Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Alfred Castanon, Associate Civil Engineer acastanon@newportbeachca.gov PHONE: 949-644-3314 TITLE: Marguerite Avenue and Hospital Road Pavement Rehabilitation — Notice of Completion for Contract No. 7188-1 (18R24) ABSTRACT: On July 24, 2018, City Council awarded Contract No. 7188-1 for the Marguerite Avenue and Hospital Road Pavement Rehabilitation project to Excel Paving Company. The work is now complete and staff requests City Council acceptance and close out of the contract. RECOMMENDATIONS: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project. On July 24, 2018, City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(c); b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the Notice of Completion has been recorded in accordance with applicable portions of the Civil Code; and c) Release Faithful Performance Bond one year after acceptance by the City Council. This Program promotes the use of rubberized asphalt concrete made from recycled waste tires generated in California. The Program aims to decrease the adverse environmental impacts created by disposing and stockpiling of waste tires. Through the CalRecycle Program, the City will be reimbursed $10/ton of rubberized asphalt concrete used on this project. DISCUSSION: Overall Contract Cost/Time Summary Awarded Final Cost at Contingency Actual % Due to % Due to Contract Amount Completion Allowance Contract Directed Unforeseen Change Change Change $887,788.00 $858,066.65 10% or less -3.3% -3.3% n/a Allowed Contract Time + 60 Actual Time -18 Approved Extensions (days) = Under (-) or Over (+) The work necessary to complete this contract included replacing existing sidewalk, curb and gutter, and curb access ramps; removing the existing pavement; and repaving with new rubberized asphalt concrete on Marguerite Avenue from Fifth Avenue to San Joaquin Hills Road, and on Hospital Road from Superior Avenue to Placentia Avenue. Also included in this contract was street reconstruction at the intersection of Irvine Avenue and Cliff Drive. The contracted work has now been completed to the satisfaction of the Public Works Department. A summary of the construction cost is as follows: Original bid amount: Actual Cost of Bid Items Constructed: Total Change Orders: Final Contract Cost: $887,788.00 $864,714.65 ($6,648.00) $858,066.65 The actual cost of bid items constructed was $23,073.36 less than the original bid amount because of less asphalt paving tonnage placed than originally planned. There were also three change orders totaling ($6,648.00) approved with this contract. The change orders included costs for additional excavation and export of unsuitable base material at the intersection of Cliff Drive and Irvine Avenue, additional striping, traffic signal detector loop repair work, and a deductive change order for $11,050, representing the contractor's failure to provide the required number of street sweepers during grinding and paving operations. With these adjustments, the final contract cost was approximately 3.3 percent below the original bid amount. 10-2 Marguerite Avenue and Hospital Road Pavement Rehabilitation — Notice of Completion for Contract No. 7188-1 (18R24) November 27, 2018 Page 3 The project was substantially completed as of October 10, 2018. A summary of the project schedule is as follows: Estimated Start of Construction per Annual Baseline Schedule August 6, 2018 Actual Start of Construction Per Notice to Proceed August 13, 2018 Contract Completion Date Including Approved Time Extensions November 7, 2018 Actual Substantial Construction Completion Date October 10, 2018 ENVIRONMENTAL REVIEW: On July 24, 2018, City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(c) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
