness that will help decrease the number of persons DRAFT 2018-2019 Action Plan CITY OF NEWPORT BEACH 52 OMB Control No: 2506-0117 (exp. 06/30/2018) 22-62 being discharged into homelessness. The CoC is seeking improve coordination among publicly and privately funded institutions of care and local service agencies in the County of Orange in order to decrease the number of persons being discharged into homelessness annually. Discussion The City of Newport Beach considers addressing homelessness a high priority need for the CDBG program and will support public service activities that help prevent homelessness and that provide a structured path to stable housing for individuals and families who become homeless. DRAFT 2018-2019 Action Plan CITY OF NEWPORT BEACH 53 OMB Control No: 2506-0117 (exp. 06/30/2018) 22-63 AP -75 Barriers to affordable housing — 91.220(j) Introduction: A barrier to affordable housing is a public policy or nongovernmental condition that constrains the development or rehabilitation of affordable housing, such as land use controls, property taxes, state prevailing wage requirements, environmental protection, cost of land and availability of monetary resources. Barriers to affordable housing are distinguished from impediments to fair housing choice in the sense that barriers are lawful and impediments to fair housing choice are usually unlawful. Based on information gathered during community meetings, the Consolidated Plan Needs Assessment Survey, the 2014-2021 Housing Element and market analysis, the primary barriers to affordable housing in Newport Beach are housing affordability and the lack of monetary resources necessary to develop and sustain affordable housing. The two barriers are related in the sense that demand for affordable housing exceeds the supply and insufficient resources are available to increase the supply of affordable housing to meet demand. For low- and moderate -income households, finding and maintaining decent affordable housing is difficult due to the high cost of housing in Newport Beach and throughout the region in general. Over 20 percent of the City's 38,048 households experience a cost burden or severe cost burden, meaning that they pay more than 30 or 50 percent of their income for housing, respectively. Consistent with available data, responses to the 2015-2019 Consolidated Plan Needs Assessment Survey indicate a high need for additional affordable housing in Newport Beach. Actions it planned to remove or ameliorate the negative effects of public policies that serve as barriers to affordable housing such as land use controls, tax policies affecting land, zoning ordinances, building codes, fees and charges, growth limitations, and policies affecting the return on residential investment In the development of the 2014-2021 Housing Element, the City evaluated significant public policies affecting affordable housing development such as land use controls, tax policies affecting land, zoning ordinances, building codes, fees and charges and growth limitations. Based on this evaluation, the City determined that it has taken all appropriate and necessary steps to ameliorate the negative effects of public policies that may have been a barrier to affordable housing. Moreover, the City will continue to use its Affordable Housing Trust Fund to fund future affordable housing projects. DRAFT 2018-2019 Action Plan CITY OF NEWPORT BEACH 55 OMB Control No: 2506-0117 (exp. 06/30/2018) 22-65 AP -85 Other Actions — 91.220(k) Introduction: In the implementation of the 2018-2019 Annual Action Plan, the City will invest CDBG resources to address obstacles to meeting underserved needs, reduce the number of poverty -level families, develop institutional structure and enhance coordination between public and private social service agencies. Actions planned to address obstacles to meeting underserved needs The primary obstacles to meeting the underserved needs of low- and moderate -income people include lack of funding from federal, state and other local sources, and the high cost of housing that is not affordable to low-income people. To address these obstacles, the City is investing CDBG funds through the 2018-2019 Action Plan in projects that provide assistance to those with special needs, projects that prevent homelessness for low- and moderate -income residents. To address underserved needs, the City is allocating 100 percent of its non- administrative CDBG investments for program year 2018-2019 to projects and activities that benefit low- and moderate -income people or people presumed under HUD regulations to be low- and moderate -income. Actions planned to foster and maintain affordable housing To expand the supply of affordable housing, the City awarded $1,975,000 of Affordable Housing Trust Funds to Newport Veterans Housing, LP to acquire and rehabilitate 12 former market rate rental units. The Cove Apartments was fully occupied as of March 2018 and will continue to be rented affordably for a period of 55 years, with priority for occupancy directed toward low- income seniors and veterans. To preserve affordable housing, the City awarded $1,600,000 of Affordable Housing Trust Funds to Seaview Lutheran Plaza for the rehabilitation of 100 existing apartments for senior citizens, extending the project's affordability period an additional 30 years. On July 26, 2016, the City and Seaview Lutheran entered into an affordable housing grant agreement for the first $800,000 of the award for upgrades to existing bathrooms. The design and permits were approved late 2016 and construction was underway throughout 2017. By the end of 2017, 60 of the 100 units were complete, with the balance of units anticipated to be complete in 2018. The remaining $800,000 will be provided in the form of a loan for kitchen upgrades. As a result of this award, the affordability requirements will remain in place through 2069. To preserve housing that is affordable to current owner -occupants, the City created a Senior DRAFT 2018-2019 Action Plan CITY OF NEWPORT BEACH 56 OMB Control No: 2506-0117 (exp. 06/30/2018) 22-66 Housing Assistance Repair Program (SHARP) in 2016, operated in partnership with Habitat for Humanity Orange County (Habitat OC). Initial program funding of up to $600,000 was granted by the City Council from the City's Affordable Housing Trust Fund. This two-year program to perform critical home repairs for lower-income seniors was extended for an additional two years so that assistance will be available into 2020. To date, seven projects have been approved and two applications were denied. Of the seven total projects, four have been completed at a total cost of $129,897. As of this writing, three applications are under contract for rehabilitation and two additional projects are in the application phase. The scope of work for SHARP projects generally includes some combination of the following repairs: roofing, painting, plumbing, electrical, structural/accessibility (repairing and modifying hazardous steps and landings), landscaping (when in violation of City codes), installation of smoke detectors and addressing "hoarding" conditions. It is anticipated that the City (OASIS Senior Center) and Habitat OC will complete three additional projects in the coming program year. The City of Newport Beach is registered as a Qualified Preservation Entity with the California Department of Housing and Community Development (HCD). When notification is received of the expiration of a prior affordable housing agreement—whether monitored by the City or as part of a different affordable housing program not sponsored by the City—staff evaluates the potential use of local Affordable Housing Trust funds to preserve the affordable units, subject to funding availability. The City also continues to consider Density Bonuses and other incentives on a project -by - project basis to encourage the construction of housing for persons and families of very low, low, and moderate income. Actions planned to reduce lead-based paint hazards In the implementation of any future Residential Rehabilitation Programs, the City will disseminate brochures provided by the U.S. Environmental Protection Agency to all applicants as part of the transmittal of the program application. Any unit receiving assistance through the program that was built prior to January 1, 1978 will be tested for lead-based paint. If lead-based paint is present, appropriate abatement procedures are implemented as part of the rehabilitation contract consistent with the requirements of 24 CFR Part 35. Actions planned to reduce the number of poverty -level families The implementation of CDBG activities meeting the goals established in the 2015-2019 Consolidated Plan -Strategic Plan and this Annual Action Plan will help to reduce the number of poverty -level families by: DRAFT 2018-2019 Action Plan CITY OF NEWPORT BEACH 57 OMB Control No: 2506-0117 (exp. 06/30/2018) 22-67 • Supporting activities that expand the supply of housing that is affordable to low- and moderate -income households, including investment of the City's Housing Trust Fund resources and using the State Density Bonus law to incentivize the development of additional affordable housing units; • Supporting a continuum of housing and public service programs to prevent and eliminate homelessness; • Supporting housing preservation programs that ensure low income households have a safe, decent and appropriate place to live; • Supporting public services through various nonprofits funded by CDBG that serve the community's youth, seniors, families and those with special needs; and • Promoting economic opportunity for all residents working for employers doing business with the City of Newport Beach through the Commercial Fagade Improvement Program. In addition to these local efforts, mainstream state and federal resources also contribute to reducing the number of individuals and families in poverty. Federal programs such as the Earned Income Tax Credit and Head Start provide a pathway out of poverty for families who are ready to pursue employment and educational opportunities. Additionally, in California, the primary programs that assist families in poverty are CalWORKs, CalFresh (formerly food stamps) and Medi -Cal. Together, these programs provide individuals and families with employment assistance, subsidy for food, medical care, childcare and cash payments to meet basic needs such as housing, nutrition and transportation. Other services are available to assist persons suffering from substance abuse, domestic violence and mental illness. Actions planned to develop institutional structure The institutional delivery system in Newport Beach is high -functioning and collaborative — particularly the relationship between local government and the nonprofit sector comprised of a network of capable community-based organizations that are delivering a full range of services to residents. Affordable housing development and preservation activities will be carried out by the Planning Division of the Community Development Department in partnership with other agencies. Public service activities will be carried out by nonprofit organizations to achieve the Strategic Plan goals. The Planning Division and the Public Works Department will work together with contractors to implement public facility improvement projects. One of the key ways the City is developing and expanding institutional structure to meet underserved needs is by funding a wide variety of services targeted to seniors, special needs populations and individuals or families at risk of homelessness with CDBG public service grants.
