Construction is not scheduled to begin for another two years. Until the new Fire Station is built, staff recommends that the site be used for paid public parking. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution 2018-62, Resolution of the City Council of the City of Newport Beach, California, Establishing an Off -Street Paid Parking Zone for the Fire Station Lot at 2807 Newport Boulevard. FUNDING REQUIREMENTS: The current adopted budget includes sufficient funding for the purchase and installation of one paystation and relevant signage, approximately $11,200.00. It will be expensed to the Parking Lot Infrastructure account in the Finance Parking Department, 75504-911015. The revenue from the Fire Station Lot is estimated to be approximately $50,000/year. DISCUSSION: Construction is not scheduled at the Fire Station Lot to begin for another two years. Until then, staff recommends that the site be used for paid public parking. 9-1 Resolution Establishing Off -Street Parking Zone 32, Located at 2807 Newport Boulevard August 14, 2018 Page 2 The Fire Station Lot contains 25 regular and 2 ADA accessible parking spaces. The Fire Station Lot is conveniently located near many local businesses. Nearby parking, which includes on -street and several small City managed lots, are all metered/paid parking. Newport Beach Municipal Code Section 12.44.030 authorizes the City to establish off- street parking meter zones and parking rates by resolution. Staff recommends establishing parking rate, hours and maximum stay to be the same as neighboring off and on -street City parking rates - currently $2.10 hourly, every day from 8 a.m. to 6 p.m., maximum 10 hours. Master Parking Permit holders would be allowed to park without any additional fee. Upon City Council approval, one paystation would be installed in the center of the lot. A sign indicating the payment requirement and the Fire Station Lot's temporary status shall also be installed. Upon closure of the Fire Station Lot for construction, the paystation would be repurposed to another parking lot. Overnight parking would be allowed at no additional charge. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENTS: Attachment A — Parking Map Attachment B — Resolution No. 2018-62 9-2 Attachment A Map of Fire Station Lot 9-3 1 Z$Z Lib o a vy4 — n 4L 1. 2SIO 2EZ T4 2T Zoroe� D 7ao4 i !r ZgYS15Z ,�1 -- i 0 0 2627. 9-4 ATTACHMENT B RESOLUTION NO. 2018- 62 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, ESTABLISHING AN OFF-STREET PAID PARKING ZONE FOR THE FIRE STATION LOT AT 2807 NEWPORT BOULEVARD WHEREAS, the City of Newport Beach ("City") acquired the property located at 2807 Newport Boulevard, Newport Beach, California for the purposes of constructing a fire station ("Fire Station Lot"); WHEREAS, construction on the Fire Station Lot is not scheduled to begin for another two years; WHEREAS, the Fire Station Lot contains twenty-five (25) regular parking spaces and two (2) ADA accessible parking spaces conveniently located near many local attractions and businesses; WHEREAS, the City desires to allow members of the public to temporarily use the Fire Station Lot for vehicle parking; WHEREAS, the nearby parking, which includes on -street and several small City managed lots, are all metered or paid parking, WHEREAS, Newport Beach Municipal Code ("NBMC") Section 12.44.030 authorizes the City to establish off-street parking meters zones by resolution; WHEREAS, NBMC Section 12.44.030 further authorizes the City to establish rates for paid off-street parking zones; and WHEREAS, the City Council previously adopted Resolution Nos. 2000-38, 2010- 39, 2013-33, and 2015-56 relating to off-street parking meter zones. NOW, THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: Section 1: Pursuant to Newport Beach Municipal Code Section 12.44.030, the City Council hereby establishes an off-street parking meter zone for the Fire Station Lot. The new zone shall be known as Zone 32 and shall consist of the City owned property located at 2807 Newport Boulevard, Newport Beach, California. Zone 32 is depicted on Exhibit "A", which is attached hereto and incorporated by reference. Zone 32 is temporary and shall automatically expire without any further action by the City Council upon the commencement of construction of the fire station. Section 2: The hours of operation for all paid parking spaces within off-street parking meter Zone 32 shall be 8:00 a.m. to 6:00 p.m. daily. Resolution No. 2018 - Page 2 of 2 Section 3: The fee for parking in Zone 32 when paid parking is in operation shall be Two Dollars and 101100 ($2.10) per hour. Section 4: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 5: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 6: The City Council finds that the establishment of an off-street parking meter zone is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3. The resolution does not authorize development and only establishes and off-street parking zone. Section 7: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution. ADOPTED this day of , 2018.
