CALL TO ORDER – The meeting was called to order at 3:00 p.m. Staff Present: Patrick J. Alford, Zoning Administrator Chelsea Crager, Associate Planner Makana Nova, Associate Planner David Lee, Assistant Planner Liz Westmoreland, Assistant Planner II. REQUEST FOR CONTINUANCES None. III. APPROVAL OF MINUTES ITEM NO. 1 MINUTES OF NOVEMBER 15, 2018 Action: Approved IV. PUBLIC HEARING ITEMS ITEM NO. 2 Naehring Residential Condominiums Coastal Development Permit No. CD2018 -061 and Tentative Parcel Map No. NP2018-018 (PA2018-143) Site Location: 3406 and 3406 1/2 Marcus Avenue Council District 1 Makana Nova, Associate Planner, provided a brief project description. She noted that the project site is bisected by the Coastal Commission permit jurisdiction and that the officially adopted map may show a different delineation. This CDP application is intended to cover portions within the City’s permit jurisdiction. She also noted that the project has been analyzed for compliance with coastal hazards, including sea level rise based on the State of California, Sea-Level Rise Guidance: 2018 Update. She then summarized the project’s compliance with LCP requirements for water quality, public access and public view protection. Ms. Nova provided updated language for the draft resolution to modify the jurisdictional delineation language in Sections 1 and 4 and added language to Condition No. 7 to further clarify Coastal Commission’s jurisdiction over public trust property. The Zoning Administrator clarified that the Coastal Commission’s Mapping Unit identified the site as bisected, but has not clearly identified which improvements are within their jurisdiction. Therefore, the CDP under review will cover portions of the project determined to be within the City’s jurisdiction. The Zoning Administrator inquired about the status of on-street parking and Ms. Nova explained that the existing duplex provides a 3-car wide curb cut. The proposed curb cut will not exceed 25 feet in width and there will be no loss of on-street parking as a result of the proposed project. Applicant Matt Naehring, property owner, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. The Zoning Administrator approved the project with the draft resolution as modified. Action: Approved ITEM NO. 3 Pack Condominiums Coastal Development Permit No. CD2018-090 and Tentative Parcel Map No. NP2018-031 (PA2018-221) Site Location: 1045 West Balboa Boulevard Council District 1 David Lee, Assistant Planner, provided a brief project description stating that the request is for a coastal development permit and tentative parcel map for condominium purposes. A previous coastal development permit was issued for the demolition of an existing duplex and construction of a new duplex. Applicant Melissa Goeritz of Foxlin Architects, on behalf of the owner, stated that she had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. The Zoning Administrator requested that staff add language to Condition No. 1 of the Resolution, which states that the conditions of approval from the previously approved coastal development permit shall remain in effect. Action: Approved ITEM NO. 4 Harbor Thai Massage Minor Use Permit No. UP2018-017 (PA2018-188) Site Location: 2400 West Coast Highway, Suite J Council District 3 Liz Westmoreland, Assistant Planner, provided a brief project description stating that the application is for a minor use permit to allow the operation of a massage establishments. The application includes a waiver of location requirements due to proximity to John Wayne Park. The Police Department had no concerns regarding the project location; additionally, the subject tenant space is separated from the park by a steep slope and public parking lot. Staff requested that the draft Resolution be modified to allow additional flexibility in the days of operation, increasing the days permitted to seven instead of six, or allowing them to be open different days (it currently states they will be closed on Tuesdays.) No changes to the hours of operation were requested. The Zoning Administrator asked if the days of operation appeared in the Public Notice. Ms. Westmoreland responded that they were not included. The applicant will also be required to obtain an operator’s permit through the Police Department, which will include review of additional details such as days of operation. Applicant Tom Gunckel of Harbor Thai Massage, stated that he had reviewed the draft Resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Action: Approved MINUTES OF THE MEETING OF THE NEWPORT BEACH ZONING ADMINISTRATOR 11/29/2018 Page 3 of 3 ITEM NO. 5 Building Worx Condominiums Coastal Development Permit No. CD2018-093 and Tentative Parcel Map No. NP2018-032 (PA2018-220) Site Location: 507 and 507 ½ Carnation Avenue Council District 6 David Lee, Assistant Planner, provided a brief project description stating that the request is for a coastal development permit and tentative parcel map for condominium purposes. Mr. Lee requested that Condition No. 9 be removed from the Final Resolution, since it was inserted in error. Applicant James “Buzz” Person, on behalf of the owner, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Action: Approved ITEM NO. 6 Coastal Body Care Minor Use Permit No. UP2018-020 (PA2018-201) Site Location: 3520 Irvine Avenue Council District 3 Chelsea Crager, Associate Planner, provided a brief project description stating that the project is a minor use permit to allow the operation of a massage establishment with a request for a waiver of location requirements. The waiver of location requirements is necessary because the project site is located within 500 feet of another establishment where massage services are offered, at 20101 Southwest Birch Street. Proposed hours of operation are 10:00 a.m. to 7:00 p.m., daily, and a maximum of two massage therapists would work at one time. The applicant’s translator, Yong Lin Tan, spoke on behalf of the applicant, Yanqing Hao, and stated that she had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Action: Approved V. PUBLIC COMMENTS ON NON-AGENDA ITEMS None. VI.
