Home My WebLink About2018-83 - Reciting the Facts of the General Municipal Election Held on Tuesday, November 6, 2018, and Declaring the Result and Such Other Matters as Provided by LawRESOLUTION NO. 2018-83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, RECITING THE FACTS OF THE GENERAL MUNICIPAL ELECTION HELD ON TUESDAY, NOVEMBER 6, 2018, AND DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a General Municipal Election was held and conducted in the City of Newport Beach, California, on Tuesday, November 6, 2018, as required by law; WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and w,..rr,'. .�.�.�.-.-..J L.., 4-L_- ..... .:-:_-_ _t LL- ri--` ---- r+_ _r ., I .-. — . ...annor as requncu vy ui� NlwIOIUIlo ul LI It: GICULI01I' bode of the Stale of Cahfornia Tor the holding of elections in charter cities; and WHEREAS, the County Election Department canvassed the returns of the election and has certified the results to this City Council. The results are received in the form of the Certificate of Registrar of Voters to Result of the Canvass of the General Election Returns, dated November 30, 2018 (the "Certificate of Registrar"), which is attached hereto as Exhibit 1 and made a part of and incorporated herein by this reference. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: That the whole number of ballots cast in the precincts, except early voting and vote -by -mail ballots, was 14,562, and the whole number of early voting and vote -by -mail ballots cast in the City was 28,608, making a total of 43,170 ballots cast in the City. Section 2: That the name of the persons voted for at the election for Member of the City Council - District One are as follows: Diane Brooks Dixon Mike Glenn That the names of the persons voted for at the election for Member of the City Council - District Three are as follows: Marshall "Duffy" Duffield Tim Stoaks Resolution No. 2018-83 Page 2 of 4 That the names of the persons voted for at the election for Member of the City Council - District Four are as follows: Roy Englebrecht Kevin Muldoon That the names of the persons voted for at the election for Member of the City Council - District Six are as follows: Joy Brenner Scott Peotter That the measure voted upon at the election is as follows: Measure T (Amendment of the Newport Beach City Charter - Require Voter Approval Prior to Issuing or Incurring Certain Debt Obligations) Section 3: That the number of votes given at each precinct and the number of votes given in the City for and against Measure T and to each of the persons above named for the respective offices for which the persons were candidates are listed in the Certificate of Registrar. Section 4: The City Council declares and determines that: Diane Brooks Dixon was reelected as Member of the City Council - District One for the full term of four (4) years; Marshall "Duffy" Duffield was reelected as Member of the City Council - District Three for the full term of four (4) years; Kevin Muldoon was reelected as Member of the City Council - District Four for the full term of four (4) years; and Joy Brenner was elected as Member of the City Council - District Six for the full term of four (4) years. That, as a result of the election, a majority of the voters voting on Measure T did vote in favor of Measure T, and that the measure carried and shall be deemed adopted and ratified. Resolution No. 2018-83 Page 3 of 4 Section 5: The City Clerk shall enter on the records of the City Council of the City, a statement of the results of the election, showing: (1) The whole number of ballots cast in the City; (2) the names of the persons voted for and the measure voted upon; (3) for what office each person was voted for; (4) the total number of votes given at each precinct to each person and Measure T; and (5) the total number of votes given in the City to each person and Measure T. Section 6: That the City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk, or her designee, shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the Office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. Section 7: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 8: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 9: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
