Staff submitted two funding applications under the CTFP Regional Capacity Program and requests City Council's adoption of two resolutions. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; b) Adopt Resolution No. 2018-76, A Resolution of the City Council of the City of Newport Beach, California, Approving the Submittal of a Funding Application for an Arterial Capacity Enhancement Project to the Orange County Transportation Authority for Funding Under the Comprehensive Transportation Funding Program, for the Old Newport Boulevard and West Coast Highway Improvement Project; and c) Adopt Resolution No. 2018-77, A Resolution of the City Council of the City of Newport Beach, California, Approving the Submittal of a Funding Application for an Intersection Capacity Enhancement Project to the Orange County Transportation Authority for Funding Under the Comprehensive Transportation Funding Program, for the West Coast Highway and Superior Avenue/Balboa Boulevard Intersection Improvement Project. 4-1 Resolutions Approving Submittal of Grant Funding Applications Under Orange County Transportation Authority (OCTA) Comprehensive Transportation Funding Program (CTFP) November 13, 2018 Page 2 FUNDING REQUIREMENTS: If the City is successful with these applications, the City will be required to provide local matching funds for each of these projects. A local funding match of $420,000 will be required for the West Coast Highway and Superior Avenue/Balboa Blvd project and $803,909 will be needed for the Old Newport Boulevard and West Coast Highway Improvement project. Local matching funds for both of these projects will need to be included in a future Capital Improvement Program (CIP) budget for City Council consideration. DISCUSSION: In August 2018, OCTA announced the opening of the 2019 CTFP Call for Projects. The 34 Orange County cities and the unincorporated County of Orange (35 agencies total) were invited to submit funding applications under CTFP. All applications were due on October 18, 2018 and will be evaluated and scored by OCTA. $32 million is available from the renewed Measure M (M2) funds for this CTFP Regional Capacity Program (RCP) Call for Projects. The RCP is further divided into three categories; 1) Arterial Capacity Enhancement (ACE), 2) Intersection Capacity Enhancement (ICE), and 3) Freeway Arterial/Street Transition (FAST). Staff submitted two funding applications under the ACE and ICE categories. Draft resolutions were included with the applications as required by the funding guidelines. Old Newport Boulevard and West Coast Highway Improvement Project The first application is for the Old Newport Boulevard and West Coast Highway Improvement project under the ACE category. The proposed improvements at the intersection would result in desired bicycle and vehicle capacity and channelization improvements including widening the north side of Pacific Coast Highway to add a third through lane underneath Newport Boulevard, a dedicated right -turn lane onto Old Newport Boulevard, a bicycle lane, and other minor site improvements. Some of the elements to be addressed would be traffic congestion, lighting conditions, lack of pedestrian facilities, uncontrolled access for ingress and egress, and parking along Pacific Coast Highway. The project will improve traffic movement by reducing vehicle/pedestrian/bike conflicts and improving the operation of the intersection by alleviating vehicle queuing and reducing congestion. The City previously applied for and was awarded M2 grant funding in 2013 for engineering plans, which are currently 90% complete. Since that time, the City has worked with Caltrans to prepare an Initial Study with a Proposed Mitigated Negative Declaration. This report, after a lengthy four-year process, is complete and was filed in the State Clearing House on June 15, 2018. The next phase of this project is to move into right-of-way negotiations with the adjacent properties. The three properties included in this right-of- way grant funding request is the "A Market and Restaurant" located at 3334 Pacific Coast Highway, Pacific Imaging office at 3300 Pacific Coast Highway and the surplus state property adjacent to Arches Interchange bridge. 4-2 Resolutions Approving Submittal of Grant Funding Applications Under Orange County Transportation Authority (OCTA) Comprehensive Transportation Funding Program (CTFP) November 13, 2018 Page 3 Please see the attached exhibit for a depiction of the proposed project and the three potential partial right-of-way acquisition areas. This grant request is for a total of $2,411,725. Of this amount, the City is responsible for a 25% match which totals $803,909. This cost is derived from market estimates of land acquisition for this area. An approximate total of 4,257 square feet from the "A Restaurant" and 1,406 square feet from Pacific Imaging office site appears to be required. The proposed improvements are part of the Old Newport Boulevard/West Coast Highway Modifications project as identified in the FY 2018/19 Capital Improvement Program (CIP). West Coast Highway and Superior Avenue/Balboa Boulevard Intersection Improvements The second application is for the West Coast Highway and Superior Avenue/Balboa Boulevard Intersection Improvement project under the ICE category. This project is part of the Lower Sunset View Park project as identified in the FY 2018/19 CIP, which is a multi-year project and will be completed in two phases. Phase 1 includes a pedestrian/bicycle bridge across Superior Avenue, a larger parking lot and potentially a new recreational area. Phase 1 is currently funded and is not part of this application. Phase 2 involves capacity improvements to the intersection of West Coast Highway and Superior, eventually constructing a second pedestrian/bicycle bridge across West Coast Highway. This grant application is for the planning, environmental and final design efforts for Phase 2. The application requests $780,000 of M2 grant funds (65 percent). If successful, the City will be required to provide $420,000 (35 percent) of local matching funds. In September 2016, the City entered into a Professional Services Agreement with T.L. Lin to begin the conceptual design. After several meetings with the Parks, Beaches, and Recreation Committee and City Council working groups, the City decided to split this project into two phases as described above. During the City Council Study Session on May 8, 2018, staff received concurrence from City Council to proceed with the phased approach and continue to seek grant funding opportunities for Phase 2. When the 2019 CTFP Call for Projects became available, staff decided to submit an application for Phase 2 under the ICE category. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. 4-3 Resolutions Approving Submittal of Grant Funding Applications Under Orange County Transportation Authority (OCTA) Comprehensive Transportation Funding Program (CTFP) November 13, 2018 Page 4 Upon completion of the environmental efforts for the West Coast Highway and Superior Avenue/Balboa Boulevard Intersection Improvement project, staff will determine the appropriate environmental documentation. As noted above, Caltrans completed a mitigated negative declaration for the Old Newport project which was filed with the State Clearing house on June 15, 2018 NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). Section 5: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional.
