On recommendation from the Tax Collector Dept. the demands of Floyd Gibson and R. J. Stauss and also a demand on the Reliance Title Company for service rendered, on motion of Trustee Sloan second- ed by Trustee Richter and carried, the clerk was ordered to draw war- rants on the city treasurer for same. At a request from Mr. Elrath that he be made an offer ' for his property now in the process of condemnation it was moved by Trustee Young seconded by Trustee Sloan and carried that the clerk be ordered to write him a letter offering him the sum of seven hundred dollars providing he would.gilre a clear title to the city, on the property in question. Trustee Wilkinson called the attention of the Board to the fact that certain well drillers on the Mesa had ditched and were drain- ing their refuse, oil and water across the city's property and asked that some action be taken to abate the nuisance and on motion of Trustee Wilkinson seconded by Young and carried, the superintendent of streets was ordered to take the necessary steps to remedy same. There being no further business before the Board on motion of Trustee Sloan seconded by Trustee Young and carried the meeting was adjourned, sine die. , & 04'. , & /,- ,,, PRESIDENT OF THE BOARD OF TRUSTEES APPROVED ATTESTED ' CLER OF THE 7TY OF NEWPORT EACH City Hall, Newport Beach, April 5, 1926. The Board of Trustees met in regular session on the above date at the above named place. Meeting was called to Wilson, roll called showing full of Trustee Wilkinson. read. order by the President, George P. board present with the exception Minutes of previous meeting were read and approved as The Board appointed Trustee Young to ^.ct on the fin- ance committee in the absence of Trustee Wilkinson. Reports of heads of departments were read and on motion of Trustee Sloan seconded by Trustee Richter were approved and ordered filed. In regard to the petition of i.rs. Bernhard to the Carn- egie Hero Fund the clerk reported that all data in regard to same had been forwarded but as yet no answer received by him. In con- nection therewith EX. YounE; stated the.t i.:rs. Bernhard had received 337 a very unsatisfactory letter from the said association and the city attorney was asked to take the matter up in a more thorough manner. There having been no deed received from Mr. Maurice Combes as under- stood in the matter of the Henry property the clerk was instructed to write kr. Combes that if no deed was received by the city on or before April 15, 1926 it would be necessary for the city to proceed with the condemnation proceedings already instituted. This being the time fixed by Resolution of Intention No. 370, passed March 15th, 1926, for hearing protests in the matter of the improvement therein described, and no written protests having been filed with the City Clerk in said matter, and no persons desiring to be heard in the matter of said protests, whereupon Trustee Sloan r n , Resolution No 371 A resolution of the Board of Trustees of the cit -r of Newport Beach ordering the improvement of certain portions of Coast Blvd. and certain other streets and Avenues in Corona Del Mar within said city and on motion of Trustee Young seconded by Trustee Richter eg*A was passed by the following vote: Ayes, Trustee, +ilson, Sloan, Young, Richter Noes, Trustee none Absent, Trustee Wilkinson Resolution No. 372 A resolution of the Board of Trustees of the city of Newport Beach directing certain work or improvement to be done under the direction of the city engineer of said city on motion of Trustee Richter sec- onded by Trustee Sloan and passed by the following vote: Ayes, Trustees, Wilson, Sloan, Young, Richter Noes, Trustees, none Absent, Trustee V;J11kinson Resolution No. 373 A resolution of the Board of Trustees of the city of Newport Deach ordering a certain grant deed recorded was laid on the table subject to the receipt of certificate of title to be procured by the city attorney. 6n the city attorney's advise that the clerk was the only person that was legally entitled to receive tax money at this time the clerk was ordered to assume that responsibility until a tax col - lector had been appointed. Communications to the Board of Trustees were read and re- ferred to the properf; order of business. A communication from the California Library Association in regard to uniform salaries was referred to the library board. The security bond of 'sirs. Miriam Porter for Treasurer of city of Newport Beach, having been approved as to form, etc. on motion of Trustee Sloan seconded by Trustee Richter it was carried by the following vote. Ayes, Trustees, Wilson, Sloan, Young, nichter Noes, Trustees none Absent, Trustees, :'ilkinson The request of the city treasurer for a transfer of three hundred dollars from the general fund to cover expense of the prep- aration of tax schedule for Balboa Island lighting was moved by Sloan seconded by Richter and carried by affirmative vote. 338 n On motion of Trustee Young seconded'by Trustee Sloan the petition of Mr. Ponting to transfer general business license was allowed. On motion of Trustee Sloan seconded by Trustee °ichter four petitions to construct piers presented by Ben Cope were allowed. On motion of Trustee Sloan seconded By Trustee Young the advertising manager's estimate for the month of April was allowed. The communication of 14r. Elrath in answer to the clerk's , offer of seven hundred dollars for the 1/3 acre necessary for re- ' servoir site, refusing same, was read and the city attorney ordered to proceed with condemnation proceedings. On motion of Trustee Sloan seconded by Trustee Young and carried, the request of I«r. Wright to cut curb for entrance to his property was granted. On motion of Trustee Sloan seconded by Trustee Young and carried in regard to the request of the Bay Island Club the board ordered the water superintendent to install a four inch meter in place of the two inch meter now in use. In regard to the petition of O.E. Brown in regard to bet- ter police protection of the pennisula was laid on the table pending appointment of city marshall. On motion of Trustee Sloan s- conded by Trustee Richter and carried the clerk was authorized to draw a warrant for $1354.97 in favor of the First National Bank of Newport Beach to pay off mort- gage and interest due on the library property. On motion of trustee Young seconded by Trustee Sloan and carried the applcation,.6f Hollaway and 'f°lallace to 6perate a flying boat on and above the waters of Newport Bay, was granted subject to the harbor master's approval as to take offs and landings etc. and I also subject to its revocation at the will of the board and the clerk was ordered to notify the Harbor master to that effect. The communications of Advertising Manager recommending certain inovations as to matters of• publicity, the matter was referred back to him for a tentative plan for embodying the approximate cost, schedule, etc. In regard to a communication and resolution presented by the secretary of tba Carmel -San Siamen State Highway association the clerk was ordered to acknowledge same and file. In the matter of a petition of the residents of Newport weights in the question of gas installation the clerk was ordered to notify them that it would be impossible to grant their petition.at the present time, having no funds available for work of that nature. In regard to a resubdivision of a part of Section 5, Balboa Island to be known as tract 742 the matter was laid on the,table pending the appointment of the tax collector for necessary signatures and also for further consideration regarding easments, etc. There being no further business before the board on motion of Trustee Young seconded by Trustee Richter an'' carried the meeting was adjourned to Monday, April 19, at 7: 30 P.
