Alford, Zoning Administrator Chelsea Crager, Associate Planner David Lee, Assistant Planner Melinda Whelan, Assistant Planner Patrick Achis, Planning Technician REQUEST FOR CONTINUANCES None. III. APPROVAL OF MINUTES ITEM NO. 1 MINUTES OF January 10, 2019 Action: Approved IV. PUBLIC HEARING ITEMS ITEM NO. 2 Pham Residence Coastal Development Permit No. CD2018-098 (PA2018-239) Site Location: 2585 Crestview Drive Council District 3 Chelsea Crager, Associate Planner, provided a brief project description stating that the project is a coastal development permit for the demolition of an existing single-family residence and the construction of a new two-story single-family residence. The proposed new residence complies with all applicable development standards and no deviations are requested. Applicant Kennedy Year of Brandon Architects, on behalf of property owner Anthony Pham, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. One member of the public, Jim Mosher, spoke and stated that the original tract map required public access across the lot line abutting Coast Highway, and that there is an existing wall blocking this access that is proposed to remain. The Zoning Administrator closed the public hearing. The Zoning Administrator confirmed with staff that information was not readily available as to when the wall was constructed, and that the wall extends along multiple lots and not solely the project site. The Zoning Administrator stated that the dedication was a curiosity; however, it was not relevant to the project under consideration. The scope of the project, replacing an existing single-family residence with a new single-family residence, will not negatively affect public access. Page 1 of 3 MINUTES OF THE MEETING OF THE NEWPORT BEACH ZONING ADMINISTRATOR Action: Approved 01/24/2019 ITEM NO. 3 Bay House Landscape Improvements Coastal Development Permit No. CD2018-096 (PA2018-243) Site Location: 2100 East Balboa Boulevard Council District 1 David Lee, Assistant Planner, provided a brief project description stating that the applicant is proposing various accessory structures on a lot where there is currently no residence. Mr. Lee proposed that staff add two conditions of approval to the final resolution. One condition is regarding the protection of any possible migratory birds on-site, and the second condition states that all conditions from the previous coastal development permit to demolish the existing single-family residence will still be in effect with the approval of this coastal development permit. Applicant Shawna Schaffner of CAA Planning, on behalf of the owner, stated that she had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved ITEM NO.4 Breech Residence Coastal Development Permit No. CD2018-107 (PA2018-226) Site Location: 2282 Channel Road Council District 1 Melinda Whelan, Assistant Planner, provided a brief project description stating that the request is for a coastal development permit to allow the construction of a new three-story, 4,887 -square -foot, single-family residence including an attached three -car garage. Applicant John Morgan, on behalf of property owner Mr. Breech, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. One member of the public, Jim Mosher, spoke and referenced typographical errors. He added that while he did not disagree with the conclusion of the staff report, he believed that the project site could be seen from across the bay on Ocean Boulevard. The Zoning Administrator closed the public hearing. The Zoning Administrator asked Mr. Mosher to confirm there was no impact to coastal views from Ocean Boulevard. Mr. Mosher answered that he had not. Action: Approved ITEM NO. 5 Palazzola Residential Condominiums Tentative Parcel Map No. NP2018-036 and Coastal Development Permit No. CD2018-100 (PA2018-245) Site Location: 129 and 129 % 46th Street Council District 1 Patrick Achis, Planning Technician, provided a brief project description stating that the request is for a tentative parcel map and associated coastal development permit (CDP) for two -unit condominium purposes. Applicant Paul Craft of Apex Land Surveying, on behalf of the Owner, stated that he had reviewed the draft resolution and agrees with all of the required conditions. Page 2 of 3 MINUTES OF THE MEETING OF THE NEWPORT BEACH ZONING ADMINISTRATOR The Zoning Administrator opened the public hearing. 01/24/2019 Jim Mosher, pointed out a Scrivener's error in the staff report, and asked questions about the technical term "plugged" used in one of the Public Works Department conditions and the CDP exemption of the California Environmental Quality Act (CEQA). The Zoning Administrator closed the public hearing. Mr. Achis responded that the Scrivener's error would be addressed and Public Works staff would be consulted to find possible alternate language for the use of the term "plugged," if necessary. The CDP exemption is under Class 15 (Minor Land Divisions) of the CEQA Guidelines. Action: Approved ITEM NO. 6 Dexter 418 Larkspur, LLC Residential Condominiums Tentative Parcel Map No. NP2018-035 (PA2018-246) Site Location: 418 and 418 % Larkspur Avenue Council District 6 Patrick Achis, Planning Technician, provided a brief project description stating that the request is for a tentative parcel map for two -unit condominium purposes. Applicant Paul Craft of Apex Land Surveying, on behalf of the Owner, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Jim Mosher, pointed out a Scrivener's error in the staff report. Mr. Achis responded that the Scrivener's error would be addressed. The Zoning Administrator closed the public hearing. Action: Approved V. PUBLIC COMMENTS ON NON -AGENDA ITEMS None. VI.
