HomeMy WebLinkAbout2018-62 - Establishing an Off-Street Paid Parking Zone for the Fire Station Lot at 2807 Newport BoulevardRESOLUTION NO. 2018-62 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, ESTABLISHING AN OFF-STREET PAID PARKING ZONE FOR THE FIRE STATION LOT AT 2807 NEWPORT BOULEVARD WHEREAS, the City of Newport Beach ("City") acquired the property located at 2807 Newport Boulevard, Newport Beach, California for the purposes of constructing a fire station ("Fire Station Lot'); WHEREAS, construction on the Fire Station Lot is not scheduled to begin for another two years; WHEREAS, the Fire Station Lot contains twenty-five (25) regular parking spaces and two (2) ADA accessible parking spaces conveniently located near many local attractions and businesses; WHEREAS, the City desires to allow members of the public to temporarily use the Fire Station Lot for vehicle parking; WHEREAS, the nearby parking, which includes on -street and several small City managed lots, are all metered or paid parking; WHEREAS, Newport Beach Municipal Code ("NBMC") Section 12.44.030 authorizes the City to establish off-street parking meter zones by resolution; WHEREAS, NBMC Section 12.44.030 further authorizes the City to establish rates for paid off-street parking zones; and WHEREAS, the City Council previously adopted Resolution Nos. 2000-38, 2010- 39, 2013-33, and 2015-56 relating to off-street parking meter zones. NOW, THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: Section 1: Pursuant to Newport Beach Municipal Code Section 12.44.030, the City Council hereby establishes an off-street parking meter zone for the Fire Station Lot. The new zone shall be known as Zone 32 and shall consist of the City owned property located at 2807 Newport Boulevard, Newport Beach, California. Zone 32 is depicted on Exhibit "A", which is attached hereto and incorporated by reference. Zone 32 is temporary and shall automatically expire without any further action by the City Council upon the commencement of construction of the fire station. Section 2: The hours of operation for all paid parking spaces within off-street parking meter Zone 32 shall be 8:00 a.m. to 6:00 p.m. daily. Section 3: The fee for parking in Zone 32 when paid parking is in operation shall be Two Dollars and 10/100 ($2.10) per hour. Resolution No. 2018-62 Page 2 of 2 Section 4: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 5: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 6: The City Council finds that the establishment of an off-street parking meter zone is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3. The resolution does not authorize development and only establishes and off-street parking zone. Section 7: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
