The Board of Trustees of the City of Newport Beach met in regular session at 7:30 P. n1. on above date, the meeting being called to order by President J. P. Greeley. The roll was called showinP; the following members present: J. P._Greeley, J. J. Schnitker, Al. L. Heard, Conrad Richter, L. S. tilkinson. Absent none, The minutes of the previous meeting April 19th were read, corrected and approved. The communications were read and referred to the proper order of business. The reports of the heads of the various departments were read, and by motion of Trustee L. S. Wilkinson seconded by Trustee J. J. Schnitker and carried, the reports were accepted and placed on file. City Treasurer, Lew H. Wallace, made a verbal report to the effect that we would have to have up to Nov. 18t this year $15,929.33 interest on our bonded indebtedness. SPECIAL COARTITTEES. Trustee L. S. 'Wilkinson reported that the P. E. officials had (instructed their crews to not shift the trolley at the end of the line until all passengers were off the car. Also in regard to cars equipped with toilet, they do not have any that they can put on this run at this time. Lew H. Wallace reported as follows in regard to the public park: He called up Mr. Clancy by phone and reported the condition of our treasury, and Mr. Clancy agreed to accept an initial payment of $200.00 instead of the $450.00 or $500.00 as at first asked. He also wanted $800.00 December 1st, 1920 and $1000.00 on Dec. 1st each year thereafter until paid, interest to be at 7 % per annum. NEW BUSINESS. Trustee Art. L. Heard presented an ordinance concerning the establishment of a public library in and for the City of Newport Beach, which was discussed and considered, and, on motion of Trustee L. S. Wilkinson seconded by Trustee J. J. Schnitker and carried, the ordinance was ordered filed, assigned No. 166, and referred to the City Attorney to be put in proper form for final consideration of the Board of Trustees. Trustee Conrad Richter presented an ordinance concerning the building structure in the City of Newport Beach, which was discussed and considered, and, on motion of Trustee J. J. Schnitker seconded by Trustee L. S. iilkinson and carried, the ordinance was ordered filed, assigned No. 167, and referred to the City Attorney to be put in proper form for final consideration of the Board of Trustees. City Attorney Bishop then presented a very full and complete report as to whether there was a limit upon the rate or amount of tax which might be levied in cities of the sixth class, for the purpose of raising revenue to pay semi - annual interest on and create a sinking fund for the redemption of bonds issued and outstanding. He gave it as his opinion that we are not limkted in the rate, provided we do not levy a tax greater than is sufficient to annually pay the interest and such a part of the principal as shall become due before the time for fixing the next general tax levy, and provided further that the tax shall be levied and collected at the same time and in the same manner as the general tax and shall be in addition thereto. On motion of Trustee J. J. Schnitker seconded by Trustee L. S. Wilkinson and carried, the report was ordered placed on file. On motion of Trustee Art L. Heard seconded by Trustee 1,4 S. Wilkinson and carried, the application of W. L..,-.!Jordan for transfer of business license to J. P. Pershbacher, was granted. On motion of Trustee Art L. Heard seconded by Trustee L. S. Wilkinson and carried, that the application of Rodger Bros. for permission to cross the sidewalk for garage purposes on Lot 4 Block B, Balboa Tract be granted. On motion of Trustee L. S. Wilkinson seconded by Trustee Art L. Heard and carried, that the application of Burris & Cline for transfer of license to Christian & Chilcoat be granted. On motion of Trustee L. S. Wilkinson seconded by Trustee Art L. Heard and carried, that the application of Mrs. M. Graves for transfer of license No. 86 to Mrs. Ida P. Durkee be granted. ,0 . On motion of Trustee L. S. Wilkinson seconded by Trustee J. J. Schnitker and carried, the application of the Balboa Fish Market for transfer of license No. 9 to John Pringle, was granted. On motion of Trustee L. S. Wilkinson seconded by Trustee Art L. Heard and carried, the application of W. A. Hall for a permit and license to operate a popcorn wagon on Lot 1 Block 11 Balboa Tract, was denied. On motion of Trustee Art L. Heard seconded by Trustee L. S. Wilkinson and carried, the request of H. L. Sherman for permission to construct a concrete driveway across the parking space in front- of his lots at East Newport, was granted. On motion of Trustee L. S. Wilkinson seconded by Trustee J. J. Schnitker and carried, the application of iWm. Elkins to lease the land owned by the City on the north side of Lot 15 Block 109 Section B, was denied. On motion of Trustee L. S. Wilkinson seconded by Trustee Art L. Heard and carried, the application of L4rs. Ida P. Durkee for transfer of License No. 86 to Edward Putnam, was granted. On motion of Conrad Richter seconded by Trustee L. S. Wilkinsoi and carried, Frank Rinehart was reappointed Gas Manager subject to theowill of the Board. On motion of Trustee J. J. Schnitker seconded by Trustee Conra Richter and carried, John Me Millan was reappointed Water Superintende: subject to the will of the Board. On motion of Trustee L. S. Wilkinson seconded by Trustee J. J. Schnitker and carried, Wm. Me Culloch was reappointed Plumbing Inspector subject to the will of the Board. On motion of Trustee Art L. Heard seconded by Trustee L. S. Wilkinson and carried, Frank J. Knight was reappointed Street Superintendent subject to the will of the Board. On motion of Trustee L. S. Wilkinson seconded by Trustee J. J. Schnitker and carried, Byron Hall was reappointed Recorder subject to the will of the Board. There were two applicants for the office of HBxbor Master, Jos. A. Beek and Capt. Wm. Spofford. A ballot was taken, Mr. Beek receiving 3 votes and Mr. Spofford 2 votes, whereupon Jos. A. Beek was declared elected as Harbor Master, subject to the will of the Board. t, A petition signed bya number of property owners on Balboa Island asking for the removaa of-the old arch at the junction of Agate Avenue and Bay Front Balboa .Island was presented, and also an offer from Joseph A. Beek to tear down the old arch for permission to use the material in repairing the comfort station on the Island. On motion of Trustee J. J. Schnitker seconded by Trustee Art L. Heard and carried, the offer of Jos. A, Beek was accepted. The pipe line permit with the Southern Pacific.}. R. granting the privilege of running a sewer line under the Railroad track at a stipulated price of $5.00 per year, wLs referred back from the city engineer, and on motion of Trustee L. S. Wilkinson seconded by Trustee J. J. Schnitker and carried, the President.of the Board and City Clerk were authorized to sign the agreement. The application of C. A. Irwin and E. Burris to lease the pavilion and renovate and paint same, was presented and discussed at length. On,motion of Trustee Conrad Richter seconded by Trustee Art L. Heard, that the offer as outlined by Irwin & Burris be accepted with the proviso that the power of revocation lies with the Board if the terms are not complied with, and that the city attorney be instructed to draw up the lease for same, was carried by the following vote: Ayes, J. P. Greeley, Art. L. Heard, Conrad Richter. Noes, J. J. Schnitker, L. S. Wilkinson. A communication from the Civic League offering to pay $100.00 towards the first payment on the public park site, elicited some discussion in regard to the park, a number of those present offering to pay X5.00 towards the balance of the first payment.on same. On motion of Trustee L. S. Wilkinson seconded by Trustee Art L. Heard and carried, the name of W. A. Irwin was added to the present committee on the park to try and raise the balance of first payment. On motion of Trustee Art L. Heard seconded by Trustee Conrad Richter, that the City purchase the property mentioned, and that the City Attorney be authorized to draw up the papers on the terms reported by the committee, namely: $200.00 down, $800.00 Dec. 1, 1920 and $1000.00 on December 1st each year thereafter until paid, interest 1 CNZA .1,C t 7 %. Heard seconded by Trustee Conrad ichter and carried, the offer of 7100.00 from the Civic League was ccepted with the thanks of the Board for same. A map of Tract No. 114 of South Santa Ana Subdivision No. 1 oming within the three mile limit of the City, was presented for he approval of the Board, and on motion of Trustee L. S. Wilkinson econded by Trustee J. J. Schnitker and carried, it was approved and he City Clerk authorized,to sign the same. Trustee Conrad Richter for the Street Committee stated there ad been a good deal of contention in regard to our streets but they re in as good a condition as we can afford perhaps, and the committe .ave.been over the streets and consulted with Mr. Knight, and have ecided we need some oil at once. We have some oil on hand which ill fix part, but we need 300 barrels of 75 % gravity road oil in ar lots, and if it is necessary to advertise for bids. On motion of Trustee Art L. Heard seconded by Trustee L. S. ilkinson and carried,.the City Clerk was authorized to advertise or bids on the above quantity of oil at once. Trustee Richter also reported the vacant building by the a,ping ground a publienuisance, and the City ought to ask the wner to remove the glass and board it up. On motion of Trustee Art L. Heard seconded by Trustee J. J. �chnitker and carried, the City Clerk was authorized to inform the wner that it must be cleaned and boarded up, and if not done the ity Marshal is to proceed to fix it up and charge it to her. On motion of Trustee L. S. Wilkinson seconded by Yrustee J. J ,chnitker and carried, the Treasurers report which was.previously rea gas accepted and placed on file. On motion of Trustee L. S. Wilkinson seconded by Trustee J. J Ichnitker and carried, that demands No. 879 to 964 inclusive, having een signed and approved by the Finance Committee, be allowed and rarrants drawn for same.
