Irvine Avenue Pavement Rehabilitation — Notice of Completion for
Contract No. 8515-2 (17R21)
On June 26, 2018, City Council awarded Contract No. 8515-2 for the Irvine Avenue
Pavement Rehabilitation project to R.J. Noble Company. The work is now complete and
staff requests City Council acceptance and close out of the contract.
RECOMMENDATIONS:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project. On June 26, 2018, City Council found this project exempt from the
California Environmental Quality Act (CEQA) pursuant to Section 15301(c);
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of the
Civil Code; and
c) Release Faithful Performance Bond one year after acceptance by the City Council.

The City was successful in obtaining grant funding to pay for a portion of the paving
material under the CalRecycle Rubberized Pavement Grant Program (Program). This
Program promotes the use of rubberized asphalt concrete made from recycled waste tires
generated in California. The Program aims to decrease the adverse environmental
impacts created by disposing and stockpiling of waste tires. Through the CalRecycle
Program, the City will be reimbursed $10/ton of rubberized asphalt concrete used on this
project.

The work necessary to complete this contract included cold milling and overlaying the
existing asphalt pavement on Irvine Avenue from 16th Street to Santiago Drive.
Deteriorated sidewalks, median curbs, gutters, and access ramps were also
reconstructed. Existing utility boxes were adjusted to conform to the new street grades.
New pavement striping was also installed.
The contracted work has now been completed to the satisfaction of the Public Works
Department. A summary of the construction cost is as follows:
Original Bid Amount: $2,459,825.00
Actual Cost of Bid Items Constructed: $2,324,312.49
Total Change Orders: ($4,394.35)
Final Contract Cost: $2,319,918.14
The actual cost of bid items constructed was less than the original bid amount due to the
reduced quantities constructed as measured in the field. This reduction in actual
quantities constructed resulted in a project savings of $135,512.51 ($2,459,825 contract
versus $2,324,312.49 completed). There were a total of five change orders; one was a
credit in the amount of $29,466 which reflected a reduction in work needed to repair
isolated failed pavement sections as determined in the field. Given the competitive bid
prices and high-quality workmanship of this contractor, staff requested R.J. Noble
Company to complete some additional requested curb and gutter improvements on
Mariners Drive adjacent to Irvine Avenue as part of this pavement rehabilitation contract
under a second change order for an additional $19,089. The remaining three change
orders were associated with minor field changes. The total final cost of construction,
including all change orders, was $2,319,918.14, which is approximately 5.7 percent below
the original bid amount.

A portion of the southbound side of Irvine Avenue from 16th Street to Baycrest Drive is
within the City of Costa Mesa. To minimize public inconvenience, City staff and
Costa Mesa staff coordinated and completed these improvements as one joint project.
On June 26, 2018, the two cities entered into a Cooperative Agreement (Agreement)
identifying roles and responsibilities for each city. Under the Agreement, the City of
Newport Beach was designated as the lead agency. The City of Costa Mesa agreed to
reimburse the City of Newport Beach for design services, construction and administration
costs for improvements within the City of Costa Mesa right-of-way. Costa Mesa's share
of the construction cost is $854,119.61 and their total project cost, including design,
construction, and administration is approximately $953,000. Costa Mesa has already
paid $580,965. The remaining balance of approximately $372,035 will be invoiced after
filing the notice of completion.
The project was substantially complete as of October 1, 2018. A summary of the project

ENVIROMENTAL REVIEW:
On June 26, 2018, City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301(c) of the CEQA Guidelines,
California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a
significant effect on the environment.
NOTICING -
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
