On motion of Trustee L. S. Wilkinson seconded by Trustee 'Y]
Harry H. Williamson and carried, the request of Antar Deraga for
increase in salary of $75.00 per month, was referred to the Clerk to
write him that if possible the allowance will be made in.next years
budget.
On motion of Trustee Felix B. Modjeska seconded by Trustee
Harry H. Williamson and carried, the application of Ben Cope for
permission to build a pier for N. M. Smith in front of Lot 9. Block
2, Section 1, Balboa Island, was allowed subject to the will of the
Board.
Mr. Grant of Foster & Sleiser Co. brought up the matter of
the change in the bill board ordinance, and Trustee L. S. Wilkinson
introducer( an ordinance amending Ordinance No. 294 of the City of
Newport Beach and repealing that portion of any other ordinance in
conflict therewith. The ordinance was ordered filed, read, con-
sidered, designated Ordinance No. 304 and referred to the City
Attorney.
In regard to the demand of Mrs. Marie A. Hanson for refund
of taxes, the Clerk was instructed to notify her that as the value
was on the premises the refund could not be allowed.
The demand of Jordan & Roehe for $261.51 was discussed, and
on motion of Trustee Harry H. Williamson seconded by Trustee Felix
'B. Modjeska and carried, the bill was allowed.
The demand of Wm. H. Galliene for $100.00 for band for
Fourth of July out of the advertising fund, and the demand of Rodger
w Bros. for $60.00 for use of boat July 4th out of current expense
fund, were allowed.
On motion of Trustee L. S. Wilkinson seconded by Trustee
Harry H. Williamson and carried, the demands in proper form were
allowed and warrants to be drawn for same, and those not signed by
the heads of the departments to be allowed when signed.
There being no further business on motion of Trustee Felix
B. Modjeska seconded by Trustee Harry H. Williamson and carried, the
meeting adjourned Sine Die.

The Board of Trustees of the City of Newport Beach met in
regular session at 7:30 o'clock P. M. on above date. The meeting
was called to order by President Conrad Richter.
The roll was called showing the full Board present.
The minutes of the previous meeting were read and approved.
The reports of the heads of'the departments were read, and
on motion of Trustee Felix B. Modjeska seconded by Trustee L. S.
Wilkinson and carried, the reports were accepted and filed.
Trustee L. S. Wilkinson reported the Finance Committee
meeting in the formation of a budget for the coming year, and had '
Mr. Briggs read the items. He also gave an overlooked report
recommending the purchase of the Truax house on the camp ground on
the basis proposed by Mr. Truax.
The communications were read and referred to the proper
order of business.
A petition having, on the 27th day of July, 1926, been
filed with the Clerk of the City of Newport Beach, the same was
presented to the Board of Trustees for consideration. Witnesses
were sworn and testified and'evidence was received and considered
from which the Board of Trustees find:

(1.) The petition.is.in writing signed by more than 10 %
of all the qualified electors residing in the portion or territory
of the City of Newport Beach which is proposed to be formed into a
municipal improvement district by said petition.
(2.) The petition contains a general desxription of the
exterior boundaries of the proposed district, and a general descrip-
tion of the improvement work to be constructed, to -wit: a public
bathhouse, and is a public improvement which the City of Newport
Beach is authorized by law to construct.
The territory or portion of the City of Newport Beach to
be formed into a proposed municipal improvement district and as set
' forth in the petition is described as follows:
"Beginning at the intersection of the center line of
Tenth Street and the northerly line of Central Avenue; thence north-
easterly along the center line of Tenth Street and along the north-
easterly prolongation of the center line of Tenth Street to a point
in the bulkhead line extending from U. S. Bulkhead Station No. 116
to U. S. Bulkhead Station No. 117, as said bulkhead line and
Bulkhead Stations are laid out and shown upon a Map of Newport Bay
showing harbor lines approved by the War Department, January 18, 1917;
thence northwesterly in a direct line to U. S. Bulkhead Station No.
124; thence northwesterly in a direct line to U. S. Bulkhead Station
No. 125; thence westerly in a direct line to U. S. Bulkhead Station
No. 126; thence westerly in a direct line to the most easterly corner
of Lot 12, Block 636 of a Map of the Canal Section, as recorded in
"Miscellaneous Maps Book 4, page 98, records of Orange County,
California "; thence westerly in a direct line to the most northerly
corner of Lot 10 of the aforesaid Block 636; thence westerly in a
direct line to the most easterly corner of Lot 1, Block 637 of the
aforesaid Map of the Canal Section; thence westerly in a direct line
to the northeasterly corner of Lot 8, Block 638, or the aforesaid
Map of the Canal Section; thence westerly in a direct line to the
northeasterly corner of Lot 8, Block 539 of the aforesaid Map of the
Canal Section; thence westerly in a direct line to the most westerly
corner of Lot 15, Block 441, of the aforesaid Map of the Canal
Section; thence northwesterly in a direct line to the most easterly
corner of Lot 1, Block 244•, of the aforesaid Map of the Canal Section;
thence northwesterly along the northeasterly line of the last
mentioned Block 244 to the northwesterly corner of Lot 7 of the last
mentioned Block 244; thence westerly in a direct line to the most
westerly corner of Lot 8 of Block 145 of the aforesaid Map of the
Canal Section; thence westerly along the westerly prolongation of
the northerly line of the last mentioned Block 145 to its intersection
with the center line of 46th Street; thence southwesterly along the
center line of 46th Street and along the southwesterly prolongation
of the center line of said 46th Street to its intersection with the
southerly boundary line of the City of Newport Beach; thence south-
easterly and easterly along the southerly boundary line of the City
of Newport Beach to its intersection with the southwesterly prolon-
gation of the center line of Tenth*_Street; thence northeasterly
along the southwesterly prolongation of the center line of Tenth
Street, and along the center line of-Tenth Street to the point of
beginning."
The proposed municipal improvement district to be known as,
designated, named and called MUNICIPAL IMPROVEMENT DISTRICT NO. 5
of the City of Newport Beach.
Trustee L. S. Wilkinson thereupon introduced an ordinance of
intention entitled as follows:
An Ordinance of the Board of Trustees of the City
' of Newport Beach, as the legislative body thereof,
declaring its intention to call an election in a
proposed district, as described in the petition therefor,
or as the same may be hereafter modified, for the
purpose of submitting to the qualified electors of said
district, the proposition of authorizing the issuance
and sale of bonds of such district, in the manner and
for the purposes set forth in this ordinance of intention.
The Ordinance was ordered filed, read, considered, designated
Ordinance of Intention No. 305 and referred to the City Attorney.
.On motion of Trustee L. S. Wilkinson seconded by Trustee
Harry H. Williamson and carried, the bonds of E. J. Allen as master
plumber and electrician were accepted.
The property list which was delinquent five years-or more
was presented and referred to the City Attorney for action.
The report of Auditor nriggs stating that he would
recommend a tax refund to Mrs. Mary P. Miller of $38.88 was read, and
on motion of Trustee Fred W. Young seconded by Trustee Felix B.
Modjeska and carried, the refund was allowed and a warrant to be
drawn for same.
On motion of Trustee L. S. Wilkinson seconded by Trustee Fred
W. Young and upon call of the roll duly carried, Mr. Paul E. Kressly,
City Engineer is hereby authorized to mkke application to the Board
of Fire Underwriters for a resurvey of the property in the City of
Newport Beach, as a basis for a rate of fire insurance, and he to
furnish all necessary and required data.
On motion of Trustee L. S. Wilkinson seconded by Trustee
Harry H. Williamson and carried, the request of Water Superintendent
Daley to sell the old pumping equipment at the pumping plant, was
referred to the Water Committee for report.
On motion of Trustee L. S. Wilkinson seconded by Trustee
Harry H. Williamson and carried, the Clerk was instructed to advertise
for bids on a Ford roadster delivery truck for the Sewer Department,
specifications to be furnished by the v+ater Superintendent.
T. E. Hammond's communication referred to the danger of the
Hydroplane operating on the bay, and on *potion of Trustee L. S.
Wilkinson seconded by Trustee Fred W. Young and carried, the Harbor
Master was instructed to communicate with the aviator that he must
start and land at a certain place and dangerous flying must be
discontinued.
On motion of Trustee Harry H. Williamson seconded by Trustee
L. S. Wilkinson and carried, $he application of Ben Cope for permission
to build piers for Mrs. Helena C. Torrance in front of Lot 3, Block 25
Bay Front Section; Estates Investment Co. in front of Lot 1, Block 3,
Section 1, Balboa Island, and W. S. Kersey in front of Lot 9, Block
21, East Side Addition, were granted subject to the will of the, Board.
On motion of Trustee L. S. Wilkinson seconded by Trustee
Felix B. Modjeska and carried, the request of Mr. Briggs that Albin
E. Johnson Co. of Santa Ana be employed to check the yearly audit of
City funds, was granted.
A request signed by the pool room owners of the City asking
that the ordinance pertaining to pool room licenses be changed, was
discussed, and on motion of Trustee Fred W. Young seconded by Trustee
Felix B. Modjeska and carried, the Clerk was instructed to notify
them that the Board does not feel justified in making a change in
the ordinance.'
A request from A. R. Russell asking that he be allowed to
close his live bait stand on the Balboa pier from October lst to
June 1st was discussed, and on motion of Trustee Fred W. Young
seconded by Trustee Felix B. Modjeska and carried, the request was
granted with the understanding that he would keep opem week ends
and holidays when the weather was permissible.
The communication from the Laguna Beach County Water
District complimenting the City on their water supply over the Fourth
of July was to be acknowledged and filed.
On motion of Trustee L. S. Wilkinson seconded by Trustee
Harry H. Williamson and carried, the request of the City of Pomona
to string banners across the streets advertising their Fair, was
granted.
On motion of Trustee Harry H. Williamson seconded by Trustee
Felix B. Modjeska and carried, the request of King C. Gillette for
permission to bulkhead a small strip of City vroperty for the protection
of his own property, was referred to the City Engineer.
The communication from the Balboa Yacht & Swimming Club
asking that the Tournament of Lights parade go by.their Club property
was filed as that was the course outlined.
On motion of Trustee L. S. Wilkinson seconded by Trustee
Felix B. Modjeska and carried, the communication from the Irvine Co.
in regard to the reservoir overflowing back of Corona Del Mar tract,
was refert�ed to the Water Superintendent to take up with Mr. Nimmo
and the Clerk was instructed to write the Irvine Company of the action
taken.
On motion of Trustee Fred W. Young seconded by Trustee
Harry H. Williamson and carried, the request of Kavanagh and Twohy
for 45 days extension of time on their contract, was allowed.

On motion of Trustee L. S. Wilkinson seconded by Trustee
Felix B. Modjeska and carried, the Clerk was instructed to acknowledge
receipt of the Insurance policy on the electric light standards from
the Marbelite Company.
On motion of Trustee Felix B. Modjeska seconded by Trustee
Harry H. Williamson and carried, the re (Ittest of C. H. Hopkins for
permission to drive two piles and extend his pier 50 feet in front of
Lot 170, Block A, East Newport, was granted subject to the usual
restrictions.
The demand of Sandy Winchester for extra salary as life
' guard, rent, etc. was discussed, and on motion of Trustee L. S.
Wilkinson seconded by Trustee Fred W. Young and carried, the matter
was referred to Antar Deraga for a recommendation.
UNFINISHED BUSINESS.
ORDINANCE NO. 301, entitled as follows:
An ordinance of the City of Newport Beach imposing
a license upon all automobile busses operating in the
City of Newport Beach and providing for the collection
thereof;
was taken up for final passage, the roll was called and
the ordinance passed by the vote of the following named members of
the Board of Trustees:
Ayes, Trustees L. S. Wilkinson, Felix B. Modjeska, Fred W.
Young, Harry H. Williamson, Conrad Richter.
Noes, Trustees None.
Absent, Trustees None.
On motion of Trustee L. S. Wilkinson seconded by Trustee
Fred VJ. Young and upon call of the roll duly carried, the Grant Deed
of John L. Plummer, Sr. dated July 13, 1926, to the City of Newport
Beach and the real property therein granted, is accepted on behalf
of the City of Newport Beach.
The City Attorney was granted more time to prepare the
' amendment to the bill board ordinance No. 294.
The Clerk reported that this was the day and hour set for
hearing in the matter of the assessment for the improvement of
portions of Central Avenue and other streets under Resolution of
Intention No. 348. The Clerk further reported that no written
protests or appeals had been filed with him on or prior to the hour
set for hearing.
Whereupon the President of the Board asked if there were any
persons present desiring to be heard upon the matter.
And no person appearing or presenting any objections to the
confirmation of the assessment, Resolution No. 381 was introduced and
adopted by the following vote,.to -wit:
Ayes, Trustees L. S. Wilkinson, Felix B. Modjeska, Fred W.
Young, Harry H. Williamson, Conrad Richter.
Noes, Trustees None.
Absent, Trustees None.
RESOLUTION NO. 382. entitled as follows:
A Resolution of the Board of Trustees of the City
of Newport Beach adopting certain plans for the improve-
ment of certain portions of Central Avenue within said
City.
The resolution was read, considered, designated Resolution
No. 382 and upon call of the roll passed by the following vote:
Ayes, Trustees L. S. Wilkinson, Felix B.' Modjeska, Fred W.
Young, Harry H. Williamson, Conrad Richter.
Noes, Trustees None.
Absent, Trustees None.
RESOLUTION NO. 383, entitled as follows:
A Resolution of the Board of Trustees of the City of
Newport Beach.declaring their intention to order the
improvement of certain portions of Central Avenue within
said City, under the improvement Act of 1911 and the
amendments to said Act.
The Resolution was read, considered,. designated Resolution
No. 383 and upon call of the roll passed by the following vote:

Young, Harry H. Williamson, Conrad Richter.
Noes, Trustees None.
Absent, Trustees None.
Mr. Myers of the Los Angeles Times presented the advantages
of advertising in their midwinter number, and on motion of Trustee
Harry H. Williamson seconded by Trustee Fred W. Young and carried,
the Clerk was instructed to reserve a space of one page in the Los
Angeles Times Midwinter Number to be out about January 1st next.
On motion of Trustee L. S. Wilkinson seconded by Trustee
Fred W. Young and carried, the Clerk was instructed to advertise for
bids on a Police Patrol and Ambulance on specifications to be furnished
by the City Marshal.
On motion of Trustee Harry H. Williamson seconded by Trustee
Fred W. Young and carried, Water Superintendent Daley was allowed two
weeks vacation on pay beginning August 9th.
On motion of Trustee Harry H. Williamson seconded by Trustee
Felix B. Modjeska and carried, the City Engineer was instructed to
prepare proceedings limiting the width of Pacific Drive on Corona Del
Mar.
The requests of Ben Cope for permission to construct piers for
Dr. Seeger, Dr. F. F. Barham and one for Grace B. Evans and Jos. Cornish
were referred to the City Engineer for the customary two weeks.
NEW BUSINESS.
On motion of Trustee Harry H. Williamson seconded by Trustee
Fred W. Young and carried, the demands were allowed and warrants to be
drawn for same.
Trustee L. S. Wilkinson introduced an ordinance providing for
the time in which demands against the City shall be filed, and amending
that portion of any other ordinance in conflict therewith. The
Ordinance was ordered filed, read, considered, designated Ordinance No.
306 and referred to the City Attorney.
On motion of Trustee Harry H. Williamson seconded by Trustee
Felix B. Modjeska the office of Water Superintendent and Sewer Super-
intendent was declared vacant to become effective August 23d by the
following vote:
Ayes, Trustees L. S. Wilkinson, Felix B. Modjeska, Harry H.
Williamson, Conrad Richter.
Noes Trustee Fred W. Young.
Absent, Trustees None.
Stuart A. Cundiff was nominated and on motion of Trustee
Felix B. Modjeska seconded by Trustee Harry H. Williamson and carried,
Mr. Cundiff was appointed to fill the office of Water and Sewer
Superintendent from August 9th.
On motion of Trustee Harry H. Williamson seconded by Trustee
Felix B. Modjeska and carried, the Clerk was instructed to notify the
City Hall help that the office hours were from 8 A. M. to 5 o'clock
P. M. with an hour for lunch.
On motion of Trustee L. S. Wilkinson seconded by Trustee Fred
W. Young and carried, the Clerk was instructed to notify the heads of
the Departments that when leaving the office they leave a memorandum
of when they expect to return.
Mr. Newberg of the Masonic Homes Co. asked if it would not
be possible to have the City Engineer provide for a sea wall around
Section 5 of Balboa Island to protect their property, and on motion
of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and
carried, the City Engineer was instructed to look into the matter and
report to the Board as to the feasibility, and also report the expense
as near as possible.
On motion of Trustee L. S. Wilkinson seconded by Trustee
Harry H. Williamson and carried, the report of the Finance Committee
and the tentative figures as presented in the budget together with the
raise in salaries as given, was adopted.
On motion of Trustee Harry H. Williamson seconded by Trustee
Fred W. Young and carried, Trustee L. S. Wilkinson was granted
permission to leave the state for a period of 60 days.
On motion of Trustee L. S. Wilkinson seconded by Trustee Fred
W. Young and carried, the meeting adjourned to 7 :30 o'c ck P.M. of
Monday, August 23, 1926.
