Staff requests City Council's approval to award the construction contract to T.E. Roberts, Inc. (T.E. Roberts) of Orange, California. RECOMMENDATION: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15302 (c) (replacement of existing public facilities involving negligible or no expansion of capacity) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment-, b) Approve the project plans and specifications; c) Award Contract No. 7173-2 to T.E. Roberts for the bid amount of $2,222,300.00 for the Balboa Island Water Main Replacement Phase II project, and authorize the Mayor and City Clerk to execute the contract-, and d) Establish a contingency of $220,000.00 (approximately 10% of Total Bid) to cover the cost of unforeseen work not included in the original contract. FUNDING REQUIREMENTS: Sufficient funding is available in the current Capital Improvement Program budget for the award of this contract. Roberts Construction Contingency $ 220,000.00 Various Printing & Incidentals $ 1,500.00 Total: $ 2,443,800.00 Staff recommends establishing approximately a ten (10) percent contingency of the construction contract for unforeseen conditions associated with construction. DISCUSSION: At 10 a.m. on November 7, 2018, the City Clerk opened and read the following bids for this project: The apparent low bidder for this project, T.E. Roberts submitted a bid 11 percent below the Engineer's Estimate of $2,500,000.00. The bids are competitive and the disparity between the engineer's estimate and the low bid appears to be in line with recent favorable bids for water main construction and trench dewatering bid items. T.E. Roberts submitted all the necessary forms and possesses a Classification "A" California State Contractors License as required by the project specifications. A check of the contractor's references indicates satisfactory completion of similar projects for the City of Newport Beach and other public agencies. T.E. Roberts recently completed the Balboa Island Water Main Replacement — Phase I project for the City of Newport Beach. The Balboa Island Water Main Replacement — Phase II project replaces older cast iron water transmission mains identified in the Water Master Plan located on Park Avenue. This is the second phase of three projects to replace deteriorated water distribution and transmission mains on Balboa Island installed in the 1940's that have reached their design life. The proposed project involves removing interfering portions of existing deteriorated cast iron water mains, dewatering, and installing new PVC pipe, valves, fire hydrants, water services, pavement restoration, traffic control and other appurtenant work as required by the contract. Project phasing has been developed to minimize impacts to the community. For example, no work will be scheduled during the boat parade and the week of Christmas. Also, for water main construction along Park Avenue, the contractor will only be allowed to close two block sections at a time and won't be allowed to have consecutive construction headings with conflicting traffic control. 13-2 BIDDER TOTAL BID AMOUNT Low T.E. A detailed schedule is to be prepared by the contractor following award, which can be adjusted to address concerns for businesses and residents in the project area. Pursuant to the Contract Specifications, Contractor will have 125 consecutive working days to complete the work. Work for this construction contract is scheduled to begin January 7, 2019. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Class 2 Section 15302 (c) (reconstruction of existing public facilities involving negligible or no expansion of capacity) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment; NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
