City Attorney Clyde Bishop brought up the matter of a dam across the old

Attorney was instructed to notify the United States En•ineers Office thct the City

On motion of Trustee Felix B. Locjeska seconded by 2stee ar ry H.

City Hall, Newport Beach, December 6, 1526.
The Board of Trustees of the City of Newport Beach met. in regular
session at 7;30 o'clock P. 1. on above date.. The meeting was called to order by
President Conrad Richter.
The roll was called showing all members present except Trustee Harry H.
Williamson.
The minutes of the previous meeting were read and approved.
The reports of the heads of the departments were read and on motion of
Trustee Felix B. Modjeska seconded by Trustee Fred W. Young and carried, the
reports were accepted and filed.
As Trustee Harry H. Williamson was not present President Richter
appointed Trustee Fred W. Young on the Finance Committee for the evening.
The communications were read and acted on as follows:
The request from Ray C. Bell, Roy Long, Hugh 1 :c Millan and Frank Suttora
for permission to erect a temporary structure on the ocean front immediately
westerly of the public comfort station, until the new building on the ground where
their present business is located is completed, was discussed, and on motion of
Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and carried, the
request was granted with the understanding that the structure be rerroved as soon
as the new building is completed, and the City Attorney was instructed to draw up
a lease on same.
The communication from The Whiting Company in regard to interrupting their
' sewer line on Corona Del Lar during paving; proceedings, was referred to the City
Engineer.
The request of Panola D. Pogue and Samuel Tustin to abandon 25 feet of
Pacific Drive between larkspur and i;arguerite Avenues on Corona del E.Lar was
discussed, and on motion of Trustee L. S. Wilkinson seconded by Trustee Felix B.
Modjeska and carried, the petitioners request was granted and. the necessary steps
taken to - abandon the 25 foot strip between the points named, the matter of, other
wor£ agreed to by them to be taken up with a sufficient number. of the other property
owners to assure its beinP done.
On motion of Trustee L. S. Wilkinson seconded by Trustee Fred W. Young
and carried, the request of Water Superintendent Cundiff for transfer of $1,500.00
from budget fund 1do. 482 -3 to fund No. 484 -A was granted.

On motion of Trustee Fred W. Young seconded by Trustee Felix B. 2odjeska
and carried, the request of Auditor R. S. Briggs for transfer of $100.00 from
Police Officers salary account to Miscellaneous expense of Police Department was
granted..
On motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska
and carried, the request of A. R. Russell for extension of time of payment on his
contract from December 1st 1926 to Junerl, 1927 was granted with instructions that
it must be paid at that time.
The communication from the War Department in regard to Laguna Beach Water
line was filed.
On motion of Trustee Felix B. Podjeska seconded by Trustee Fred W. Young
and carried, the estimated expense of the Advertising Manager for December of
$85.00 was allowed.
The request of Jack Riggs that the City pay a motorcycle repair bill of
$28.60 was discussed, and on motion of Trustee Felix B. Modjeska seconded by Trustee
L. S. Wilkinson and carried, the Clerk was instructed to notify him that the demand
could not be allowed until it had the endorsement and approval of the head of the
department.
On motion of Trustee Fred 7;. Young seconded by Trustee Felix B. Modjeska
and carried, the amount o` the insurance policies on water equipment of $5,391.20
was transferred from the unappropriated fund-to Insurance Account of the {later
Department.
The communication from Antar Deraga asking for the establishment of an
Airway Beacon on the bluff overlooking Newport Bay was discussed, and on motion of
Trustee Fred W. Young seconded by Trustee Felix B. Modjeska and carried, the Chair
was instructed to appoint a committee consisting of three-Trustees and two Citizens
with power to act, and to report on same at the next meeting. The Committee appointed
is Trustees L. S. Wilkinson, Felix B. Modjeska and Fred W. Young aid J. P. Greeley
and Ray C. Bell.

was called and the ordinance passed by the vote of the following named members of
the Board of Trustees:
Ayes, Trustees L. S. Wilkinson, Felix B. Modjeska, Fred 17. Young,
Conrad Richter.
Noes, Trustees NONE-.
Absent, Trustee Harry H. Williamson,
and was thereupon signed and approved by the President of the Board and
attested by the Clerk.
Trustee L. S. Wilkinson introduced a Resolution declaring it to be the
intention of the Board of Trustees of the City of Vewport Beach to order trees,
shrubs, plants and grass to be planted, protected and maintained upon and along the
southwesterly side of Avocado Avenue and certain other streets and portions of
streets, courts and places within the City of Newport Beach.
The Resolution was ordered filed, read, considered and referred to the
City Attorney.
NEW BUSINESS.
On motion•of Trustee L. S. Wilkinson seconded by Trustee Fred r. Young
and carried, the demands which are in proper form and approved by the Finance
Committee were allowed and warrants to be drawn for same.
On motion of Trustee L. S. Wilkinson seconded by Trustee Fred W. Young
and carried, the demands for refund of taxes were referred to the Treasurer for an
affidavit of claimants as to reason for a refund, and to be approved by the City
Assessor.
Trustee L. S. Wilkinson brought up the matter of having some seats on
the land end of the wharf which was discussed, and on his motion seconded by Trustee
Fred T.T. Young and carried, the Street Superintendent was instructed to ascertain the
cost of 12 comfortable benches about 12 or 14 feet long, 6 for Newport wharf and
6 for Balboa wharf, and to -report on same at next meeting.

The President was authorized to issue a proclamation requesting that all
business house.s in the City be closed on Tuesday afternoon, December 14th so that
everyone can get out and work for the Harbor Bond election.
H. B. King brought up the matter of tryine to convince the different
colleges and athletic associations of the advantages of-Newport Bay for their
rowing matches.. The matter was discussed and on motion of Trustee Felix B.
Modjeska seconded by Trustee Fred N. Young and carried, the matter was referred to
the Advertising ?anager, Harry Welch.
City. Treasurer, R. S. Briggs, stated that Rodger Brothers were witbholding
sending in their barge receipts owing to a misunderstanding of their contract, and
on motion of Trustee Felix B. t,.odjeska seconded by Trustee Fred C1. Young and
carried, the Clerk was instructed to notify them to send in the amount due at once
with. a certified report of same.
The City Treasurer also stated that Leo ::;. :Yilleford was bac'c on payments
on his lease, and on motion of Trustee Fred W. Young seconded by Trustee L. S.
Wilkinson acid carried,, the Clerk was instructed to notify him to. pay up the amount
due within three days or the matter would be placed in the hands of the Police
Department and, the lease revoked.
There being no further business on motion of Trust Felix B. 'odjeska
seconded by Trustee Fred N. Young and carried, the meeting journed to :30 o'clock

adjourned session at 7:30 o'clock P. 11. on above date.. The meeting was called to
ordor by Presi-dent Conrad. Richter.
The roll was called showing the full Board present.

This being the time fixed for opening bids for certain work on certain
portions of Seaview Avenue and certain other streets and avenues in Corona del L >ar,
within the City of Newport Beach,. as contemplated by Resolution of Intention No. 396
