Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Patrick Arciniega, Senior Civil Engineer parciniega@newportbeachca.gov PHONE: 949-644-3347 TITLE: Peninsula Park Improvements — Notice of Completion for Contract No. 7226-2 (16R12) ABSTRACT: On March 27, 2018, City Council awarded Contract No. 7226-2 to S&H Civilworks for the Peninsula Park Improvements project. This contract included reconstructing a seat/sand wall, sidewalk, stairs and restoring adjacent turf area. The required work is now complete and staff requests City Council acceptance and close out of the contract. RECOMMENDATIONS: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project. On March 27, 2018, City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15332 (in -fill development projects) because it has no potential to have a significant effect on the environment; b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the Notice of Completion has been recorded in accordance with applicable portions of the Civil Code; and c) Release Faithful Performance Bond one (1) year after acceptance by the City Council. FUNDING REQUIREMENTS: Funds for the construction contract were expensed from the following accounts: Account Description Account Number Amount Building Excise Tax 14101-980000-16P12 $ 268,135.36 Total: $ 268,135.36 13-1 Peninsula Park Improvements — Notice of Completion for Contract No. 7226-2 (16R12) August 14, 2018 Page 2 DISCUSSION: The project involved removing and replacing an existing deteriorated block wall (separating Peninsula Park from the sand), cement hardscape surrounding the public restrooms, and an asphalt concrete (AC) walkway. The main component of work involved removing and replacing the deteriorated block wall around Peninsula Park and replacing it with a poured -in-place decorative concrete seat/sand wall. The existing wall was well past its service life (20+ years) and was continuously falling apart. The new wall was designed to serve two purposes: containment of blowing sand on the beach, and providing an aesthetically pleasing seat wall for the community. Work adjacent to the Balboa Pier Restrooms was also included to replace deteriorated worn concrete improvements including repairs to the seatwall, sidewalk, and stairs, as well as asphalt concrete improvements around the fire ring walkway and raised the grade slightly to match the sand dune grade. This project required a compressed and accelerated schedule to complete work prior to Memorial Day weekend. Contractor S&H Civilworks maintained their schedule and was very responsive to the City's requests. Project was substantially complete prior to Memorial Day. During construction a change order was issued totaling $34,075.36 to produce a better final product. Two issues resulted in a majority of the cost increase. The first change lengthened the access opening guard wall to increase the field's protection from windblown sand and the second increased the grade of the asphalt concrete path (and resulting tonnage) to better provide access to the beach and match grades around the area. The actual cost of bid items constructed was $234,060.00. The total final cost of construction, including the change orders, was $268,135.36, which is approximately 14.6 percent above the original bid amount. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
